COMMENTS OF THE
COMMISSION STAFF
STAFF OF the Idaho Public Utilities Commission, by and through its Attorney of
record, Matt Hunter, Deputy Attorney General, submits the following comments.
BACKGROUND
On August 20,2019, GC Pivotal,LLC d/b/a Global Capacity ("Pivotal") applied to the
Commission for a Certificate of Public Convenience and Necessity ("CPCN") authorizing it to
provide resold local exchange telecommunications services in Idaho pursuant to IDAPA
3 I .0 I .01 . 1 14 and Commissioner Order No. 26665.
STAFF ANALYSIS
Pivotal is a Delaware limited liability company authorized to do business in Idaho and is
located at7900 Tysons One Place, Suite #1450, Mclean, Virginia 22102. It is registered with
the Idaho Secretary of State and its Idaho Certificate of Authority is attached to its Application.
Its Foreign Certificate of Registration is attached to the Application as Exhibit A.

Pivotal proposes, and requests authority, to "provide local telecommunications service to
business customers." Pivotal plans to "offer service through UNE-P facilities and resale
arrangements with incumbent local exchange carriers." Application at 2. Pivotal intends to offer
service in the geographic areas currently served by Qwest Communications d/b/a CenturyLink.
Application at 3.
Pivotal agrees to comply with all Commission rules. Application at 3. The Application
included Pivotal's financial statements. See Exhibit D.
STAFF RECOMMENDATION
Staff has reviewed Pivotal's Application for a CPCN and believes the Company
understands and agrees to comply with the Commission's rules and requirements. Based on the
review, Staff believes Pivotal's Application fulfills the requirements of the Commission Rules
and Procedural Order No. 26665. Staff also believes Pivotal possesses the requisite financial,
managerial, and technical qualifications necessary to operate as a provider of
telecommunications services.
Staff, therefore, recommends approval of the Application for a Certificate of Public
Convenience and Necessity subject to the following conditions:
1. Pivotal complies with number pooling and reporting requirements of the North
American Numbering Plan Administrator, as set forth in Commission Order No. 30425;
2. Pivotal provides necessary reports and contributions as appropriate to the Idaho
Universal Service Fund , Idaho Telecommunications Relay Services, Idaho Telecommunications
Service Assistance Program, and complies with all future reporting requirements deemed
appropriate by the Commission for competitive telecommunications providers;
3. Prior to issuance of the Certificate, Pivotal files a final price list outlining all its rates,
terms and conditions with the Commission; and
4. Envision shall provide three reports to the Commission indicating the number of basic
local exchange customers it has and the services being offered. Those reports will be due as
follows:

a. February 19,2020
b. June 17,2020
c. October 18,2020
If the Company fails to provide the three reports, the Company shall relinquish its CPCN and all
telephone numbers it has been assigned.
