RE: IMPLEMENTATION OF THE FCC’S SLAMMING RULES
Bev and I have discussed how to implement the FCC’s slamming rules. As you know, the FCC has issued new rules implementing procedures and remedies concerning slamming complaints. However, the slamming rules are currently being “held” by the Office of Management and Budget (OMB). The FCC anticipates that OMB will release these rules within the next 60 days. After the FCC slamming rules are released, the FCC will publish a notice in the Federal Register establishing an effective date for these rules.
I believe that the most effective way to implement the FCC slamming rules is to issue temporary and proposed rules at the same time. As the Commission knows, temporary rules can only be issued upon the Governor’s approval. Attached for your review is a draft of the “Proposed Administrative Rules Form” that is submitted to DFM for gubernatorial approval. Also included for your information are the temporary and proposed rules that would implement the FCC’s slamming rules.
Before we proceed further, Bev and I thought it would be helpful to meet with the Commission to explain and discuss the implementation procedures. Perhaps we could meet after the decision meeting on October 10?
