CCC-T-99-1 LLC FOR A CERTIFICATE OF PUBLIC ) CONVENIENCE AND NECESSITY TO ) PROVIDE LOCAL EXCHANGE SERVICE IN ) THE STATE OF IDAHO. ) ORDER NO. 28489 ) On November 1, 1999, Clearcore Communications, LLC submitted an Application for a Certificate of Public Convenience and Necessity to provide basic local exchange service to customers within the state of Idaho. In its Application, the Company specifically identified the service territory of U S WEST Communications (now known as Qwest Communications) in southern Idaho as its proposed service area. The Company did not include any financial information or a business plan but explained that "it will be able to raise sufficient capital to expand services when necessary." Upon its review of the Company's Application, the Commission Staff advised the Company in December 1999 that additional information was necessary to bring the filing in compliance with Commission Order No. 26665 as well as the Commission's Telephone Customer Relations Rules, IDAPA 31.41.01. Two of the Staff's main concerns were the lack of financial data contained in the Application and the Company's illustrative tariffs required advance payment for telecommunication services. The Company did not respond. On March 30, 2000, Staff sent another letter to Clearcore requesting the information to complete the administrative review of the Company's Application. In this subsequent letter, Staff requested that the revisions and additional information be provided no later than April 24, 2000. Again, the Company did not respond to the Staffs inquiry. Given the lack of responses, the Staff recommended on August 3, 2000, that Clearcore's Application for a Certificate be dismissed without prejudice. The Staff alleged that the Company has not been responsive to Staff's inquiries and that the Application does not comport with the Commission's Procedural Order No. 26665 and the Commission's Telephone Customer Relations Rules, IDAPA 31.41.01. ORDER NO. 28489 1 S : . Based upon the Staff's recommendation and the fact that Clearcore has not provided the necessary information to complete its Application, the Commission finds that it is reasonable to dismiss Clearcore's Application without prejudice. Consequently, Clearcore's Application for a Certificate of Public Convenience and Necessity to provide basic local exchange service within Idaho is denied. ORDER IT IS HEREBY ORDERED that Clearcore Communications, LLC's Application for a Certificate of Public Convenience and Necessity to provide basic local exchange service within Idaho is denied without prejudice. THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. CCC-T-99-1 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this order or in interlocutory Orders previously issued in this Case No. CCC-T-99-1. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61-626.
