On January 22,2010, the Commission issued Order No. 30984 approving Greenfly
Networks, Inc. dba Clear Communications' Application for a Certif,rcate of Public Convenience
and Necessity. Within that Order, the Company was directed to file a final and complete price
list with the Commission containing all of its rates, terms and conditions no later than fourteen
(14) days from the service date of the Order. To date, Greenfly has yet to file its tariff/price list
with the Commission. As a result of its non-compliance, Greenfly has never been issued a
Certificate. Staff has attempted to contact the Company on numerous occasions to file its
tariff/price list. The Company has remained non-responsive.
On February 15,2014, a new procedural rule, Rule 18.02, became effective that
authorizes the Commission to administratively remove utilities and railroads from the list of
utilities subject to an annual regulatory fee if they (l) fail to pay their special regulatory fees; (2)
are no longer conducting business in Idaho; and (3) fail to maintain a designated agent for
service with the Commission Secretary. IDAPA 31.01.01.018.02. At the March 31,2014,
Decision Meeting, Staff notified the Commission that 225 telephone companies meet the criteria
of Rule 18.02. Greenfly was among the telephone companies included on the list. Staff
recommended the Commission administratively remove the applicable companies from the
assessment list. The Commission adopted Staffs recommendation. Consequently, Staff
considers Case No. GFN-T-09-01 closed.
