GNR-T-00-27 FILE FROM: JOHN HAMMOND DATE: JANUARY 24, 2003 RE: IN THE MATTER OF PROPOSED REVISIONS TO THE COMMISSION’S OPERATOR SERVICES AND PAY TELEPHONE RULES (IDAPA 31.51.01.000). On August 24, 2000, the Commission on its own Motion initiated this proceeding to examine what changes should be made to its Operator Services and Pay Telephone Rules, IDAPA 31.51.01.000 et seq. to accommodate changes to federal law. Notice of Public Workshop and Negotiated Rulemaking, Order No. 28476. On September 27, 2000, a public workshop was held to discuss proposed changes to these rules. After consensus was reached among the parties about the form and content of the proposed rules the Commission adopted them and issued a Notice of Proposed Rulemaking on May 25, 2001. This Notice started a new case, Case No. 31-5101-0101. No further action was taken in Case No. GNR-T-00-27 by the Commission. In Case No. 31-5101-0101, after receiving comments from the parties the Commission entered General Order No. 210 adopting the pending rules and submitted them to the 2002 Idaho State Legislature for its review. On March 15, 2002, the Legislature approved these amended rules. Accordingly, Case No. 31-5101-0101 was closed. However, Case No. GNR-T-00-27 that began the process to amend the Operator Services and Pay Telephone Rules has remained open, albeit inadvertently. Case No. GNR-T-00-27 is moot as the most current version of the Operator Services and Pay Telephone Rules were approved by the Legislature on March 15, 2002, in Case No. 31-5101-0101. Accordingly this case is now closed.
