Respondent.
On June 18,2002,the Boise County Board of County Commissioners filed a formal
complaint against Citizens Telecommunications Company of Idaho dba Frontier
Communications (Citizens)seeking a refund for alleged overcharges related to 911 service.
Boise County subsequently agreed to an indefinite extension of time for Citizens to file an
answer while the parties attempted to settle the matter.Citizens did not file an answer to the
Boise Countycomplaint.
On November 19,2002,the parties filed a Stipulation for Dismissal of Complaint
With Prejudice.The stipulation asks the Commission to dismiss the complaint "with prejudice
based upon the fact that the parties have resolved their differences."
Pursuant to Idaho Commission Rule of Procedure 274,the Commission "may
summarily accept settlement of an essentially private dispute that has no significant implications
for regulatory law or policy or for other utilities or customers upon the written request of the
affected party."The Commission finds the dispute between Boise County and Citizens is a
private dispute regarding alleged overcharges,and does not affect regulatory law or policy or
other utilities or customers.The Commission accepts the stipulation for dismissal filed by the
parties and issues this Order dismissing the complaint and closing the case.
ORDER
IT IS HEREBY ORDERED that the complaint filed by the Boise County Board of
County Commissioners in this case is dismissed with prejudice.

reconsideration,any other person may cross-petition for reconsideration.See Idaho Code §61-
626.
