GNRT001 ORDER NO. 28431 On January 6, 2000, the Commission received an Application from FairPoint Communications Corporation dba FairPoint Communications Solutions Corporation (FairPoint) for a Certificate of Public Convenience and Necessity to provide local exchange service, resold local exchange service and interexchange service as a competitive local carrier within U S WEST Communications, Inc.’s and GTE Northwest Inc.’s respective service territories. Application at 1. On May 26, 2000, the Commission ordered the Application be considered under Modified Procedure. Order No. 28382. Only the Commission Staff filed comments on June 16, 2000, and it recommended the Application be approved. Based on the comments, the law and the record, the Commission grants the Application. The Commission further finds that the Certificate should be issued in FairPoint’s new name -- FairPoint Communications Solutions Corporation. COMMISSION FINDINGS On January 6, 2000, FairPoint Communications Corporation filed an Application for a Certificate of Public Convenience and Necessity to provide basic local services in the serving areas currently served by U S WEST and GTE. The Commission finds that according to its Application, FairPoint proposes to immediately provide local exchange services to business and residential customers. Initially it will lease and resell various types of exchange and carrier access lines, including local switched services, unbundled local links or ports, switched and special access service, and information services. It will also provide MTS, WATS, Foreign Exchange Service, private lines, tie lines, cellular services, PCS services, Internet services and other services and facilities of communications common carriers and other entities. The Commission finds that FairPoint was incorporated in Delaware in January 1998. It is a wholly-owned subsidiary of MJD Communications, whose business address is in Charlotte, North Carolina. MJD owns or has a controlling interest in fifteen communications-related businesses. To support its Application, FairPoint submitted the financial statements of its corporate parent that revealed about one-half billion dollars in assets and submitted illustrative tariffs. FairPoint stated that it has reviewed all of the Commission rules and agrees to comply with them. Staff recommended the Commission approve FairPoint’s Application. Therefore, the Commission finds that FairPoint meets the requirements for the issuance of a Certificate of Public Convenience and Necessity and hereby approves its Application. Commission further finds that a Certificate of Public Convenience and Necessity should be issued in its new name, FairPoint Communications Solutions Corporation. O R D E R IT IS HEREBY ORDERED that FairPoint Communications Solutions Corporation is granted a Certificate of Public Convenience and Necessity to provide local telecommunications service in the areas presently served by U S WEST and GTE. THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory Orders previously issued in this Case No. GNR-T-00-1 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. GNR-T-00-1. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61626.
