Mark Street Marksville, LA 71351 RE: Refund Due Idaho Customer Mabel Deforest Dear Mr. Cotton: I understand you have been contacted several times by the Staff of the Idaho Public Utilities Commission regarding an over charge by Infinity Networks, Inc. (“Infinity”) to an Idaho telephone customer, Mabel Deforest. Telephone calls made between Bruneau, Idaho and Mountain Home, Idaho between January 12 and February 4, 2001 were billed to Ms. Deforest as long-distance, toll calls by Infinity. As you have been informed, the communities of Bruneau and Mountain Home are within an extended local calling area, and thus Inifinity improperly billed toll charges for the calls. Ms. Deforest is entitled to a refund from Infinity in the amount of $298.70. In addition to providing a refund for the amount improperly billed, Infinity must reprogram the telephones over which the calls were made to prevent any further improper charges to customers. Please contact Wayne Hart of the IPUC Staff no later than May 25, 2001 to advise him of the remedial actions taken by Infinity. If the IPUC Staff has not received adequate information from Infinity by May 25, 2001, Staff will advise the IPUC Commissioners of the status of Ms. Deforest’s complaint. If Infinity has not corrected its billing error and ensured similar mistakes will not be made in the future, Staff will ask the Commission to consider all available legal remedies, including monetary penalties and revocation of Infinity’s authority to conduct business in Idaho.
