COX-O6- COMMENTS OF THE COMMISSION STAFF The Staff of the Idaho Public Utilities Commission, by and through its Attorney of record Cecelia A. Gassner, Deputy Attorney General, in response to the Notice of Application and Notice of Modified Procedure in Order No. 29981 issued on March 6, 2006, submits the following comments. BACKGROUND On January 31 , 2006, Cox Idaho Telcom, LLC ("Cox ) filed an Application for a Certificate of Public Convenience and Necessity with the Commission. In the Application, Cox proposes to provide facilities-based basic local exchange service in the Idaho communities of Ketchum, Sun Valley, Hailey and Bellevue. Cox Idaho Telcom, LLC is a Delaware limited liability company with a principal place business in Ketchum, Idaho. The Company has a Certificate of Good Standing issued by the Delaware Secretary of State on December 3, 2004, a Certificate of Registration as a Foreign Limited Liability Company issued by the Idaho Secretary of State on January 24, 2006 and a Certificate of Existence issued by the Idaho Secretary of State on January 26, 2006. The Company has provided financial STAFF COMMENTS MARCH 27 2006 information and a letter of financial commitment, as well as the appropriate contact information for its registered agent for service of process within Idaho. STAFF ANALYSIS The Cox Idaho Telcom, LLC Application states that they are a competitive telecommunications company that proposes to provide facilities-based local and toll telecommunications to residential and business customers in the Idaho communities where it currently holds cable franchises. On March 9 2006, the Commission approved an Interconnection Agreement between Cox Idaho Telecom, LLC and Qwest Communications. Cox is a wholly owned company of CoxCom, Inc., a subsidiary of Cox Communications, Inc. Financial data provided in the Application included a balance sheet and consolidated statements for the period ending December 31 , 2000 for Cox Communications, Inc., an indirect, wholly-owned subsidiary of Cox Enterprises, Inc., a multi-service broadband communications company serving approximately 6.6 million customers nationwide. STAFF RECOMMENDATION Staff has reviewed the Application submitted by Cox Idaho Telcom, LLC and believes the Company understands and agrees to comply with the Commission rules and requirements. Based on this review, the Company s filing fulfils the requirements of the Commission Rules and Procedural Order No. 26665. Staff believes that the Company possesses the requisite financial, managerial, and technical qualifications necessary to operate as a provider of telecommunications services.
