Dear Gary:
Pursuant to our telephone conversation of last Friday, I have enclosed for your review several documents relating to the federal Telecommunications Act, state legislative activities, and access to rights-of-way.  More specifically, the documents I have enclosed include: (1) the federal Telecommunications Act of 1996; (2) the FCC’s Notice of Proposed Rulemaking (3) the FCC’s interconnection rules implementing the federal Act; (4) proposed industry legislation to amend Idaho law addressing access to public rights-of-way; and (5) a state-by-state comparison of electrical rates.
I have tabbed that portion of the FCC’s rules addressing access to rights-of-way.  You’ll note that I have changed the paragraph number from 135 to 1119 at the tab at page 503.  Unfortunately, our electronic reproduction of the FCC’s rules renumbered the paragraphs starting at paragraph 985.  In addition, approximately 30 parties have appealed these rules to the Eighth Circuit.  The Eighth Circuit has temporarily stayed the rules until it can rule on the stay petitions.  At this writing, the Court  has not issued a final ruling on the stays but the appeals are scheduled for oral argument in January 1997.
