Deposi t Requirement
At the Company's discretion , the Company may require
depos it, in accordance wi th IDAPA 31 . D . 1 . 1 (b),
which is not to exceed the estimated charges for two(2) months of tariffed services, from a specifiedOperator Service Provider CUstomer or TelephoneCustomer. Interest on deposits will be paid in
accordance with IDAPA 31.6 (a).
Te~ination of Service
The Company reserves the right to terminate services in
accordance with rules found in IDAPA 31.
Service Offering
Calculation of Distance.Calls are measured, based on airline distance betweenthe rate center of the customer I terminal or switch
location to the rate center of the destination of thecall.
The distance between the rate centers of the
customer's switch and destination point is calculated by
using the vertical ("V") and horizontal ("H") coordinatesfound in AT&T Tariff FCC No. 10, in the following
manner.

Step 1- Obtain the "V" and "H" coordinates for theSubscriber's switch and the destination point.

Step 3-Square the difference obtained in Step
Step 4- Add the squares of the "V" difference and "H"
difference obtained in Step
Step 5- Divide the sum of the squares obtained in Step
4 by ten (10). Round to the next higher whole number ifany fraction results from the division.
Step 6- Obtain the square root of the whole number
obtained in Step 5. Round to the next higher whole
number if any fraction is obtained. This is the
distance between the rate centers.
Minimum Call Completion
Operator Service Provider CUstomers, Telephone Callers
and Telephone Customers can expect a call completion rateof 99%.
Description of ServicesThe Company endeavors to provide high quality
service. All network access is monitored and engineered
to provide a p.01 grade of service (99% call completionratio). Service is available 24 hours per day, 7 days
a week, subject to routine maintenance and outages beyondthe control of the Company. The Company's equipment isdesigned and engineered to provide high quality
transmission of voice and data with a minimum level of
impairment such as noise and echo. However, overall
quality may vary somewhat due to the variability in
quality of the connections provided by the local
telephone companies and other interexchange carriers
which is beyond the Company s control.

The service provided is an automated collect only sevice,offered only within correctional facilities for the
exclusive use of inmates.
Equal Access Corporation I s services are offered
twenty four (24) hours per day, seven (7) days a week.
2 Equal Access Corporation's service agreements are
in effect for the duration of Agreements between EqualAccess Corporation and Operator Service Provider
Customers.
Liability of Equal Access Corporation ("Company")
1 The Company shall not be liable for claim or loss,
expense or damage (including indirect, special orconsequential damage), for any interruption, delay,error, omission, or defect in any service, facility or
transmission provided under this tariff, if caused by any
person or entity other than the Company, by any
malfunction or any service or facility provided by any
carrier, by an act of God, fire, war, civil disturbance,
or act of government, or by any other cause beyond the
Company s direct control.
The Company shall not be liable for, and shall be
fully indemnified and held harmless by Operator ServiceProvider CUstomer, Telephone Caller and/or Telephone
Customer against any claim or loss, expense, or damage
(including indirect, special or consequential
damage) for defamation, libel, slander, invasion,
infringement of copyright or patent, unauthorized use ofany trademark, trade name or service mark, unfair
competition, interference with or misappropriation orviolation of any proprietary or creative right, orany other injury to any person, property or entity

arising out of the material, data, information, orother content revealed to, transmitted, or used by
the Company under this tariff; or for any act or omission
of the Operator Service Provider Customer,
Telephone Caller and/or Telephone Customer or for any
personal injury or death of any person caused directly orindirectly by the installation, maintenance, location,
condition, operation , failure, presence, use, or removal
of equipment or wiring provided by the Company, if not
directly caused by negligence of the Company.
The Company shall not be liable for any defacement
of or damages to the premises of a Operator ServiceProvider Customer resulting from the furnishing of
service which is not the direct result of the Company'negligence.
No agent or employee of any other carrier or
Company shall be deemed to be an agent or employee of the
Company.
5 The above tariff language does not constitute a
determination by the Commission that a limitation of
liability imposed by the Company should be upheld in
a court of law. Acceptance for filing by the Commission
recognizes that it is a court'responsibility to
adjudicate negligence and consequential damage claims.
It is also the court's responsibility to determine the
validity of the exculpatory clause.

before making any changes in rates or charges. The

Corporation's Idaho service areas.
