Custer Telephone Cooperative, Inc. ("Custer ) and Midvale Telephone Exchange, Inc.
Midvale ), hereby petition the Commission for an Order approving this Joint Petition for
Amendment of Certificated Service Area Boundaries. In support whereof, Custer and Midvale
Gointly "Petitioners ) state as follows:
Custer is a mutual, non-profit telephone corporation organized under the laws of
the State of Idaho and exempt from regulation by the Public Utilities Commission
Commission ). Custer s principle place of business is in Challis, Idaho and it maintains central
offices in Challis, May, Elk Bend and Clayton. Custer provides basic local exchange
telecommunications services, MTS , W A TS , access services to inter-exchange carriers, special
access services, broadband and other telecommunications services that its customers may from
time to time request or require.
JOINT PETITION FOR AMENDMENT OF CERTIFICATED SERVICE AREA BOUNDARIES - 1
On May 16, 1989 , the Commission issued Order No. 22519 granting Custer
application for a certificate for an exclusive service area for telecommunications service pursuant
to Idaho Code 62-615 (since amended), and simultaneously issued Custer Certificate No. 308, a
copy of which is attached as Fxhihit A to this Joint Petition.
Midvale is a Title 61 regulated telephone corporation organized under the laws of
the State ofIdaho, with its principal place of business in Midvale, Idaho. Midvale provides basic
local exchange and other telecommunications services within the State of Idaho pursuant to a
certificate of public convenience and necessity issued by this Commission. Midvale
certificated service area includes Yellow Pine, Warren, Warm Lake, Midvale, Lakeview, and
Stanley, Idaho. Midvale s current certificated service area is described in the Commission
Third Amended Certificate No. 254, a copy of which is attached as Fxhihit R to this Joint
Petition.
Custer s and Midvale s certificated service areas are contiguous to one another
near Sunbeam, Idaho which is downstream from the town of Stanley along the Salmon River.
Custer and Midvale are members of Syringa Networks, LLC ("Syringa ), which is a non-regulated
telecommunications company. Custer and Midvale each participated in construction of portions of
Syringa s SONET fiber optic ring to provide broadband connectivity to rural Southern Idaho. As
part of the coordination of their respective construction responsibilities to complete the SONET
ring, Custer and Midvale agreed to a meet point that was within Midvale s certificated service area
west of Sunbeam.
The SONET ring facilities were completed by Custer and Midvale in November
2003. At that time, there were no Midvale customers in the area between Custer s certificated
boundary and the meet point. It was Custer s and Midvale s intent then that they jointly seek an
amendment of their respective boundaries to adjust Custer s certificated area to encompass its

facilities up to the agreed-upon meet point, because Custer would be better able to serve new
customers in that area due to the proximity of its facilities. The purpose of this Joint Petition
then, is to complete the contemplated amendments ofthe Petitioners' respective service areas.
A map showing the area proposed to be added to the Custer certificated service
area and removed from the Midvale certificated service area is attached hereto as Fxhihit C.
Explicit legal descriptions describing the service area boundaries for Custer and
Midvale ifthis Joint Petition is granted are attached as Fxhihit D and Fxhihit E.A compact disk
containing the proposed modified legal descriptions in Microsoft Word format is being submitted
contemporaneously with this Joint Petition.
The requested Certificate amendments will not affect the service area boundaries
of any other certificated telecommunications carrier, and will not injure or interfere with the
operation of any line, plant or system of any other public utility already constructed. The subject
area is not currently unserved or an uncertificated area. The six residential customers in the
subject area of this Joint Petition currently are being served by Custer.
Granting of this Petition will not require Midvale to construct or expand any
facilities. Consequently, Midvale will not require any financing for construction or expansions if
this Petition is approved.
