FOR A WAIVER OF THE NANP A'S DENIAL OF APPLICATION FOR NXX NUMBERING BLOCKS FOR ADA COUNTY.ORDER NO. 29411 CASE NO. ELI-O4- On December 17, 2003 , Electric Lightwave, Inc. (ELI) filed a Petition with the Commission for authorization to use new telephone numbers to provide service to Ada County government offices. ELI originally filed its Application with the North American Numbering Plan Administrator (NANP A), as required by the Federal Communications Commission. Numbering requests filed with NANP A may be appealed to the state commission if they are denied by NANP A. ELI's Application requests authorization to use two consecutive 1000 block numbers to enable Ada County to expand its services. Specifically, the numbers would be used to serve Ada County s Public Safety Complex, Juvenile Detention Center and Field Services Building. As is required, ELI in its application to NANP A completed a "month to exhaust" worksheet indicating that ELI's number resources in the Boise Rate Center would exhaust in approximately 13 months. NANPA denied ELI's application on the grounds that ELI had not met the six- month exhaust criteria as set forth in NANPA's guidelines for each rate center.In its Application to the Commission, ELI asserts that NANPA's denial interferes with its ability to serve its customers within the State of Idaho. ELI's Application was presented to the Commission for consideration during its December 29, 2003, decision meeting. The Commission determined to approve ELI' Application in order to enable ELI to provide adequate telecommunication to the Ada County government offices. In assigning new numbers, ELI should continue to follow the FCC numbering guidelines by assigning numbers in 1000 blocks only as demand requires before opening new 1000 blocks within an assigned prefix. Unused 1000 numbering blocks will be returned to the NANP A within six months. ORDER NO. 29411 ORDER IT IS HEREBY ORDERED that NANP A provide to Electric Lightwave, Inc. two consecutive 1000 numbering blocks for use by ELI to serve Ada County government offices. assigning the numbers, ELI shall, consistent with FCC numbering guidelines, exhaust the numbers in the first 1000 numbering block before providing numbers in the second 1000 numbering block. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. ELI-04- may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. ELI- T -04-1. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ 61- 626.
