RE: IDAHO TELEPHONE ASSOCIATIONS PETITION TO INTERVENE IN CITIZENS TELECOMMUNICATIONS OF IDAHOS APPLICATION TO REBALANCE ITS RATES FOR TELECOMMUNICATIONS SERVICES, CASE NO. CTC-T-98-3.
On June 29, 1998, one week after the deadline for intervention, Idaho Telephone Association (ITA) filed an untimely Petition for Leave to Intervene. No party filed any opposition.
Pursuant to Commission Rule 73, untimely Petitions for Intervention must state a substantial reason for delay. ITA stated that its reason for delay was that ITAs counsel was unable to confirm from the appropriate ITA members and officers whether ITA wished to intervene in this matter until the afternoon of June 26, 1998, and has sought intervention immediately after confirmation was received. Petition at 2. ITA also alleged that no party would be prejudiced and that it did not intend to participate in any hearing. It currently has no position on the merits and only seeks to intervene for the purpose of receiving documents, examining witnesses, and otherwise participating as its interest may appear. Id.
Pursuant to Commission Rule 73, the Commission may deny or conditionally grant petitions to intervene that are not timely filed for failure to state good cause for untimely filing, to prevent disruption, prejudice to existing parties or undue broadening of the issues, or for other reasons.
