FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE TELECOMMUNICATIONS SERVICES. ) ) ) ) ) ) ) CASE NO. GNR-T-00-10 ORDER NO. 28452 On March 16, 2000, NOW Communications, Inc. filed an Application for a Certificate of Public Convenience and Necessity to provide competitive local telecommunications exchange services within the state of Idaho. NOW proposes to provide only residential local exchange service pursuant to resale agreements with incumbent local exchange companies. NOW intends to provide all residential retail services offered by ILECs for resale to competing carriers, and would provide local telecommunication services in the areas served by U S WEST and GTE Incorporated. NOW recently purchased TelLink LLC, which holds a CPCN approved by the Commission in Case No. TLI-T-97-1. TelLink is a wholly-owned subsidiary of NOW. On June 13, 2000, the Commission issued a Notice of Application and Notice of Modified Procedure to process NOW’s Application. Written comments were filed only by the Commission Staff during the comment period. Staff’s comments state that the Company has submitted all the information required by the Commission in Order No. 26665 and the Commission’s rules. Staff recommended approval of the Application of NOW Communications, Inc. for a Certificate of Public Convenience and Necessity. COMMISSION FINDINGS Based on our review of the record, including the filed written comments and Staff’s recommendation, we find that the Application of NOW complies with Procedural Order No. 26665 and the Commission’s Rules to obtain a Certificate of Public Convenience and Necessity. O R D E R IT IS HEREBY ORDERED that NOW Communications, Inc. is granted a Certificate of Public Convenience and Necessity to provide local telecommunications services within the areas of Idaho currently served by U S WEST and GTE Northwest Incorporated. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61626.
