HomeMy WebLinkAbout20140916final_order_no_33127.pdfOffice of the Secretary Service Date September 16,2014 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION OF ) BLACKFOOT COMMUNICATIONS,INC.TO )CASE NO.FRC-T-99-O1 TRANSFER CERTIFICATE OF PUBLIC ) CONVENIENCE AND NECESSITY NO.370 ) FROM FRETEL COMMUNICATIONS,LLC TO ) BLACKFOOT COMMUNICATIONS,INC.DBA )ORDER NO.33127 FREMONT COMMUNICATIONS ) On September 2,2014,the Commission received a letter from Blackfoot Communications,Inc.requesting the transfer of Certificate No.370 from Fretel Communications,LLC (“Fretel”)to Blackfoot Communications,Inc.dba Fremont Communications (“Blackfoot”or “Company”).The Company states that Fretel will merge into Blackfoot effective October 1,2014.The merger will be transparent to the customers and will not change the way business will be conducted.Both Fretel and Blackfoot are wholly-owned subsidiaries of BTC Holdings,Inc.A Price List with the new name was included with the letter. STAFF RECOMMENDATION Staff has reviewed Blackfoot’s request,including the Company’s price list.Staff believes that Blackfoot is compliant with the requirements of Procedural Order No.26665 and IDAPA 31 .01.01.111 and 112 (Rules 111 and 112).Staff believes the Company possesses the requisite financial,managerial,and technical qualifications necessary to effectively operate as a telecommunications provider within the State of Idaho and recommended the Commission approve Blackfoot’s Application. COMMISSION FINDINGS Based upon the record in this case,the Commission grants the Company’s Application.The Commission finds that the request to transfer Fretel’s Certificate is essentially a corporate structure name change,that this change does not appear to effect individual customer service in any way,and that the Application satisfies the requirements of the Commission’s Rules and Procedural Order No.26665.Thus,we approve Blackfoot’s Application to transfer Certificate of Public Convenience and Necessity No.370. ORDERNO.33127 1 ORDER IT IS HEREBY ORDERED that Certificate of Public Convenience and Necessity No. 370 previously issued to Fretel Communications,LLC to provide telecommunications services within the State of Idaho is transferred to Blackfoot Communications,Inc.,dba Fremont Communications. THIS IS A FINAL ORDER.Any person interested in the Order may petition for reconsideration within twenty-one (21)days of the service date of this Order with regard to any matter decided in this Order.Within seven (7)days after any person has petitioned for reconsideration,any other person may cross-petition for reconsideration.See Idaho Code §61- 626.
