DBA FAIRPOINT COMMUNICATIONS SOLUTIONS CORP. TO WITHDRAW CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY NO. 374 CASE NO. GNR-OO- ORDER NO. 29295 On July 19, 2000, the Commission granted FairPoint Communications Corp. dba FairPoint Communications Solutions Corp. (FairPoint) a Certificate of Public Convenience and Necessity (No. 374) to provide prepaid telecommunications services, including basic exchange services, within the State of Idaho. In November 2001 , FairPoint advised the Commission that as of February 1 , 2002 it intended to discontinue telephone services to its local and long-distance end user retail customers in the State of Idaho. The Company requested that its Certificate remain on file pending further--review of market conditions. FairPoint indicated it would notify the Commission when it decided to relinquish or cancel its Certificate. On June 24, 2003 , the Commission Staff received correspondence from John J. La Penta, Assistant General Counsel for FairPoint, advising that the Company wished to voluntarily relinquish its CPCN and have the Commission cancel its tariffs without prejudice. Based on this record, FairPoint's CPCN and tariffs are withdrawn without prejudice. ORDER IT IS HEREBY ORDERED that FairPoint Communications Corp. dba FairPoint Communications Solutions Corp.'s Certificate of Public Convenience and Necessity No. 374 is withdrawn without prejudice. IT IS FURTHER ORDERED that all FairPoint's tariffs filed with the Commission shall be withdrawn. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. GNR-00- may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or interlocutory Orders previously issued in this case. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code gg 61-626 and 62-619.
