HomeMy WebLinkAbout20110623final_order_no_32273.pdfOffice of the Secretary Service Date June 23,2011 BEFORE THE IDAhO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE PETITION OF ) CENTURYTEL GEM STATE,INC.DBA )CASE NO.CEN-T-1l-02 CENTURYLINK OF IDAHO FOR A WAIVER ) OF FCC THRESHOLD REQUIREMENTS ) FOR NUMBERING RESOURCES FOR )ORDER NO.32273 GRANDVIE W,IDAHO ) __________________________________________________________________________________ ) On May 27,2011,CenturyTel Gem State,Inc.dba CenturyLink of Idaho (CenturyLink)filed a request for a waiver of number assignment requirements relating to an application the Company previously filed with NeuStar,the North American Number Plan Administrator (NANPA).CenturyLink received a request for additional numbers from a customer served by the Grandview,Idaho,rate center.CenturyLink reviewed the customer’s request and determined it did not have the appropriate numbering resources available within the Grandview rate center.On May 10,2011,CenturyLink submitted a 1,000-block application form to NeuStar to satisfy the request of the customer for additional numbers to meet the customer’s business needs.NeuStar denied the request due to the months to exhaust and/or usage threshold calculations for the Grandview rate center.CenturyLink’s Application filed with the Commission includes the request filed with NeuStar as a confidential document. CenturyLink’s Application asserts that the denial by NeuStar triggers the waiver process as outlined in Federal Communications Commission Numbering Optimization Orders. The FCC permits a waiver of the kind requested by CenturyLink when there is a demonstrated need,such as a specific customer request for numbers.FCC Orders delegate authority to hear requests for waivers to state commissions and recommends that commissions act expeditiously. Staff reviewed the Application for a waiver and available number resources in the Grandview rate center.There are 10 blocks in the Grandview rate center and CenturyLink currently holds the 208-834-2 block.CenturyLink’s customer requires 100 sequential telephone numbers and is not able to use blocks beginning with 0 or 9.Thus,it is not possible for CenturyLink to fulfill the customer’s request with its current inventory of numbers. CenturyLink’s Application with NeuStar was denied due to the months to exhaust calculation for the Grandview rate center.According to NeuStar’s calculation,the months to ORDER NO.32273 1 exhaust for the rate center is 173.65 years.Staff determined that given the low demand for numbers in the rate center and the total available numbers in the 208-834 code inventory,the months to exhaust calculation is reasonable,and CenturyLink does not currently have 100 sequential numbers to provide to its customer.Staff recommended the Commission approve CenturyLink’s requested waiver and that 100 consecutive numbers be granted to CenturyLink for its customer.Specifically,Staff recommended that NPA NXX X (208-834-3)be released to CenturyLink for its Grandview customer. After reviewing CenturyLink’s Application and Staffs recommendation,the Commission finds it appropriate to approve the waiver request filed by CenturyLink.The requested number assignment is necessary for CenturyLink to meet the needs of its customer, and granting the request will facilitate the business expansion of the customer.Accordingly,the Commission finds that it is reasonable to direct that NeuStar release the NPA NXX X (208-834- 3)block to CenturyLink to meet the business expansion needs of its customer in Grandview, Idaho. ORDER IT IS HEREBY ORDERED that CenturyLink’s request for a waiver of the FCC’s Numbering Optimization Requirement is approved. IT IS FURTHER ORDERED that NeuStar release the NPA NXX X (208-834-3) number block in the Grandview,Idaho wire center to CenturyLink to satisfy the request of a CenturyLink customer. THIS IS A FINAL ORDER.Any person interested in this Order may petition for reconsideration within twenty-one (21)days of the service date of this Order.Within seven (7) days after any person has petitioned for reconsideration,any other person may cross-petition for reconsideration.See Idaho Code §6 1-626.
