HomeMy WebLinkAbout20100628_3012.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER KEMPTON COMMISSIONER SMITH COMMISSIONER REDFORD COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: WELDON STUTZMAN DEPUTY ATTORNEY GENERAL DATE: JUNE 24, 2010 SUBJECT: SILVER STAR COMMUNICATIONS’ MOTION TO EXTEND DATE FOR COMPLYING WITH COMMISSION ORDER NO. 30951, CASE NO. SIL-T-10-01 On December 4, 2009, the Commission issued Order No. 30951 directing that Universal Service Fund levels for the recipient companies be adjusted, and also notifying the recipient companies that they needed to raise their residential rates to $25.76. All but Silver Star Communications have filed tariffs to increase their residential rate as directed by the Commission in Order No. 30951, and to comply with State law regarding USF eligibility requirements. On June 22, 2010, Silver Star filed a request to delay until September 1, 2010, its rate increase. Silver Star states that it is in the middle of a system conversion that is scheduled to be substantially complete on July 1, 2010. To avoid service disruptions to customers, Silver Star requests that it be allowed until September 1, 2010, to file its revised tariffs as required by Order No. 30951. Staff recommends the Commission treat Silver Star’s request as a motion and approve it to give the Company until September 1, 2010, to file revised tariffs as the Commission directed. Staff further recommends the Commission in its Order notify Silver Star that if it fails to revise its rates by September 1, 2010, that its USF funding will be removed for the Company’s failure to comply with the statutory USF requirements. DECISION MEMORANDUM 2 COMMISSION DECISION Should the Commission issue an Order approving Silver Star’s Motion to delay implementation of its revised residential service rates until September 1, 2010, and state in the Order that if the Company fails to comply by that date its USF funding will be terminated?
