Sheet revision numbers also appear in the upper left corner of each page. These numbers are used to determine the most current sheet version on file with the IPUC. For example, the 4th revised sheet 6 cancels the 3rd revised sheet 6. Consult the check sheet for the sheet currently in effect. D . 1 . 1 (b), which is not to exceed the estimated charges for two(2) months of tariffed services, from a specifiedOperator Service Provider CUstomer or TelephoneCustomer. Interest on deposits will be paid in accordance with IDAPA 31.6 (a). Te~ination of Service The Company reserves the right to terminate services in accordance with rules found in IDAPA 31. Service Offering Calculation of Distance.Calls are measured, based on airline distance betweenthe rate center of the customer I terminal or switch location to the rate center of the destination of thecall. The distance between the rate centers of the customer's switch and destination point is calculated by using the vertical ("V") and horizontal ("H") coordinatesfound in AT&T Tariff FCC No. 10, in the following manner. 6 . 1 . 2 . 1 Formula Step 1- Obtain the "V" and "H" coordinates for theSubscriber's switch and the destination point. Step 3-Square the difference obtained in Step Step 4- Add the squares of the "V" difference and "H" difference obtained in Step Step 5- Divide the sum of the squares obtained in Step 4 by ten (10). Round to the next higher whole number ifany fraction results from the division. Step 6- Obtain the square root of the whole number obtained in Step 5. Round to the next higher whole number if any fraction is obtained. This is the distance between the rate centers. Minimum Call Completion Operator Service Provider CUstomers, Telephone Callers and Telephone Customers can expect a call completion rateof 99%. Description of ServicesThe Company endeavors to provide high quality service. All network access is monitored and engineered to provide a p.01 grade of service (99% call completionratio). Service is available 24 hours per day, 7 days a week, subject to routine maintenance and outages beyondthe control of the Company. The Company's equipment isdesigned and engineered to provide high quality transmission of voice and data with a minimum level of impairment such as noise and echo. However, overall quality may vary somewhat due to the variability in quality of the connections provided by the local telephone companies and other interexchange carriers which is beyond the Company s control. Equal Access Corporation I s services are offered twenty four (24) hours per day, seven (7) days a week. 2 Equal Access Corporation's service agreements are in effect for the duration of Agreements between EqualAccess Corporation and Operator Service Provider Customers. Liability of Equal Access Corporation ("Company") 1 The Company shall not be liable for claim or loss, expense or damage (including indirect, special orconsequential damage), for any interruption, delay,error, omission, or defect in any service, facility or transmission provided under this tariff, if caused by any person or entity other than the Company, by any malfunction or any service or facility provided by any carrier, by an act of God, fire, war, civil disturbance, or act of government, or by any other cause beyond the Company s direct control. The Company shall not be liable for, and shall be fully indemnified and held harmless by Operator ServiceProvider CUstomer, Telephone Caller and/or Telephone Customer against any claim or loss, expense, or damage (including indirect, special or consequential damage) for defamation, libel, slander, invasion, infringement of copyright or patent, unauthorized use ofany trademark, trade name or service mark, unfair competition, interference with or misappropriation orviolation of any proprietary or creative right, orany other injury to any person, property or entity Issued February 21,1992 Effective March 2,1992 Issued by Steven J.Rosenthal Title Corporate At torney PAGE ildaho 'Public UtilitiesOo~ Office of the Secretary ACCEPTED FOR FiUNG MAR 2 - 1992ORIGINAL Boise, Idaho NAME OF UTILITY EQUAL ACCESS CORPORATION (Acceptance Stamp) arising out of the material, data, information, orother content revealed to, transmitted, or used by the Company under this tariff; or for any act or omission of the Operator Service Provider Customer, Telephone Caller and/or Telephone Customer or for any personal injury or death of any person caused directly orindirectly by the installation, maintenance, location, condition, operation , failure, presence, use, or removal of equipment or wiring provided by the Company, if not directly caused by negligence of the Company. The Company shall not be liable for any defacement of or damages to the premises of a Operator ServiceProvider Customer resulting from the furnishing of service which is not the direct result of the Company'negligence. No agent or employee of any other carrier or Company shall be deemed to be an agent or employee of the Company. 5 The above tariff language does not constitute a determination by the Commission that a limitation of liability imposed by the Company should be upheld in a court of law. Acceptance for filing by the Commission recognizes that it is a court'responsibility to adjudicate negligence and consequential damage claims. It is also the court's responsibility to determine the validity of the exculpatory clause.
