ENL.T.19.O1 ORDER NO. 34443 On July 29, 2019, Envision Networks LLC ("Envision" or "Company") filed an Application for a Certificate of Public Convenience and Necessity ("CPCN") to provide local telecommunications service in Idaho.l The Commission issued a Notice of Application and Notice of Modified Procedure setting a September 4,2019 comment deadline and a September ll,2019 reply deadline. Order No. 34415. The Commission's Staff filed the only comments, and recommended the Commission approve the Company's Application and issue a CPCN subject to certain conditions. Envision did not file reply comments. Having reviewed the record, the Commission issues this Order approving the Company's Application as follows. THE APPLICATION Envision is an Idaho limited liability company that is authorized to do business in Idaho. Its principal place of business will be in Pocatello, and it would provide facilities-based competitive local exchange telecommunications service throughout southeast Idaho. To support its deployment of local exchange services, the Company plans to obtain an interconnection agreement with Centurylink. Its initial service territories will be Pocatello, Idaho Falls, Rexburg, and the surrounding areas where Centurylink is the incumbent. The Company plans to deploy a telephone and fiber network to support local exchange services and high-speed Internet service. STAFF COMMENTS Staff reviewed the Company's Application for compliance with the requirements to obtain a CPCN, and confirmed the Company has satisfied those requirements. Staff believes the Company understands and will comply with the Commission's rules and requirements. Staff also I Envision originally filed its Application on March 11,2019. After consulting with Commission Staff, Envision filed an amended Application on July 29,2019. ) ) ) ) ) ORDER NO. 34443 I believes the Company has the financial, managerial, and technical qualifications to provide telecommunications services. Staff thus recommended the Commission issue the Company a CPCN on condition that the Company must comply with (1) the number pooling and reporting requirements of the North American Number Plan Administrator (NANPA); (2) the reporting and contribution requirements for Idaho's Universal Service Fund, Telecommunications Relay Services program, and Idaho Telecommunications Service Assistance program; (3) future reporting requirements as imposed by the Commission; and 4) the requirement that the Company provide three reports during 2020 indicating the number of basic local exchange customers it has and the services being offered. DISCUSSION AND FINDINGS Based on our review of the record, we find that the Company's Application complies with the requirements to obtain a CPCN. Rule of Procedure ll4 sets the requirements that competitive local exchange snn'is15-such as the Company-must satisfy to obtain a CPCN. IDAPA 31.01.01.114. We find that the Company has satisfied Rule 114. The Company has provided all needed information in its Application, including financial information. The Company also has the financial, managerial, and technical qualifications needed to operate as a telecommunications service provider, and it has reviewed and agreed to comply with this Commission's rules. We thus find it reasonable to approve the Company's Application for a CPCN, subject to these conditions: 1. The Company must comply with North American Number Plan Administrator requirements. 2. The Company must comply with all reporting and contribution requirements prescribed by the Idaho Universal Service Fund, Idaho Telecommunications Relay System, and Idaho Telecommunications Service Assistance Program. 3. The Company must comply with all future reporting requirements deemed appropriate by the Commission for competitive telecommunications providers. 4. The Company must provide three reports to the Commission indicating the number of basic local exchange customers it has and the services being offered. These reports will be due on: January 15,2O2O; May 15, 2O2O; and September 15, 2O20.If the Company fails to provide the three reports, the Company shall relinquish its CPCN and all telephone numbers. 2oRDER NO. 34443 ORDER IT IS HEREBY ORDERED that the Company's Application for a CPCN is granted subject to the conditions outlined above. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See ldaho Code $$ 6I-626 and62-619.
