HomeMy WebLinkAboutWHETTON.docxApril 17, 1997 VIA FED EX Mr. Randy Whetton, Vice President NICS 851 C 1st South Arcadia, CA 91017 RE: Submission of Idaho Price Lists   Dear Mr. Whetton: The Commission Staff has asked me to forward for your attention the price list NICS submitted on April 15, 1997.  Title 62 telecommunications corporations (such as NICS) providing MTS or WATS are required to file price lists which reflect “the availability, price, and terms and conditions for those services.”  Idaho Code § 62-606.  Normally these price lists are “accepted for filing” unless the price lists are incomplete.  The Staff has reviewed your price list submitted on April 15, and determined that your price list is deficient as outlined in greater detail below. Your price list does not adequately describe the services you offer and the terms and conditions under which such services are offered to Idaho customers.  An example of what is acceptable is contained on the green pages of the enclosed booklet and in the Group III price list.  Although our records reflect that you were sent this booklet, I have enclosed another one.  To assist you in making the necessary changes, the booklet also contains our Title 62 Rules 203 and 204 (IDAPA 31.42.01.203-204) as well as an example of product or service descriptions contained in another price list.  In addition, interstate services and Internet services should not be included in your price list.  Once you have made the necessary corrections, please submit an original and three copies of your price list. The Staff has also received complaints that some of your customers have been unable to access your calling facilities or have been unable to reach your customer service office.  Our attempts to reach your customer service office at 888-252-6848 or 888-445-4547 have also been unsuccessful.  When you resubmit your price list, please advise the Staff of the cause of customers being unable to access your facilities and whether this difficulty (and the difficulty in reaching your customer service office) are isolated occurrences and/or have been corrected.  It would also be helpful if you could describe how your network or system is configured and how it operates. Although the Commission does not set the prices for Title 62 services, it does retain jurisdiction over the Title 62 services.  In addition, Title 62 companies providing MTS or WATS services must remit a surcharge to the Idaho USF and Telecommunication Relay Services (TRS) Administrators.  The USF Administrator is Alyson Anderson, 3785 Williamsburg Way, Boise, ID 83706-5605 (208-342-1868) and the TRS Administrator is Bob Dunbar, PO Box 775, Donnelly, ID 83615 (208-325-8308). Please correct your price list and resubmit it no later than May 1, 1997.  If you have questions concerning the contents of this letter, please contact Joe Cusick at (208) 334-0333 or Birdelle Brown at (208) 334-0352.
