DZI-O6- DIGITAL COMMUNICATIONS AKA DIGI- COMM FOR A CERTIFICATE OF PUBLIC NOTICE OF APPLICATION CONVENIENCE AND NECESSITY TO PROVIDE LOCAL EXCHANGE SERVICES NOTICE OF MODIFIED WITHIN THE STATE OF IDAHO PROCEDURE ORDER NO. 29982 NOTICE OF APPLICATION YOU ARE HEERBY NOTIFIED that on February 1 2006, Larry Cromwell filed an Application for a Certificate of Public Convenience and Necessity with the Commission for his business, Digital Communications a.k.a. Digi-Comm ("Digi-Comm ). In the Application, Digi- Comm proposes to provide dial-up and high-speed Internet access, dial tone, long distance multiple customer convenience services and digital streaming television on a retail basis business and residential consumers. The Company anticipates also providing monitored security and mobile Internet services to its customers. YOU ARE FURTHER NOTIFIED that Digi-Comm is a sole proprietorship with a principal place of business in Emmett, Idaho. The Company has provided certain financial information and the appropriate contact information for its registered agent for service of process within Idaho. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has reviewed the Application in this case and has preliminarily determined that the public interest in this matter may not require a hearing to consider the issues presented, and that the issues raised by the Application may be processed under Modified Procedure, i., by written submission rather than by hearing. IDAP A 31.01.01.210-204. YOU ARE FURTHER NOTIFIED that the Commission may not hold a hearing in this proceeding unless it receives written protests or comments opposing the use of Modified Procedure and stating why Modified Procedure should not be used. IDAP A 31.01.01.203. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29982 YOU ARE FURTHER NOTIFIED that the deadline for filing written comments or protests with respect to Digi-Comm s Application and the use of Modified Procedure in this case is twenty-one (21) days from the service date of this Order. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. If written comments or protests are received within the deadline, the Commission will consider them and in its discretion may set the matter for hearing or may decide the matter and issue its Order based on the written comments before it. YOU ARE FURTHER NOTIFIED that the Application and supporting workpapers and exhibits have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices or on the Commission s website www.puc.idaho.gov YOU ARE FURTHER NOTIFIED that persons desiring to intervene in this case for the purpose of presenting evidence or cross-examining witnesses must file a Petition to Intervene with the Commission pursuant to Rule 72 and 73 of the Commission s Rules of Procedure NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29982 IDAP A 31.01.01.000 et seq. Persons desiring to present their views without parties' rights of participation and cross-examination are not required to intervene and may present their comments without prior notification to the Commission or to other parties. YOU ARE FURTHER NOTIFIED that the Commission has jurisdiction over this matter pursuant to Title 61 of the Idaho Code. ORDER IT IS HEREBY ORDERED that the Application of Digital Communications a.k.a. Digi-Comm be processed by Modified Procedure, IDAP A 31.01.01.201-204. Persons interested in submitting written comments in this matter must do so no later than twenty-one (21) days from the service date of this Order.
