HomeMy WebLinkAbout20110124final_order_no_32164.pdfOffice of the Secretary Service Date January 24 2011 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF AMERICAN FIBER NETWORK, INc.'S REQUEST FOR CANCELLATION OF CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY NO. 382 CASE NO. GNR- T -00- ORDER NO. 32164 On December 23 2010, American Fiber Network, Inc. requested that its Certificate of Public Convenience and Necessity (CPCN) No. 382 issued by the Commission on October 12, 2000 be withdrawn. American Fiber stated it is exiting the industry and no longer plans to provide telecommunications services in the State ofldaho. The Company stated that it currently provides long-distance services to four customers in Idaho, in addition to limited payphone services. The Company stated it notified customers on December 15, 2010, by mail that it was discontinuing service. A copy ofthe notice was provided with its request to cancel. Upon further inquiry by Staff American Fiber indicated that it had not been contacted by any customers. American Fiber intends to discontinue all services as of January 21 , 2011. In its Decision Meeting on January 19, 2011 , the Commission approved American Fiber s request for cancellation of Certificate No. 382. COMMISSION FINDINGS In January 2000, American Fiber Network, Inc. filed an Application for a CPCN to provide resold and facilities-based local exchange and interexchange services within the State of Idaho, and in October 2000, the Commission granted American Fiber s Application for a CPCN. Order No. 28541. On December 23, 2010, American Fiber requested cancellation of its Certificate and stated that it no longer plans to provide services in Idaho as ofJanuary21 , 2011. Staffrecommended the Commission cancel Certificate No. 382 and remove the Company s price list or tariff on file. ORDER IT IS HEREBY ORDERED that American Fiber Network, Inc.s request for cancellation of Certificate of Public Convenience and Necessity No. 382 is granted. Certificate No. 382 is no longer in effect, and American Fiber is no longer authorized to provide telecommunications services in the State ofldaho. ORDER NO. 32164 THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory Orders previously issued in this case may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this case. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ ~ 61-619 and 61-626.
