On August 2, 2000, GTE Northwest Incorporated, now Verizon Northwest Inc., filed a Motion to Suspend Docket and requested expedited consideration. GTE/Verizon contends that the dockets should be suspended in light of its appeal of the Fifth Circuit Opinion in GTE Service Corp. v. FCC, 183 F.3d 393 (5th Cir. 1999) and the recent Eighth Circuit opinion on remand in Iowa Utilities Board v. FCC. According to its Motion, the constitutionality of the FCC’s decision to use the FCC Synthesis Model at issue in these dockets will be decided by the United States Supreme Court which has clear implications for this Commission’s decision. GTE/Verizon is requesting a suspension of eight weeks.
Because the time is short, the Commission orders all parties to file replies to the GTE/Verizon Motion by close of business Monday, August 7, 2000.
