FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY; CASE NO. GNR-T-00-3. On January 25, 2000, American Fiber Network, Inc. filed an Application for a Certificate of Public Convenience and Necessity in compliance with Commission Rules of Procedures, IDAPA 31.01.01.111 and Procedural Order No. 26665. American Fiber states that it intends to provide resold and facilities-based, switched and dedicated local exchange services; resold and facilities-based interexchange services; and operator services in Idaho. On September 12, 2000, the Commission issued a Notice of Application and Modified Procedure. The Commission Staff was the only person to file written comments and it supported the issuance of the certificate. BACKGROUND American Fiber is a Delaware corporation seeking to provide local exchange telecommunications services in the state of Idaho. American Fiber does not currently own facilities in Idaho. It intends to initially resell network and other services of other incumbent and competitive LECs within Idaho. American Fiber does not intend to provide local exchange service in areas currently served by rural telecommunications carriers as defined by the federal Telecommunications Act of 1996. The Company stated it intends to provide competitive local exchange services to business and residential customers throughout Qwest (formerly U S WEST) and Verizon (formerly GTE) service areas in Idaho. STAFF COMMENTS Staff reviewed American Fiber’s Application and concluded American Fiber understands the Commission’s rules and requirements. American Fiber requested a waiver of the escrow account requirement for deposits as the Company does not anticipate collecting deposits from its customers. Staff supports the Company’s request for a waiver. RECOMMENDATION Based on Staff’s review of American Fiber’s Application, Staff concluded that the Company meets the requirements of the Commission’s Rules and recommended the Commission approve the Application.
