CTLT991 ORDER NO. 28059 On April 30, 1999, the Commission received an Application from CTC Telecom, Inc. for an Amended Certificate of Public Convenience and Necessity to provide competitive local exchange service as a competitive local carrier throughout U S WEST Communications, Inc.’s southern Idaho service territory. CTC’s Certificate No. 348 was issued September 22, 1998. The Commission ordered consideration of the Application on Modified Procedure on May 13, 1999 by Order No. 28039. On May 27, 1999, Staff filed comments recommending that the Commission approve the Application. No other party filed comments. Based on the Application, the comments and the law, the Commission grants the Application. BACKGROUND On April 30, 1999, the Commission received an Application from CTC Telecom, Inc. for an Amended Certificate of Public Convenience and Necessity to provide competitive local exchange service as a competitive local carrier throughout U S WEST Communications, Inc.’s southern Idaho service territory. Application at 1. CTC’s Certificate No. 348 was issued September 22, 1998. CTC is an Idaho corporation that was granted a Certificate of Public Convenience and Necessity on August 10, 1998, by Order No. 27673, to provide basic local exchange service to an area known as Hidden Springs, located in Ada County, Idaho. (CTC is an Idaho corporation, and is a wholly-owned subsidiary of Cambridge Telephone Company.) In connection with the issuance of Certificate No. 348, CTC provided all required documentation and information required by Commission Rule of Procedure 111, IDAPA 31.01.01.111, and Procedural Order No. 26665, issued November 7, 1996. Order No. 26665 sets out the necessary information to be included with an Application for a Certificate submitted by a new local service provider in Idaho. STAFF RECOMMENDATION Staff reviewed the Application and found it satisfies the requirements specified by the Commission for the amendment of a Certificate in Order No. 26665. CTC is simply requesting to expand its potential service area to one similar to that requested by nearly all competitive local exchange providers that have been issued a Certificate of Public Convenience and Necessity by this Commission. Staff believed the expanded service area requested in this amendment would enhance competition and therefore be consistent with public interest, convenience and necessity. Staff recommended approval of the Application. COMMISSION FINDINGS Based on the Commission’s review of the record, including the written comments filed by the Commission Staff finds that the Application of CTC complies with Procedural Order No. 26665 and the Commission’s Rules to obtain a Certificate of Public Convenience and Necessity. The Commission finds that granting the Application is in the public’s interest and will promote competition in the service area. O R D E R IT IS HEREBY ORDERED that CTC Telecom, Inc.’s Application is granted and its Certificate of Public Convenience and Necessity, Certificate No. 348 should be amended to allow CTC to provide local telecommunications service in the areas served by U S WEST Communications, Inc. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. CTL-T-99-1 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. CTL-T-99-1. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code  61626.
