RE: CASE NO. EXC-T-97-1; REQUEST OF EXCEL TELECOMMUNICATIONS TO WITHDRAW ITS APPLICATION

On September 24, 1997, Excel Telecommunications, Inc. (Excel) submitted a letter to the Commission Secretary requesting, pursuant to the Commissions Rules of Procedure, that its Application for a Certificate of Public Convenience and Necessity to operate as a local exchange carrier in the state of Idaho be withdrawn without prejudice. Excel states that it seeks to withdraw its Application at this time and to refile at a later date when its business plans permit it to concentrate its efforts on obtaining certification in Idaho.
Staff recommends that the Commission issue the attached Order dismissing this case without prejudice to the right of Excel to refile its Application in the future.
