APPLICATION OF EXCEL TELECOMMUNICATIONS, INC. (EXCEL) FOR CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY.
On June 18, 1996, Excel filed an Application for a Certificate of Public Convenience and Necessity to provide local exchange resell services. Following the receipt of Excels Application, the case was put on hold pending the outcome of the Commissions efforts to redraft rules pertaining to the requirements for obtaining authority to operate as a local exchange carrier in Idaho. Ultimately, Excels Application was returned to the Company due to the fact that it did not contain adequate information and a combined Title 61 and Title 62 services.
On April 28, 1997, Excel resubmitted its Application. Again, however, the Application did not contain the correct information. Moreover, Excel indicated that it was undergoing some internal changes and that it would be submitting a new tariff which this Commission has not yet received. Finally, Excel states that it is merging with Telco Communications.
In light of the foregoing, Staff recommends that Excels Application be dismissed without prejudice to the right of the newly merged company to resubmit an Application to operate as an LEC in Idaho. Staff contacted Excels agent, Maria Cattafesta who stated that Excel had no objection to Staffs proposal to dismiss the Application.
