WALKER DATE:FEBRUARY 27, 2006 SUBJECT:APPLICATION OF EXTREME MEDIA TECHNOLOGIES INC. DBA XMT3 FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY - CASE NO. EXT-05- On January 5, 2006 , Extreme Media Technologies Inc. dba XMT3 (Company) filed an Amended Application for a Certificate of Public Convenience and Necessity with the Idaho Public Utilities Commission (Commission). The Application seeks authority for the Company to provide basic local exchange telecommunications services throughout Qwest Corporation southern Idaho territory. The Commission issued a Notice of Application and Modified Procedure, Order No. 29944, establishing a comment deadline of January 30, 2006. The only comments filed were those of Commission Staff, who recommend approval of the Application. THE APPLICATION The Application states that the Company is incorporated in the State of Wyoming, in good standing and authorized to transact business in the State of Idaho by the Idaho Secretary of State. The Application states that XMT3 is a full-service competitive communications company offering integrated voice and data services utilizing its engineered Internet Protocol for delivery of voice over private networks.XMT3 leases TIs from Qwest, ELI, Time Warner, and IdaComm in order to provide high-speed connectivity to its subscribers. The Company intends to provide integrated vice and data services using voice over Internet protocol technology. The Application states that the Company owns the necessary equipment to deliver carrier-grade telecommunications services to its subscribers. The Company intends to provide service throughout southern Idaho and to compete with Qwest throughout this territory. DECISION MEMORANDUM ST AFF COMMENTS Based on its review of the Company s Application Staff has determined that XMT3 ' s filing complies with the Commission s requirements for issuance of a Certification of Public Convenience and Necessity. Staff believes that the Company understands and agrees to comply with the Commission rules and requirements. Staff recommends approval of the Company Application. COMMISSION DECISION Does the Commission wish to approve the Company s Application and thereby grant XMT3 a Certificate of Public Convenience and Necessity to provide basic local exchange telecommunications services throughout Qwest Corporation s southern Idaho service territory?
