ORDER NO. 27309
On May 31, 1996, the Commission received an Application from Dial & Save of Idaho, Inc., d.b.a. Dial & Save, for a Certificate of Public Convenience and Necessity to provide local exchange service as a competitive local carrier. On November 7, 1996, subsequent to the receipt of the Application, the Commission issued a procedural order setting forth what an application for a Certificate of Public Convenience and Necessity submitted by a new local service provider in Idaho must contain in order to be considered by the Commission. See Procedural Order No. 26665. Staff returned the Application to Dial & Save on April 14, 1997, requesting it to resubmit the Application in conformance with Commission guidelines as outlined in Order No. 26665. Dial & Save has not resubmitted the Application as of the date of this Order.
F I N D I N G S
Staff reviewed this Application and found Dial & Saves Application is insufficient in that it does not meet the requirements set forth in Order No. 26665. Therefore, Staff recommended that the Application be returned, dismissed without prejudice, and the docket closed pursuant to IDAPA 31.01.01.065.
The Commission finds that the Application does not meet the requirements set forth in Order No. 26665 and that Dial & Save is not prejudiced by closing the docket at this time because the Application can be refiled in the future. Therefore, this proceeding is hereby closed without prejudice to Dial & Saves right to refile its Application at a future time.
O R D E R
IT IS HEREBY ORDERED that this proceeding is closed without prejudice as discussed above.
THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. DIL-T-97-1 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. DILT97-1. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code 61626.
