CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY

On March 9, 2000, an Application for a Certificate of Public Convenience and Necessity was filed by Maxcess, Inc. Maxcess seeks authorization to provide local exchange telecommunication services within the state of Idaho, and intends to provide resold and facilities-based local exchange service throughout the areas served by U S WEST and GTE. On April 10, 2000, the Commission issued a Notice of Application and Notice of Modified Procedure. Comments were filed only by the Commission Staff. Staff recommends approval of the Application conditioned, however, on the procurement by Maxcess of a performance bond in the amount of $150,000. Maxcess is a start-up company and does not expect to generate a positive cash flow during an initial period of operation. Staff thus recommended that a performance bond be in place for a period of two years.
Staff recommends the Application of Maxcess for a Certificate of Public Convenience and Necessity be approved, conditioned on the procurement of a performance bond by Maxcess in the amount of $150,000 to be in effect for a period of two years.
