CMP-O4- CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE NOTICE OF APPLICATION FA CILITIES- BASED AND RESALE LOCAL EXCHANGE AND INTEREXCHANGE NOTICE OF MODIFIED SERVICES IN ELIGIBLE AREAS PRODEDURE STATEWIDE ORDER NO. 29691 NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that on November 16, 2004, CommPartners, LLC filed an Application for a Certificate of Public Convenience and Necessity to provide facilities- based and resold local exchange and interexchange services in the State of Idaho. According to the Application CommPartners is in the process of building an Internet Protocol (IP) based communications network throughout all 50 states and the District of Columbia. The network is designed to connect public and private IP networks with the Public Switched Telephone Network (PSTN). The Company will provide the network needed for Voice-Over-Internet Protocol (VoIP) providers to originate and terminate IP-based communications, as well as allow for the termination of traditional circuit-switched telephone calls. The traffic to be carried over this network will be comprised of primarily information services traffic such as V olP, as well as interstate, intrastate interLA T A, intraLA T A, and local traffic. YOU ARE FURTHER NOTIFIED that, according to its Application, CommPartners is organized as a Nevada Limited Liability Company. The Application states that it has an Operating Agreement and Certificate of Status issued by the Idaho Secretary of State stating that it is qualified to transact business in the State of Idaho. The Company s principal place of business in Las Vegas, Nevada. The Company states that it will primarily be providing network transit and associated operations support systems for VolP traffic to wholesale customers. CommPartners' proposed service area will be all areas served by incumbent local exchange carriers Qwest and Verizon, that are required by the Telecommunications Act of 1996 interconnect their networks with competitive local exchange carriers. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29691 YOU ARE FURTHER NOTIFIED that, according to its Application, CommPartners network is a "hub-centric" topology consisting of switching centers in Las Vegas, Chicago Atlanta, and New York. These switching centers are collocation points situated in highly sophisticated environments where large numbers of network providers meet for interconnection among their networks. At these locations CommPartners has placed softswitch equipment routers and border control devices. YOU ARE FURTHER NOTIFIED that the Application together with supporting workpapers have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAP A 31.01.01.000 et seq. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has reviewed the filing of record in Case No. CMP- T -04-1. The Commission has preliminarily determined that the public interest may not require a hearing to consider the issues presented in this case and that issues raised by the Company s filing may be processed under Modified Procedure , by written submission rather than by hearing. IDAPA 31.01.01.201-204. In so doing, the Commission notes that Modified Procedure and written comment have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that the Commission may not hold a hearing in this proceeding unless it receives written protests or comments opposing the use of Modified Procedure and stating why Modified Procedure should not be used. IDAP A 31.01.01.203. YOU ARE FURTHER NOTIFIED that if no protests or written comments are received within the deadline, the Commission will consider the matter and enter its Order without a hearing. If protests or comments are filed within the deadline, the Commission will consider them and may, in its discretion, set the matter for hearing or decide the matter and issue its Order on the basis of the written positions before it. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 29691 NOTICE OF COMMENT/PROTEST DEADLINE YOU ARE FURTHER NOTIFIED that the deadline for filing written comments or protests with respect to the Application and the Commission s use of Modified Procedure in Case No. CMP-04-1 is 21 days from the service date of this Order. Persons desiring a hearing must specifically request a hearing in their written protests or comments. IDAP 31.01.01.203. YOU ARE FURTHER NOTIFIED that written comments concernIng Case No. CMP- T -04-1 should be mailed to the Commission and to CommPartners, LLC at the addresses reflected below.
