FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE RESOLD LOCAL EXCHANGE AND INTEREXCHANGE SERVICES. CASE NO. FRN-O4- NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29693 NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that on December 23 , 2004, France Telecom Corporate Solutions L.C. (FTCS; Company) filed an Application for a Certificate of Public Convenience and Necessity with the Commission to provide local exchange and toll services throughout the State of Idaho. Procedural Order No. 26665; IDAPA 31.01.01.111. According to its Application FTCS is a Delaware limited liability company with a corporate office in Herndon, Virginia. FTCS is majority-owned and controlled by France Telecom S., a publicly traded company on both the Paris Stock Exchange and the New York Stock Exchange. FTCS has a Certificate of Good Standing issued by the Idaho Secretary of State on September 16, 2004 and although the Company does not maintain an office in Idaho, it does have a registered in-state agent. YOU ARE FURTHER NOTIFIED that FTCS requests authority to provide all forms of local exchange and interexchange telecommunications services in Qwest and Verizon' s service territories throughout Idaho. In addition, FTCS plans to provide resold commercial mobile radio services. FTCS agrees to provide service in accordance with all applicable statutes administrative rules, and orders of the Commission. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has reviewed the Application in this case. The Commission has preliminarily determined that the public interest in this matter may not require a hearing to consider the issues presented, and that the issues NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29693 raised by the Application may be processed under Modified Procedure, i., by written submission rather than by hearing. IDAP A 31.01.01.201 - 204. YOU ARE FURTHER NOTIFIED that the Commission may not hold a hearing in this proceeding unless it receives written protests or comments opposing the use of modified procedure and stating why modified procedure should not be used. IDAP A 31-01-01.203. YOU ARE FURTHER NOTIFIED that the deadline for filing written comments or protests with respect to the Application of FTCS or the use of Modified Procedure in Case No. FRN-04-1 is twenty-one (21) days from the service date of this Order. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. ORDER IT IS HEREBY ORDERED that the Application of France Telecom Corporate Solutions L.C. be processed by Modified Procedure, IDAPA 31.01.01.201-204.
