AMENDED APPLICATION
Extreme Media Technologies, Inc., d/b/a! XMT3 ("Applicant" or "XMT3") hereby
submits this Amended Application for a Certificate of Public Convenience and Necessity
Certificate ) to provide basic local exchange service throughout Qwest Corporation s southern
Idaho territory. XMT3 respectfully requests that the Idaho Public Utilities Commission ("the
Commission ) grant the Certificate pursuant to Sections 61-526 through - 528, Idaho Code.
NAME. ADDRESS AND FORM OF BUSINESS
XMT3 is a full-service competitive communications company offering integrated
voice and data services utilizing its engineered Internet Protocol for delivery of voice over
private networks XMT3leases TIs from Qwest, ELI, Time Warner, and IdaComm in order to
provide high speed connectivity to its subscribers. XMT3 also purchases DSL from Qwest for
broadband connectivity to its subscribers. XMT3's backbone in Idaho consists of the following:

II.TELECOMMUNICATIONS SERVICE
Upon the effective date of an approved Certificate of Public Convenience and Necessity,
XMT3 intends to provide integrated voice and data telecommunications services using voice
over internet protocol technology. XMT3 owns a Vocal Data Class 5 soft switch, a Tekelec
Class 4 soft switch, and related Cisco switches and routers, as well as Intel and Sun Micro
Systems servers, all ofthe quality and performance level necessary to deliver carrier-grade
telecommunications services to its subscribers.
III.SERVICE TERRITORY
XMT3 intends to provide service throughout southern Idaho. With respect to local
exchange services, XMT3 intends to compete with Qwest in its southern Idaho service territory.

IV.FINANCIAL INFORMATION
XMT3's financial information is attached hereto as Exhibit 3, and is incorporated herein
by this reference. This information is provided to the Commission as CONFIDENTIAL
INFORMATION pursuant to Rule 67 of the Rules of Procedure of the Idaho Public Utilities
Commission. IDAPA 31.01.01.067.
MAPS
XMT3 proposes to provide service in Qwest's southern Idaho service territory and
thereby references and incorporates herein by this reference Qwest's southern Idaho service
territory map on file with the Commission.

XMT3's proposed initial price list is attached hereto as Exhibit 4.

VIII. INTERCONNECTION AGREEMENT
XMT3 does currently not intend to offer unbundled network elements to its subscribers in
Idaho and, therefore, does not intend to make a request to Qwest for interconnection in the near
future.

IX.E911 SERVICE
XMT3 has the following mechanisms in place to provide 911 services:
A. PSI ALl services through Qwest; all databases are updated on a weekly basis
through INTRADO
B. ELI provides XMT3 with a 911 database to update and it is done on the day of
every customer LNP
C. An agreement with a company called DASH91 1 to provide 911 services in 2006
for all of its subscribers. DASH9II works directly with INTRADO.
COMPLIANCE WITH COMMISSION RULES
XMT3 has reviewed all ofthe Commission rules and agrees to comply with all applicable
rules, unless otherwise ordered.
XI.NO ADVANCE DEPOSITS
XMT3 will not require advance deposits.
XII.RELEASE OF INFORMATION
XMT3 hereby permits the release of its name, address and general business telephone
number in response to a request for the same.

Access Line
The circuit that travels from the Company s Central Office to the Subscriber s premise
terminating at the Network Interface Device (NID), which provides direct access to the
local exchange and the toll switching networks.
Circuit
A channel used for the transmission of electrical energy in the furnishing of
telephone service.
Company
Extreme Media Technologies, Inc. andlor XMT3.
Connecting Company.
A corporation, association, partnership, LLC, or individual owning or
operating one or more exchanges and with who traffic is interchanged.
Contract
The service agreement between a Subscriber and the Company under which services and
facilities are furnished in accordance with the provisions of the Price Lists applicable,

Customer Provided Equipment (CPE)
Devices, apparatus and their associated wiring provided by a Subscriber for use with

Direct Dialing

The territory served by an Exchange.

Extension Station
An additional station connected on the same circuit as the main station and having the
same telephone number as the main station.
Additional Listing
Any listing of a name or information in connection with a Subscriber s telephone number
beyond that to which the Subscriber is entitled in connection with the Subscriber
regular service.
Foreign Exchange Directory Listing
An alphabetical and directory listing in the directory of an exchange other than the
exchange in which a Subscriber is furnished local service.
Individual Line
An exchange line designed for the connection of only one access line.
Installation Charge
A non-recurring charge made for the placing or furnishing of telephone equipment, which
may apply in place of or in addition to Service Connection Charges and other applicable
charges for service or equipment.
Local Channel
That portion of a channel which connects a station to the interexchange channel; it also
applies to a channel connecting two or more stations within an exchange area.
Local Exchange Service
Telephone service furnished between telephone station and the telephone station(s)
of others located within the same local service area.
Local Message
A communication between telephone stations within the same Exchange Area.

Local Service Area
That geographical area throughout which a Subscriber obtains telephone service without
the payment of a toll charge.
Main Station
A suitable telephone instrument or station that is connected to a network access line
through a Central Office and has a unique telephone number.
Premises
All of the building or the adjoining portions of a building occupied and used by the
Subscriber; or all of the buildings occupied and used by the Subscriber as a place of
business or residence, which are located on a continuous plot of ground not intersected by
a public highway or thoroughfare.
Price List
The document filed by the Company with the Public Utilities Commission which lists the
communication services offered by the Company and the associated prices.
Primary Station
Synonymous with Main Station.
Private Branch Exchange (PBX)
An arrangement of equipment used by a Subscriber and connected directly to a central
office by means of trunk access lines, from which connection is made to stations at
various locations or Subscriber premises, thereby providing telecommunications between
these stations and also communication with the general exchange system.

Private Line
A circuit provided to furnish communication only between the two or more telephones
directly connected to it, and not having connection with either central office or P .B.x.
switching apparatus.
Station
(see Telephone Station)
Subscriber
A person or agency subscribing for XMT3 telephone service. As used in this Price List, a
separate Subscriber is involved at each location, or continuous property, where service is
furnished. One individual or firm therefore may be considered as two or more separate
Subscribers, even in the same Exchange. The privileges, restrictions, and rates
established for a Subscriber to any class of service are limited to the service at one
location; no group treatment of service at separate locations furnished to one individual
or firm, is contemplated or to be implied, except when definitely provided for in the
schedules.
Telephone Station
A suitable telephone instrument, consisting of a transmitter, receiver, and associated
apparatus, so connected as to permit transmitting of and receiving telephone messages.
Tie Trunk
A circuit connecting two P .B.X. systems for the purpose of intercommunicating between
the stations connected with such P .B.X. switching apparatus. The circuit is not intended
to provide for general exchange service through either of the P .B.X. systems with which
it connects.
Toll Message
A message from a calling station to a station located in a different local service area.
Toll Service
Telephone service rendered by the Company between patrons in different local service
areas in accordance with the rates specified in the Company s Toll Price List.

A. APPLICATION
The rules and regulations specified herein apply to the intrastate services and facilities of
the Company. Failure on the part of the Subscribers to observe these terms and conditions
of the Company, after due notice of such failure, automatically gives the Company the
authority to discontinue the furnishing of service.
B. EXPLANANTION OF SYMBOLS

6. Defacement of Premises
The Company will repair or replace any defacement or damage of property due to
installation, existence, or removal of Company property, when the damage is the result of
negligence of the Company.
7. Adjustment of Charges
In case of over-billing, a refund will be made by the Company for the full
amount of excess charges when the amount can be determined; when the amount cannot
be determined from available records, the maximum refund will not exceed the
estimated over-billing over a three-year period.
In case of under-billing, the Company reserves the right to back-bill for the
deficiency charges up to a period of three years.
D. USE OF SERVICE AND FACILITIES
1. Ownership and Use of Equipment
All equipment and lines furnished by the Company are the property of the
Company unless otherwise specified. Company agents or employees shall have the right
to enter Subscriber premises at any mutually agreed upon reasonable hour to install
maintain or remove, as appropriate, Company equipment.
The Company may refuse to install or maintain any service at locations that are
hazardous to Company employees. If such service is furnished, the Subscriber may be
required to install and maintain such service, holding the Company harmless from any
claims for damage by reason of the installation and maintenance of this service.
2. Interconnection Policy
CPE may be used and Subscriber provided communication systems may be
connected with the facilities furnished by the Company for telecommunications services
subject to terms and conditions outlined in other parts of this Price List. In case any
unauthorized attachment is made, the Company shall have the right to disconnect
suspend, or terminate the service.

3. Use of Subscriber Service
Subscriber telephone service is furnished only for the use by the Subscriber, his
family and/or Subscriber s associates. The Company may refuse to install or permit such
service to remain on premises of public or semi-public character.
The equipment may be installed, at such locations provided the service is located
so it is not accessible for public use.
4. Tampering with Equipment
The Company may refuse to furnish telephone service when Company equipment
shows any evidence of tampering for the purpose of obtaining service without payment of
charges applicable to the service rendered by the Company.
5. Use of Improper Language or Impersonation of Another
The Company may refuse service to anyone who uses or permits abusive or
obscene language over Company facilities or impersonates another individual with
traudulent or malicious intent.

7. Indiscriminate Use of Facilities
The Company may refuse to furnish service or require upgrading of services
provided to any Subscriber who allows indiscriminate use of Company facilities except in
case of emergency.

E. ESTABLISHMENT AND FURNISHING OF SERVICE
I. Application for Service
Application for service must be made on the Company s standard form, which
becomes a contract when accepted in writing by the Company or upon establishment of
service. The person or entity submitting an application for service is hereafter referred to
as "Applicant". The conditions of such contracts are subject to all provisions of this and
other applicable Price Lists. Requests for additional service may be made orally, if
provided in the original contract, and no advance payment will be required. A move
within the exchange area is not considered to terminate the contract and orders for such
may be made orally.
2. Telephone Numbers
The Company may change the telephone number or Central Office designation of
a Subscriber whenever it is required WITH consent FROM THE SUBSCRIBER and 30
days advance written notice,
3. Alterations
The Subscriber agrees to notify the Company of any alterations that will
necessitate changes in the Company s wiring; and the Subscriber agrees to pay the
Company s current charges for such changes. The Subscriber can change the inside
wiring up to the demarcation point.
4. Payment of Service
The Subscriber is required to pay all charges for services rendered by the
Company, both exchange and toll, in accordance with provisions contained elsewhere in
this Price List. The Subscriber is responsible for all charges for services rendered at
his/her telephone, including collect charges.

5. Maintenance and Repairs
The Company shall bear the expense of all repair and maintenance of its facilities
except where damage or destruction of its facilities is due to the gross neglect of the
Subscriber. The Subscriber may not rearrange, remove or disconnect any Company
facilities without consent of the Company.
6, Line Extensions
The Company will extend the Subscriber s line from the point of demarcation to
one qualified inside phone jack.
Additional jack wiring will be done at the rate of $65.00 per hour, plus materials.

G. ESTABLISHMENT OF DEPOSITS

H. MINIMUM CONTRACT PERIODS AND TERMINATION OF
SERVICE
1. Minimum Contract Periods
Except as hereinafter provided, the minimum contract period for all services and
facilities is one month at the same location.
The Company may require a minimum contract period longer than one month at
the same location in connection with special (non-standard) types or arrangements of
equipment, or for unusual construction necessary to meet special demands, and involving
extra cost.
2. Termination Of Service
The Company shall comply with all applicable Commission rules relating to the
denial, restriction and notification processes before denying, restricting or terminating a
Subscriber s service. Specifically, the Company shall abide by Telephone Customer
Relations Rules 301 through 314. IDAPA 31.41.01.301- 314.

I. PAYMENT FOR SERVICE AND FACILITIES
The Subscriber shall pay for service and facilities monthly in advance, except all
various units of government, and shall pay for Moves and Changes when billed, Failure
to receive a bill does not relieve the Subscriber of the responsibility for payment in
accordance with the provisions set forth herein.
All bills for service are due and payable at the office of the Company on or
before the twentieth day following the post marked date of the statement of the month in
which the bill is rendered.
J. SPECIAL SERVICES AND FACILITIES
Special services and facilities not ordinarily used in the furnishing of telephone
service and not otherwise provided for by the Price List schedules of the Company may
be furnished or leased pursuant to special contract for such special service or facility for
such period as may be agreed upon, provided such special service or facility or the use
made thereof is not unlawful and does not interfere with the telephone service furnished
by the Company. Special services are provided for each individual application as a
custom-engineered system to satisfy and provide for the needs of that Subscriber.
Applicable charges will be determined by the Company for each individual system, In
the event any such special service or facility or the use made thereof interferes with the
furnishing of the telephone service by the Company, the Company may terminate such
contract and cease to furnish such special service or facility after thirty (30) days written
notice to the Subscriber.
K. SUBSCRIBER NOTICE
The Company will give at least ten (10) days notice to Subscribers and the Idaho
PUC before increasing rates or making other changes to its Price List.

Service Order

execute a Subscriber s request for the establishment of service. It is also applicable for
Subscriber s request for additions, moves or changes to existing service.
Premises Visit
Applicable if a Company employee must visit the Subscriber s premises to move or
change a service drop or standard network interface at the Subscriber s request. Not
applicable when a Company employee is on the Subscriber s premises for any other
business purpose.

Per each Directory Assistance Call- $0.
CONDITIONS
1. The above charge will apply to each call to a directory assistance operator
requesting information for locations within the Company s service area.
2. The charge will apply regardless of whether or not the operator is able to
supply the requested information.
3. A maximum of one request for information will be allowed per directory
assistance call.
4. Charges for Directory Assistance calls placed from Subscribers who have a
reading, physical or visual handicap and thus are unable to use the Telephone Directory
shall receive five (5) Directory Assistance Calls per month free of charge.
5. In the event a Subscriber obtains directory assistance service through
fraudulent means, in addition to any other action authorized by this Price List, the
Company may assess appropriate Directory Assistance charges on the Subscriber
regular telephone account.

CONDITIONSI. When a service is programmed for both Three-way Calling and Call
Waiting, only one of the two may be activated at anyone time.

Calling Features.
4. Caller ID Features (Calling Name and Number Deliver, Call Blocking
and Anonymous Caller Rejection) require an additional piece of Customer Provided
Equipment (CPE) to fully activate features.5. Selective Call Forwarding, Selective Call Rejection, Selective Call
Acceptance, and Call Waiting provide Subscribers with four different options for
treating incoming calls. Each feature is capable of holding a list of up to 12 directory
options for treating incoming calls. Each feature is capable of holding a list of up to
12 directory numbers (DNS) that should receive screening treatment. Once a
Subscriber has programmed the list and turned on the feature, the switch will screen
each incoming call and direct the call to the treatment specified by the feature.
7. From time to time, the Company may offer special promotions to its
Subscribers. These offerings will generally consist of a reduced price, a waiver of
installation charges, or a free service with a purchase of another service. These
offerings may be limited to certain dates and locations, and will be for limited time
periods. When such an offering is made, the Commission will be notified and a copy of
the offering will be provided to them.

DEFINITIONS
Anonymous Call Reiection
This service allows the Central Office Subscriber to block calls from callers who block
transmission of their Caller ID information.
Caller ID
Caller ID will display the name and number of Subscriber s outgoing and incoming calls.
Caller ID Block
Caller ID Block allows the Subscriber to block their outgoing display by programming
their phone prior to each call or they can set it permanently to block every call.
Call Forward Busv/No Answer
This service allows the Central Office Subscriber to forward all incoming calls if the line
is busy and/or if there is no answer. If the line is busy, the Central Office Subscriber may
choose to have those calls forwarded to another device such as a cell phone or Voice
Mail. The same may apply if there is no answer.
Call Forwarding Variable (standard)
This service allows Central Office Subscribers to forward their phone calls to any phone
number whether local or long distance,
Call HoldlRetrieve
This service allows the Central Office Subscriber to place the calling party on hold and
retrieve the call at a later time.
Call Transfer
This service allows the Central Office Subscriber to call either an on-net or an off-net
Subscriber.
Call Waiting
This service notifies the Central Office Subscriber of an incoming call while they are on
the line with another call.

Do Not Disturb
This feature prevents the Central Office Subscriber s telephone from ringing by directing
all incoming calls directly to Voice Mail.
Find MelFollow Me
This service allows Central Office Subscribers to have their phone ring up to nine other
devices sequentially or simultaneously.
Last Number Redial
This feature allows the Central Office Subscriber to identify the last incoming call by
number and automatically redial that number.
Message Waiting Indication
This feature is offered in two forms. Ifthe Subscriber s telephone has a message waiting
indication lamp, the light will come on in the event of a message in their Voice Mail. If
no lamp exists, the alert will come n the way of a stutter dial tone.
Multi-Call Park
This service allows incoming calls to be parked with an identification number and picked
up from any phone using the identification number.
Priority Call
Priority Call allows Subscribers to program in numbers of other parties they deem to have
priority when calling their phone.
Remote Call Forwarding (standard)
This service allows Central Office Subscribers to dial in remotely to their phone and
forward their phone calls to any phone number whether local or long distance.
Selective Call Acceptance
This service allows the Central Office Subscriber to selectively accept calls based on
calling party information.

Selective Call Forwarding (standard)
This service allows Central Office Subscribers to set call forwarding by time of day or
date to any phone number whether local or long distance.
Selective Call Reiection
This service allows the Central Office Subscriber to select calls they wish to prevent ftom
ringing their telephone instrument.
Speed Calling
Permits placing local and long distance calls to pre-selected telephone numbers by dialing
an abbreviated code. To add a number to the calling list the Subscriber uses hislher own
telephone instrument.
T API Dialing Support
This service allows the Central Office Subscriber to integrate T API compliant e-mail
clients and dial out of their contact manager by mouse-clicking on the contact which
prompts the Subscriber s telephone instrument to dial the selected contact.
Three-Way Calling
Permits a Subscriber to add a third party to an existing local or long distance call. It will
also permit a Subscriber to consult privately with a third party while holding the original
call.
Voice Mail
This service allows records incoming caller messages and stores them for later retrieval at
the Subscriber s convenience.

OBLIGATION OF COMPANY
1. Limitation of Obligation with Respect to Privacy Concerns
The Company shall be held harmless by the Subscriber in cases where the Subscriber
telephone number is transmitted via the Caller ID CCF to another Subscriber who subscribes to
such service, and the Subscriber has not blocked the transmission of his /her telephone number.
2. Obligation ofthe Subscriber
Under no circumstances should any Subscriber to the Caller ID CCF use telephone
numbers delivered to the Subscriber for purposes of marketing any service, or for the sale of the
numbers to any interested party. Permitted uses of the number information received through the
Caller ID CCF service include:
billing and collection, routing, screening, and completion ofthe originating Subscriber
core transaction, or for services directly related to the originating Subscriber s call or
transaction.

the directory containing the regular alphabetical list of names of Subscribers.
Primary Listing
One listing without charge, termed the Primary Listing, is provided as follows:1. For each separate Subscriber service, when two or more mainstation lines or PBX trunk lines are consecutively operated, the first number of the
group is considered the primary listing.
2. Non-listed telephone numbers are listed with regional andlor national
telephone directory services. They will be given out by such services upon caller
request.
3. Non published numbers are not listed with regionallnational telephone directory
services and are not to be given out to anyone unless authorized by a court oflaw.
