CERTIFICATE OF PUBLIC CONVENIENCE AND) NECESSITY NO. 408. CASE NO. EXC-02- ORDER NO. 30148 On September 6, 2006, the Commission received a notice from Comtel Telcom Assets LP (Comtel) requesting cancellation of Certificate of Public Convenience and Necessity No. 408 (CPCN). Certificate No. 408 had been issued to Excel Telecommunications, Inc., which was acquired by Comtel. In its Decision Meeting on September25, 2006, the Commission determined to approve Comtel's request for cancellation of Certificate No. 408. COMMISSION FINDINGS In January 2002, Excel Telecommunications, Inc. filed an Application with the Commission requesting authority to provide telecommunications services within the entire State of Idaho. In March 2003, the Commission granted Excel's Application for a CPCN and issued Certificate No. 408. Order No. 29202. On June 7 2006, Comtel Telcom Assets LP completed the purchase of substantially all of the assets, including customers, of VarTec Telecom, Inc., Excel Telecommunications, Inc. and VarTec Solutions, Inc. Excel and VarTec both held CPCNs. On May 11 2006, the Commission approved Comtel's assumption ofVarTec s Certificate No. 399. Order No. 30039. On September 6, 2006, Comtel notified the Commission of its desire to cancel Excel' Certificate No. 408. Staff recommended the Commission cancel Certificate No. 408 and remove the Company s price list on file. ORDER IT IS HEREBY ORDERED that Comtel Telcom Assets LP' s request for cancellation of Excel Telecommunications, Inc.'s Certificate of Public Convenience and Necessity No. 408 is granted. Certificate No. 408 is no longer in effect, and Excel Telecommunications, Inc. is no longer authorized to provide service in the State of Idaho. THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory Orders previously issued in this Case No. EXC-02-1 may petition for reconsideration within ORDER NO. 30148 twenty-one (21) days of the service date ofthis Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this case. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~~ 61-619 and 61-626.
