On May 25 , 2001 , the Commission granted Essex Communications, Inc. dba eLEC
Communications, Inc. (Essex) a Certificate of Public Convenience and Necessity (No. 387) to
provide basic local exchange service in the State of Idaho. On June 12, 2003 , the Commission
Staff received correspondence from Maria A. Abbagnaro, General Counsel for Essex, advising
that the Company wished to voluntarily relinquish its CPCN and have the Commission cancel its
tariffs without prejudice. The letter also advised the Commission that the Company is not
currently operating in the State, thus, there are no customers to notify of its withdrawal from the
telecommunications market in the State of Idaho. Based on this record, Essex s CPCN and
tariffs on file with the Commission are withdrawn without prejudice.
ORDER
IT IS HEREBY ORDERED that Essex Communications Inc. dba eLEC
Communications, Inc.'s Certificate of Public Convenience and Necessity No. 387 is withdrawn
without prejudice.
IT IS FURTHER ORDERED that all Essex s tariffs filed with the Commission shall
be withdrawn.
THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally
decided by this Order) or in interlocutory Orders previously issued in this Case No. GNR-OO-
26 may petition for reconsideration within twenty-one (21) days of the service date of this Order
with regard to any matter decided in this Order or interlocutory Orders previously issued in this
case. Within seven (7) days after any person has petitioned for reconsideration, any other person
may cross-petition for reconsideration. See Idaho Code 99 61-626 and 62-619.
