BACKGROUND Under the provisions of the federal Telecommunications Act of 1996,interconnection agreements must be submitted to the Commission for approval.47 U.S.C.§252(e)(1).The Commission may reject an agreement adopted by negotiations only if it finds that the agreement: (1)discriminates against telecommunications carrier not a party to the agreement;or (2) implementation of the agreement is not consistent with the public interest,convenience and necessity.47 U.S.C.§252(e)(2)(A).As the Commission recently noted in Order No.28427, companies voluntarilyentering into interconnection agreements "may negotiate terms,prices and DECISIONMEMORANDUM l NOVEMBER 13,2001 conditions that do ng comply with either the FCC rules or with the provisions with Section 251(b) or (c)."Order No.28427 at 11 (emphasis original).This comports with the FCC's statement that "a state commission shall have authorityto approve an interconnection agreement adopted by negotiation even if the terms of the agreement do not complywith the requirements of [Part 51)." 47 C.F.R.§51.3. THE CURRENT APPLICATIONS 1.Citizens Telecommunications Company of Idaho and dPi TeleConnect,LLC. (Case No.CTC-T-01-1).This is a new resale agreement.It was reached through voluntarynegotiations.The standard discount under this agreement is l 1.5%. 2.Verizon Northwest,Inc.and Now Communications,Inc.(Case No.VZN-T-01-14). The parties have requested approval of a negotiated resale interconnection agreement. 3.Owest and Sprint Communications Company,LP (Case No.SPR-T-01-1).This is a new mterconnection agreement. 4.Owest and BG Enterprise,Inc.(Case No.QWE-T-01-23)This is a resale mterconnection agreement. 5.Owest and CI2 Inc.(Case No.QWE-T-01-24).This is a resale interconnection agreement. 6.Verizon Northwest,Inc.and Preferred Carrier Services,Inc.dba Phones for All and Telefonos para Todos.(Case No.VZN-T-01-13).This is a comprehensive mterconnection agreement. 7.TDS Telecommunications Corporation and AT&T Wireless Services,Inc.(Case No.GNR-T-01-19).This is a wireless interconnection agreement. 8.Owest and Eschelon Telecom,Inc.(Case No.QWE-T-00-13).This includes four amendments,adding UNE Loop Installations,Bill and Keep for reciprocal compensation,Amending UNE P recurring charges and nonrecurring charges. 10.Owest and Sprint Spectrum,LP (Case No.USW-T-97-7).This Amendment provides Bill and Keep terms for reciprocal compensation. DECISION MEMORANDUM 2 NOVEMBER 13,2001 STAFF ANALYSIS The Staff has reviewed these Applications and did not find any terms and conditions that it considers to be discriminatory or contrary to the public interest.All contain terms and conditions that are similar to those contained in previouslyapproved agreements.Staffbelieves that theAgreementsandAmendmentsareconsistentwiththepro-competitive policies of this Commission,the Idaho Legislature,and the federal Telecommunications Act.Accordingly,Staff believes thattheAgreementsandAmendmentsmerittheCommission's approval.
