EXCEL TELECOMMUNICATIONS, INC.=S APPLICATION FOR CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY.
On June 18, 1996, the Commission received an Application from Excel Telecommunications, Inc. (Excel) for a Certificate of Public Convenience and Necessity to provide local exchange service as a competitive local carrier. On March 3, 1997, after diligent attempts to obtain complete information as required by the Commissions generic Procedural Order No. 26665, which sets out the necessary information to be included with an application for a certificate for local service provider authority. Staff returned the Application to Excel. On April 28, 1997, Excel resubmitted a revised Application. Again, Staff began working with the Company to delete the extraneous information and to add the required information to comply with Order No. 26665. On July 7, 1997, Staff received the final revisions from Excel.
Currently, Excel is authorized to provide telecommunication services pursuant to Title 62 of the Idaho Code. The Application indicates that Excel is seeking to obtain a Certificate to provide Title 61 regulated telecommunications services, including basic local exchange service. The Application states that Excel plans to provide residential and business services to all classes of customers in Idaho throughout the service areas of U S WEST Communications, Inc. and GTE Northwest Incorporated.
Staff believes that Excel has provided information that appears to satisfy the procedural requirements of Rule 111 of the Commissions Rules of Procedure, IDAPA 31.01.01.111 and the Commissions Procedural Order No. 26665.
Staff recommends that the Commission solicit comments pursuant to Modified Procedure.
