APPLICATION OF PRICE LIST
Broadview Networks, Inc. (hereinafter "The Company") has been authorized by the Idaho Public
Utilties Commssion (Idaho PUC) to provide competitive local exchange and interexchange
serces.
This tarff sets fort the service offerings, rates, ters and conditions applicable to the furnshing
oflocal exchange serces to small business customers within the State ofIdaho. The rates and
rules contained herein are subject to change pursuant to the rules and regulations of the Idaho
PUC.
EXPLANATION OF SYMBOLS, REFERENCE MARKS, AND ABBREVIATIONS OF
TECHNICAL TERMS USED IN THIS PRICE LIST
The following symbols shall be used as set out below to descrbe specific changes made to the
original price list.
C Indicates a changed listing, rule, or condition, which may affect
rates or charges
D Indicates discontinued materal, including a listing, rate, rue or
condition
I Indicates an increase
M Indicates that the material has been relocated to _another par of
price list schedules with no change in text, rate, rule or condition
N Indicates new materal including listing, rate, rule or condition

1.0 DEFINITIONS
The following words and terms when used in this price list shall have the meanng set out by this
section.
Access Lines: Telephone facilities which permits access to and :fom the Customer's premises
and the telephone exchange or serng central office.
Advance Payment: A payment required before the star of serce. Advanced payment may
consist of any required constrction cost, all appropriate non-recurng charges, and an estimate
of the first month's recurng charges. Advance Payments will be applied to the first bil rendered
by Company following implementation of serices.
Agent: A business representative authorized by the Company to bring about, modify, affect,
accept perormance of, or terminate contractual obligations between the Company and its
applicants or Customers.
Applicant: A person who applies for telecommunications serice. Includes persons seeking
reconnection of serce after Company-intiated termination.
Application: A request made in wrting for telephone serice.
Authorized User: A person, fi or corporation that is authorized by the Company to be
connected to the serce of the Customer or joint user.
Automatic Number Identification (ANI): The automatic transmission of a calling par's biling
account telephone number to a local exchange Company, interexchange carer or a thrd par
subscriber. The primar purose of ANI is for biling of toll calls.
Basic Rate Area: A specific geographic area, withn which the schedule rates for local exchange
serce apply without exchange line mileage and without special rates in lieu of mileage.
Central Offce: Company facilties where subscrber lines are connected to each other though
switching equipment for placing local and long distance telephone calls.

Customer or Subscrber: The person, firm or corporation that orders servce and is responsible
for the payment of charges for that serice and for compliance with the Company's regulations
related to that service.
Nonlisted Serce: A directory listing serce wherein a Customer is not listed in the published
directory, but is listed in the directory assistance database.
Nonpublished Serce: A directory listing serice whereinß Customer is not listed in the
published directory or in the directory assistace database.
Recurng Charges: The charges to a Customer for servces, facilities and equipment, which
recur monthy for the agreed upon durtion of the serce.
Residential Serce: Telephone Serce provided to customers when the actual or obvious use is
for domestic puroses.
Service Commencement Date: The first day following the date on which the Company notifies
the Customer that the requested servce or facility is available for use, uness the Customer
refuses to accept serice because it does not conform to the stadards set forth in the Serice
Order or in this price list, in which case the Servce Commencement Date is the date on which
the Customer accepts serice. The Company and the Customer may agree on a substitute Serce
Commencement Date.
Serice Order: The wrtten order for Serces executed by the Customer and the Company in the
format devised by the Company. The signng of a Serce Order by the Customer and acceptace
by the Company initiates the obligations of the respective_paries as set forth therein and
pursuant to this price list; except that the duration of the serce is calculated :fom the Serice
Commencement Date.
Shared: A facility or equipment system or subsystem that can be used simultaneously by several
Customers.
Small Business Serce: Telephone service provided to businesses with five (5) or fewer lines.

2.0 REGULATIONS
2.1 Underaking of the Company
2.1.1 Scope
2.1.1.2 The Company underakes to furnsh local exchange communications
serce pursuant to the terms of ths price list.
2.1.1.2 The serces offered herein may be used for any lawful purose. There are
no restrctions on sharng or resale of the Company's serces. However, the Customer
remains liable for all obligations under this price list even if such sharng or resale
arangements exist regardless of the Company's knowledge of these arangements. If
serice is jointly ordered by more than one Customer, each is jointly and severally liable
for all obligations.
2.1.1.3 The servces the Company offers shall not be used for any unlawful
puroses or for any use for which the Customer has not obtained all required
goverental approvals, authorizations, licenses, consents and permts.
2.1.1.4 Company serces may be connected to the servces or facilities of other
communications carers only when authorized by and in accordance with the ters and
conditions of any price lists of such other communications carers.
2.1.1.5 The servces of the Company are fuished for the transmission of voice
communications but may also be used for data, facsimile, signaling, meterng, or other
simlar communcations, subject to the transmission capabilities of the technologies or
combination of technologies available. Serice is available twenty-four hours a day,
seven days a week.

2.2 Shortage of Equipment or Facilities
The furnishing of servce under ths price list is subject to the availability on a continuing
basis of all facilities necessar to provide the service. Serices wil be provided using a
combination of the Company's facilities and/or the resale of other carer facilities.
2.3 Selection of Transmission
The Company selects and/or aranges for the chanels and/or serce components and
underlying network facilities used to provide service. The Company may modify or
change the chanels, service components and underlyig Company facilities or the
underlying carer at any time subject to Par 68 of the FCC's Rules and Regulations and
this price list.
2.4 Notification of Serce-Affecting Activities
The Company wil provide the Customer with reasonable notification of servce-affecting
activities that may occur durng the normal operation of its business. Such activities may
include, but are not limited to, equipment or facilties additions, removals or
rearangements and routine preventive maintenance. Generally, such activities are not
specific to an individual Customer but affect many Customers' serices. No specific
advance notification period is applicable to all serice-affecting activities. The Company
wil work cooperatively with the Customer to determine reasonable notification
requirements. Notification to the Customer may not be possible with some emergency or
unplaned serice-affecting conditions, such as an outage resulting :fom cable damage.
2.5 Provision of Equipment and Facilities
2.5.1 The Company shall make a reasonable effort to provide servce to a Customer on or
before a parcular date, subject to the provisions of and compliance by the Customer
with the regulations contained in this price list.
2.5.2 The Company shall make a reasonable effort to maitain facilties that it fuishes
to the Customer. The Customer shall not, and the Customer shall not permit others to,
rearange, disconnect, remove, attempt to repair or otherise interfere with any of the
facilities installed by the Company, except upon the wrtten consent ofthe Company.

2.6 Ters and Conditions
2.6.1 Serice is provided on a minimum term basis of at least one month, using
24-hours per day for each day ofthe month. For puroses of ths price list, a month is
considered to have thirt days. All calculations of dates set forth in this price list shall be
based on calendar days, unless otherwise specified herein.
2.6.2 Ths price list shall be interreted and govered by the laws of the State of
Idaho and the Rules issued by the Idaho Public Utilities Commission.
2.7 Non-routine Installation and Special Constrction
2.7.1 Non-Routine Installation
At the Customer's request, installation and/or maitenance may be pedormed
outside the Company's regular business hours or in hazardous locations. In such cases,
charges based on cost of the actual labor, materal, or other costs incured by or charged
to the Company wil apply.
2.7.2 Special Constrction
Subject to the agreement of the Company, special constrction of facilities may
be underaken on a reasonable effort basis at the request of the Customer. Special
constrction may include that constrction underen:
(a) where facilities are not presently available;
(b) of a tye other than that which the Company would normally utilize in thefushig of its serice;
(c) over a route other than that which the Company would normally utilize in the
fushing of its services;
(d) in a quantity greater than that which the Company would normally utilize in
the fuishing of its serices;
(e) on an expedited basis;
(t) on a temporar basis until peranent facilities are available;
(g) involving abnormal costs; or
(h) in advance of normal constrction.Issued Date: Effective Date:

Special constrction wil be undertaken at the discretion of the Company consistent with
budgetar responsibilities and consideration for the effect on Company's other Customers and
contractual responsibilities.
2.7.3 Ifrequired by the Company, the Customer shall make an advance payment
before serices are fushed and such advance payment will be credited to the
Customer's initial bilL. The Company may require such an advance payment, in addition
to a deposit, when additional costs are incurred to perorm special or extraordinar
constrction to provide serices required by the customer.
2.8 Ownership of Facilities
Title to all facilities and equipment, and related plans and proposals, provided by the Company
in fuishing serce remains with the Company, its agents or contractors. Such facilities and
equipment, plans and proposals shall be retued to the Company by the Customer whenever
requested, within a reasonable perod following the request and in as good condition as
reasonable wear wil perit.
2.9 Rights-of-Way
Provisioning of the Company's services is subject to and contingent upon the Company's ability
to obtai and maintai rights-of-way and access to public and private proper necessar for
installation of the facilities used to provide the Company's serices to the Customer's serce
point as agreed to by the Company.

A.Except as otherise stated in ths section, the liability of the Company for
damages arsing out of either: (1) the fushing of its serces, including
but not limited to mistakes, omissions, interptions, delays, or erors, or
other defects, representations, or use ofthese serices or (2) the failure to
fush its serice, whether caused by acts or omission, shall be limted to
the extension of allowances to the Customer for interrptions in serce as
set fort in Section 2.7.
Except for the extension of allowances to the Customer for interptions in
serice as set fort n Section 2.7, the Company shall not be liable to a
Customer or thrd par for any direct, indirect, special, incidental,
reliance, consequential, exemplar or puntive damages, including, but not
limited to, loss or revenue or profits, for any reason whatsoever, including,
but not limited to, any act or omission, failure to perorm, delay,
interption, failure to provide any serce or any failure in or breakdown
of facilities associated with the serice.
The liability of the Company for erors in biling that result in
overayment by the Customer shall be limited to a credit equal t the dollar
amount eroneously biled or, in the event that payment has been made
and service has been discontinued, to a refud of the amount eroneously
biled.

D.The Company does not guarantee nor make any waranty with respect to
installations provided by it for use in an explosive atmosphere.
E.The Company makes no waranties or representations, EXPRESS OR
IMPLIED, either in fact or by operation oflaw, statutory or otherise,
including waranties of merchantabilty or fitness for a partcular use,
except those expressly set fort herein.
F.failure by the company to asser its rights pursuant to one provision of ths
rate sheet does not preclude the Company :fom asserting its rights under
other provisions. .
G.Directory Errors - In the absence of gross negligence or wilful
misconduct, no liability for damages arsing from erors or mistakes in or
omissions of directory listings, or erors or mistakes in or omissions of
listing obtainable :fom the directory assistance operator, including errors
in the reporting thereof, shall attach to the Company. An allowance for
errors or mistakes in or omissions of published directory listings or for
errors or mistakes in or omissions of listing obtainable from the directory
assistance operator shall be at the monthy tarff rate for each listing, or in
the case of a free or no-charge directory listing, credit shall equal two
times the monthy taff rate for an additional listing, for the life of the
directory or the charge perod durng which the error, mistake or omission
occurs.

H. With respect to Emergency Number 911 Servce:
1.Neither is the Company responsible for any infrngement, nor
invasion of the right of privacy or any person or persons, caused or
claimed to have been caused directly or indirectly, by the
installation, operation, failure to operate, maintenance, removal,
presence, conditions, occasion or use of emergency 9 I I servce
featues and the equipment associated therewith, or by any serices
fushed by the Company, including, but not limited to the
identification of the telephone number, address or name associated
with the telephone used by the par or paries accessing
emergency 911 serice, and which arse out of the negligence or
other wrongful act of the Company, the Customer, its user,
agencies or muncipalities, or the employees or agents of anyone
of them.
2.When a Customer with a nonpublished telephone number, as
defined herein, places a call to emergency 911 serice, the
Company wil release the name and address of the calling par,
where such information can be detered, to the appropriate local
goverental authority. By subscribing to serce under ths rate
sheet, the Customer acknowledges and agrees with the release of
information as descrbed above.

2.10.1 Exculpatory Clause
THE INCLUDED EXCULPATORY LANGUAGE DOES NOT CONSTITUTE A
DETERMINATION BY THE COMMISSION THAT A LIMITATION OF LIABILITY
IMPOSED BY THE COMPANY SHOULD BE UPHELD IN A COURT OF LAW.
ACCEPTANCE FOR FILING BY THE COMMISSION RECOGNIZES THAT IT IS A
COURT'S RESPONSIBILITY TO ADJUDICATE NEGLIGENCE AND CONSEQUENTIAL
DAMAGE CLAIMS. IT IS ALSO THE COURT'S RESPONSIBILITY TO DETERMINE THE
VALIDITY OF THE EXCULPATORY CLAUSE.

2.1 I Indemification
The Company shall be indemfied and saved haress by the Customer from and against all
loss, liability, damage and expense, including reasonable counsel fees, due to:
Any act or omission of: (a) the Customer, (b) any other entity fushing serce, equipment or
facilties for use in conjunction with serces or facilities provided by the Company; or (c)
common carers or warehousemen, except as contracted by the Company.
Any delay or failure of perormance or equipment due to causes beyond the Company's control,
including but not limited to, acts of God, fires, floods, earquakes, hurcanes, or other
catastrophes; national emergencies, insurections, riots, wars or other civil commotions; stres,
lockouts, work stoppages or other labor difficulties; crminal actions taken against the Company;
unavailability, failure or malfuction of equipment or facilities provided by the Customer or third
paries; and any law, order, regulation or other action of any governg authority or agency
thereof;
Any unawful or unauthorized use ofthe Company's facilties and serices;
Libel, slander, invasion of privacy or infrngement of patents, trade secrets, or copyrghts arsing
from or in connection with the materal transmitted by means of Company-provided facilities or
serces; or by means of the combination of Company-provided facilities or serces;
Breach in the privacy or securty of communcations transmitted over the Company's facilities.
Changes in any of the facilities, operations or procedures of the Company that render any
equipment, facilities or servces provided by the Customer obsolete, or requie modification or
alteration of such equipment, facilities or serices, or otherwse affect their use or perormance,
except where reasonable notice is required by the company and is not provided to the Customer,
in which event the Company's liabilty is limited as set fort in paragraph A. of Subsection
2.1.10.
Defacement of or damage to Customer premises resulting :fom the furnshing of serices or
equipment on such premses or the installation or removal thereof;

Injur to propert or injur or death to persons, including claims for payments made under
Worker's Compensation law or under any plan for employee disabilty or death benefits, arsing
out of, or caused by, any act or omission of the Customer, or the constrction, installation,
maintenance, presence, use or removal of the Customer's faciliies or equipment connected, or to
be connected to the Company's facilities;
Any noncompletion of calls due to network busy conditions;
Any calls not actully attempted to be completed durng any period that service is unavailable;
And any other claim resulting :fom any act or omission of the Customer or patron(s) of the
Customer relating to the use of the Company's servces or facilties.
2.12 Conflicts Between Price List and Commssion Rules
If ths Price List contains provisions that deny or restrct a Customer's rights otherise protected
by Commission rules, Commssion rues superede any conflcting tarff or price list provisions
that deny or restrct any of those rights, uness otherwise ordered by the Commssion, cour
order, or statute.
2.13 Allowances for Interrptions in Serice
A credit allowance wil be given for interptions of serice, subject to the provisions of this
section.
2.13.1 Credit for Service Interptions
A credit allowance wil be made when an interption in serice occurs. An interption
in servce is considered to exist when the local servce quality deterorates to such an extent that
the customer canot make local calls or

canot receive local calls or canot use the serice for voice grade
communcations because of cross talk, static or other transmission problem.
An interption perod begis when the Customer reports a circuit, serce or
facility to be interpted and releases it for testing.
2.13.1.1 The Company must restore service: withn sixteen (16) hours
after the report of the outage if the customer notifies the telephone company that
the servce outage creates an emergency; or
2.13.1.2 withn 24 hours after the report of the outage if no emergency
exists.
2.13.1.3 Outages reported beteen noon on Saturday and 6:00 p.m. on the
following Sunday must be restored withn fort-eight (48) hours or by 6:00 p.m.
on the following Monday, whichever is sooner.
2. I 3 .1.4 If the Company does not restore servce with the times required
by this paragraph, the Company wil credit the customer's account for an amount
equal to the monthly rate for one (1) month of basic local exchange service.
2.13.2 Limitations on Allowances
No credit allowance wil be made for:
2.13.2.1 interptions due to the negligence of the Customer, or noncompliance
with, or acts of omission regarding the provisions of ths price list by the Customer,
authorized user or joint user;

2.13.2.2 interptions of serice durng any perod in which the Company is not
given full and free access to its facilities. and equipment for the purpose of investigating
and correcting interptions;
2.13.2.3 interptions of serce durng a perod when the Customer has released
serce to the Company for maintenance puroses or for implementation of a Customer
order for a change in service arangements; or
2.13.2.4 interption of serce due to circumstances or causes beyond the control
of the Company and affecting large groups of customers.
2.14 Obligations of the Customer
2.14.1 The Customer shall provide at no charge, as specified by the Company, any
personnel, equipment, space, power, heating and air conditioning needed to operate, and
maintain a proper operating environment for the Company's facilities and equipment installed on
the Customer's premises.
2.14.2 Upon suitable notification to the Customer, and at a reasonable time, the Company
may make such tests and inspections as may be necessar to deterine that the Customer is
complying with the requirements set fort herein for the installation, operation, and maintenance
of Customer-provided facilities, equipment, and wiring in the connection of Customer-provided
facilities and equipment to Company-owned facilities and equipment.
2.14.3 If the protective requirements for Customer-provided equipment are not being
complied with, the Company may take such action as it deems necessar to protect its facilities,
equipment, and personneL. The Company wil notify the Customer promptly if there is any need
for fuer corrective action. Withn ten days of receiving this notice, the Customer must take
this corrective action and notify the Company of the action taken. If the Customer fails to do this,
the Company may take whatever additional action is deemed necessar, including the suspension
of serice, to protect its facilities, equipment and personnel from har.

2.15 Prohibited Uses
The Customer shall not use or allow the use ofthe Company's facilities or equipment installed at
the Customer's premises for any purose other than that for which the Company provides it,
without the prior wrtten consent of the Company.
2.15.1 Abuse
The abuse of Company Services is prohibited. Abuse includes, but is not limited to, the
following activities:
(a) Using service to make calls that might reasonably be expected to frghten, torment, or
harass another.
(b) Using service in such a way that it intederes uneasonably with the use of Company
serces by other.
2.15.2 Fraudulent Use
The :faudulent use or the intended or attempted :faudulent use of serce is prohibited
and can result in the discontinuance of services as set out by this price list. Fraudulent use
consists of using or attempting to use serce with the intent to avoid the payment, either in
whole or in par, of the price listed charges for the servce including but not limited to:

(a) rearangig, tamperig with, or makng connections not authorized by ths price list
to any network components used to fush serice; or
(b) using :faudulent means or devices, trcks, schemes, false or invalid numbers, false
credit devices, or electronic devices.
2.16 Payments
2.16.1 Customer Obligations
2.16.1.1 The Customer shall pay outstanding charges in full withn th (30) days of the
invoice date. Charges normally will be invoiced in arear, with monthly recurng charges
invoiced on or about the first of the month for which the charges apply. Amounts not paid within
thirt (30) days after the date of the invoice are considered delinquent.
2.16.1.2 The Customer shall pay all charges for use of the serice by any persons whether
or not authorized by the Customer, except in those instances where it has been deterined that
the Customer's present and former employees, agents and authorized users were not responsible
for calls biled to the Customer via third par biling and the Company did not verfy that the
charges for the call would be accepted. The Customer is not responsible for unauthorized use of
serce to the extent such use is proxiately caused by the Company's wilful or negligent act.

2.16.2 Disputed Bils
2.16.2.1 Any Customer who disputes a porton of a bil rendered for Company
serices shall pay the undisputed portion of the bil and notify the Company that such
unpaid amount is in dispute within thrty (30) days of receipt of the bil. If such notice is
not received by the Company with thirt (30) days as indicated above, the Company
shall consider the bil statement to be due and payable in ful by the Customer. Payment
of the amount due by the Customer does not constitute a waiver of the Customer's rights
under the provisions ofIDAPA 31.41.01.204 to challenge any biling amount due or paid
to the Company.
2.16.2.2 In the event a Customer and the Company canot resolve a biling
dispute to their mutu satisfaction, the Customer may contact the Idaho PUC and
proceed in accordance with the Idaho PUC's Rules. The address and telephone numbers

2.16.3 Payment Arangements
2.16.3.1 When a Customer canot pay a bil in full, the Company may continue to
sere the Customer if the Customer and the Company agree on a reasonable portion of
the outstanding bil to be paid immediately, and the manner in which the balance of the
outstanding bil wil be paid.
2.16.3.2 In deciding on the reasonableness of a particular agreement, the
Company wil take into account the Customer's ability to pay, the size of the unpaid
balance, the Customer's payment history and length of serce, and the amount of time
and reasons why the debt is outstanding.
2.16.3.3 Payments are to be applied to the undisputed balance owed by the
Customer. A Customer may designate how a payment insufficient to pay the total balance
due shall be applied. If applicable, and in the absence of instrctions :fom the Customer,
a paral payment shall be allocated first to local exchange serices. Such payments shall
be applied first to the oldest undisputed balances.
2.16.3.5 If a Customer fails to make the payment agreed upon by the date that it is
due, the Company may, but is not obligated to, enter into a second payment arangement.
2.16.3.7 A Customer's failure to pay for undisputed MTS charges biled by the
Company may result in loss of 0+, 0- and 1 + dialing access to MTS serices until such
time as the customer pays the undisputed charges and applicable reconnection charges, if
any.
2.16.3.8 Customer failure to pay undisputed charges for other serces may result
in discontinuance of those serices.

2.17 Taxes, Charges, Fees
In addition to the rates and charges descrbed in this price list, the Customer may be
responsible for payment of taxes, charges or fees ordered by the Idaho PUC, the Idaho State
Legislatue, or local and county goverents. When the Company is authorized to collect such
taxes, charges or fees :fom the Customer, these taxes, charges and fees wil be itemized
separately on the Customer's bil.
2.18 Deposits
2.18.1 The Company wil not require advance deposits.

2.19 Refusal or Termination of Serices
If the Company intends to deny an available serce to an applicant, the Company wil
provide the applicant with a written explanation of its refusal to sere. The written explanation
shall include:
a) the reasons for denial of the serce;
b) actions the applicant may take in order to receive the dened serice; and
c) a statement that the Customer may fie an informal or formal complaint concernng
denial of the serice with the Company or with the Idaho PUC.
2.19.1 Grounds for Refusal to Establish Serice
The Company may refuse to establish serce if any of the following conditions exist:
. 2.19.1.1 the applicant has an outstanding amount due to the CompanyJor similar
utility serces and the applicant is unwillng to make acceptable arangements with the
Company for payment;
2.19.1.2 a condition exists that, in the Company's judgment, is unsafe or
hazardous to the applicant, the general population, or the Company's personnel, agents or
facilities;
2.19.1.3 the applicant refuses to provide the Company with a deposit after having
failed to meet the credit critera for waiver of deposit requirements;
2.19.1.4 the applicant is known to be in violation of the Company's price lists
filed with the Commssion;
2.19.1.5 the applicant fails to fush such funds, suitable facilities, and/or rights-
of-way which have been specified by the Company as necessar to and a condition for
providing serice to the applicant; or
2.19.1.6 the applicant has falsified his/her identity for the purose of obtaig
serice.

2.19.2 Grounds for Terination with Written Prior Notice
Except as otherise specified in ths price list or Idaho PUC rues, the Company may,
upon reasonable wrtten notice to the Customer, discontinue serices for any of the following
reasons:
2.19.2.1 for nonpayment of any undisputed amounts owing to the Company;
2.19.2.2 for serces provided to premses that have been vacated by the
Customer;
2.19.2.3 for tampering with the Company's proper;
2.19.2.4 for violation of rules, serice agreements, or fied price lists;
2.19.2.5 for use of Customer equipment which adversely affects the Company's
proper, facilities, or serice to its other Customers, or upon condemation of any
materal portion of the facilties used by the Company to provide serice to a Customer,
or if a casualty renders all or any materal portion of such facilities inoperable beyond
feasible repair; or
2.19.2.6 for :faudulent obtaining or use of servce, including, but not limited to:
(a) providing false information to carer the Company regarding the
Customer's identity, address, creditwortness, or curent or planed use of
common communications;
(b) using or attempting to use serice by rearanging, tamperng with, or
makng connection to the Company's serice where not authorized by ths price
list;
(c) using tricks, schemes, false or invalid numbers, false credit devices,
electronic devices; or

2.19.3 Without Written Notice to the Customer
The Company may deny or discontinue the fushing of any and/or all servce(s) to a
Customer immediately and without prior notice to the Customer and without the Customer's
perssion for one or more of the following reasons:
2.19.3.1 Dangerous Condition. A condition immediately dangerous or hazardous
to the life, physical safety, or proper exists, or it is necessar to prevent a violation of
federal, state or local safety or health codes.
2.19.3.2 Ordered to Terminate Serice. The Company is ordered to terinate
serice by any cour, the Idaho PUC, or any other duly authorized public authority.
2.19.3.3 Services Obtained Ilegally. The servces(s) was (were) obtaied,
divered or used without the authorization or knowledge of the Company.
2.19.3.4 Customer Unable to be Contacted. The Company has tred dilgently to
provide reasonable notice to the Customer, but has been unsuccessful in its attempt to
contact the Customer.
2.19.3.5 Misrepresentation of Identity. The Customer has misrepresented the
Customer's identity for puroses of obtaining telephone serice and either does not have
or has an inadequate securty deposit on file with the Company.
2.19.3.6 for any goverental prohibition, or required alteration of the serces
provided, or any violation of any applicable law or regulation, or unawful use of serce
or use of serce for unawful puroses, the Company may immediately discontinue or
suspend serice.

2.19.4 Notice of Disconnection
2.19.4.1 Seven-Day Notice
Except as otherise provided under the provisions ofIDAP A 31.41.01.303.04
and 31.41.01.305, the Company wil mail to the Customer wrtten notice of teration at
least seven (7) calendar days before the proposed date of termination. The wrtten notice
wil contain the information required by IDAP A 31.41.01.306.
2.19.4.2 Twenty-Four-Hour Notice
At least twenty-four (24) hours before actual termination, the Company wil
diligently attempt to contact the Customer affected to apprise the Customer of the
proposed action and the steps to tale to avoid or delay terination. Oral Notice wil
contain the same information as required by IDAP A 31.41.01.306.

2.19.4.3 Additional Notice
If the Company does not terminate serice withn seven (7) days after a proposed
terination date, and the matter is not the subject of a pending complaint before the
Idaho PUC, or if other arangements have not been made with the Customer, the
Company wil again make a diligent effort to contact the Customer to advise the
Customer of the proposed action. If the Company has not terinated serce withn
twenty-eight (28) days of mailing a written notice of termination, but stil intends to
terate, the Company wil again issue a written notice as set out by subsection 2.19.4.1
of this price list, related to Seven-Day Notice.
2.19.5 Customer Cancellation of Serice
If the Customer cancels a serce order or terinates serice before the
completion of the term of serice specified in the serce order for any reason, the
Customer agrees to pay to the Company all costs, fees, and expenses reasonably incured
in connection with special constrction and with the term of serce. In addition, the
Customer may be liable for termination charges up to a maxmum amount equal to the
total charges applicable for the remaining ter specified in the servce order.

2.20 Restoration of Serce
2.20.1 A reconnection charge shall be imposed on any Customer whose servce
has been discontinued pursuant to the provisions of Section 2.19 of this price list. The
Company reseres the right to refuse to restore serice until all amounts due have been
paid.
2.20.2 Should the Customer request that service be restored durng a period other
than regular working hours, such as evenings or weekends, the Customer may be required
to pay an after-hour charge for servce reconnection.
2.21 Assignent
The Company may, without obtaining any fuer consent from the Customer, assign any
of its rights, privileges or obligations under ths price list to any subsidiar, parent, or affliate of
the Company; pursuat to any sale or transfer of substatially all the business of the Company;
or puruat to any financing, merger or reorganzation of the Company. The Customer may,
upon prior wrtten consent of the Company, which consent shall not be uneasonably witheld,
assign its rights, privileges or obligations under this price list to any subsidiar, parent, or
affliate of the Customer; pursuant to any sale or transfer of substantially all the business of the
Customer; or pursuant to any financing, merger or reorganzation of the Customer.
2.22 Promotions
The Company may provide promotional offerings from time to time. The Company wil
notify the Idaho PUC ten (10) days in advance of the rates, terms & conditions of any such
promotions.
2.23 E911
The Company wil provide necessar Customer information to the incumbent local
exchange carrer for appropriate routing ofE911 calls. The Company's switches wil be
equipped with E911 trs and all E911 traffc wil be switched by the Company to the
incumbent local exchange carer for routing.

2.24 Public Notice
The Company shall give public notice of all proposed changes in rates. Public notice
must be reasonably designed to call the attention of Customers who are affected by the changes
to the proposed changes in rates. Legal advertisements alone wil not be considered adequate
public notice. Individual notice to all Customers affected wil always constitute public notice

3.0 LOCAL EXCHANGE SERVICES
3.1 General
The following Company Serices in this section are for business and residential
Customers and for carers cerficated by the Commission.
All serices offered in this tarff are subject to service order and serce change charges
where the Customer requests new serces or changes in existing serices, as well as indicated
Non-Recurrng and Monthly Recurrg Charges. Charges for local callng serices and
Measured Telecommuncations Serce are assessed on either a flat rate or a measured rate basis
and are additional to the charges shown for Standard Residence or Business Line as are other
servce charges.
3.1.1 Local Exchange Servce Areas
Local exchange services are provided, subject to availability of facilities and equipment, in
the exchanges and local calling areas curently served by the Incumbent LEC. NXX's associated
with each paricular exchange or zone may be found in the telephone directory published by the
incumbent local exchange provider in the Customer's exchange.

3.2 Stadard Access Line
The Standard Residential or Business Access Line provides a Customer with a single,
analog, voice-grade telephonic communcations chanel that can be used to place or
receive one call at a time. Standard Access Lines are provided for the connection of
Customer-provided wirng and single station sets or facsimile machines. A multi-line
subscrber is a Business customer with more than one line provided by Broadview
Networks. Standard Access Lines enable the customer to:
(a) place or receive calls to any station in the local calling area, as defined herein;
(b) access enhanced 911 Emergency Servce where available;
(c) access the interexchange carer selected by the Customer for interLATA,
intraLA T A, interstate or international callng;
(d) access Operator Serices;
( e) access Directory Assistance;
(t) place or receive calls to 800 numbers;
(g) access Telecommuncations Relay Serice.
Touch Tone signaling, consisting of a push button or touchtone dial that sends out a
sound which consists of two discrete tones (one low frequency and one high :fequency),
picked up and interreted by telephone switches, is provided as par of the Stadard
Access Line.
The Company's servce wil automatically block originating calls to other telephone
companes' caller-paid information servces (e.g., 900, 976) at no charge. Calls to those
numbers and other numbers used for caller-paid information serces wil be unblocked
on a per directory number basis only. Subsequent blockig of 900-tye numbers wil
incur a charge listed in section 4.

3.2 Serice Descriptions
3.2.1 Business Serice
Call Timing for Usage Sensitive Serices
Where charges for a serice are specified based on the duration of use, such as the
duration of a telephone call, the following rules apply:
Calls are measured in durational increments identified for each service. All calls
which are fractions of a measurement increment are rounded up to the next whole
unit.
Timing on completed calls begins when the call is answered by the called part.
Answering is deterined by hardware answer supersion in all cases where ths
signaling is provided by the terinating local carer and any intermediate
carer( s ).
Timing terates on all calls when the callng par hangs up or the Company's
network receives an off-hook signal from the terinating carer.

3.3 Local Exchange Serice
Local Exchange Serce provides the customer the ability to complete local and long
distance calls. The Company concurs in the local callng areas defied in the local
exchange tarff of the incumbent local exchange company for the geographic area being
sered. This serce provides the customer with unimited local calling.
3.3.1 Optional Features
Anonymous Call Rejection - An arangement that allows a called par to block
calls :fom paries that have marked their calls "private." Customer may activate
or deactivate this arangement by dialing a preassigned activation code. There is
no charge for this featue.
Call Forwarding - Perits a Customer to transfer all incoming calls to another
telephone number. The Customer pre-selects a second telephone number to
which all incoming calls are to be transferred automatically. Call Forwarding
shall not be used to extend calls on a planed or continuing basis to intentionally
avoid the payment in whole or in par, of message toll charges that would
regularly be applicable between the access line originating the call and the access
line to which the call is transferred. Customers utilzing Call Forwarding service
are responsible for the payment of charges for each toll call between his access
line and the distat access line to which the call was transferred.
Call Retu - Enables a Customer to automatically retu the last incoming calL.
To retu the call, the Customer dials a specified code and the number is dialed
automatically. If the called line is busy, a 30-minute queuing process begins. The
Customer is then given an indication that the network wil attempt to set up the
call when the called line is idle.
Call Waiting - By means of a tone signal, a Customer who is using his telephone
is alered when another call is trng to reach that telephone number. Ths serice
permts putting the first calIon hold so that a second call can be answered.

Caller ID - Ths featue delivers calling par information to pares being called.
Caller ID wil indicate the name and directory number of the calling par or may
indicate that the number of the calling par is private or unavailable. Customer
provided equipment is required to utilize this featue.
Calling Number Deliver Block - Allows a Customer to make all calls with the
delivery of the callng number identification marked as "private" to all outgoing
calls placed over the specified line. Ths feature wil be offered at no charge.
Repeat Dialing - An arangement, which perits the Customer to redial
automatically the last number dialed. If the called line is busy, a 30-minute
queuing process begins. The Customer is then given an indication that the
network wil attempt to set up the call when the called line is idle.
Speed Calling - Enables a Customer to place calls to other telephone numbers by
dialing a one or two digit code rather than the complete telephone number. A
Customer may subscribe to either the 8-code capacity or 30-code capacity on their
line.
Three Way Callng - Enables a Customer to add a third pary on an existing call
without operator assistance, thereby establishig a three-way conversation. The
transmission quality may var depending on the distance and routing necessar
and may not necessarly meet normal standards.
Toll Restrction - Restrcts associated line :fom reaching dialing codes requied to
access long distance carer networks to place long distance calls.

3.3.2 Directory Listings
The Company wil arange for the listing of the customer's main biling number
in a directory of general circulation at no additional charge. At the customer's
option the Company will arange for additional listings in such directory for an
additional charge. The rates for directory listings apply only to the alphabetical
section of the directory. Listings are intended solely for the purose of
identifyng the customer's telephone number as an aid to the use of telephone
serice.
3.3.3 Directory Assistance Serce
Directory Assistace Serice is fushed upon customer request for assistance in
deterining telephone numbers. The customer may request a maximum of two
listings per call. A charge applies to each call to Directory Assistance, excet that
calls made to Directory Assistace by customers who have received Company
cerification as being unable to use a telephone directory wil be exempt :fom the
Directory Assistance charge. The customer has the option of having the call
automatically completed to the requested number.

3.3.4 Operator Assisted Serices
Operator Assisted Serice is provided to customers on a presubscribed basis.
Operator Assisted Serice is also provided to customers and users of exchange
access lines that are presubscribed to the Company's interexchange outbound
callng serices. Varous biling arangements are available with the Company's
Operator Assisted Serce including Operator Station, Collect, Biled to Third
Par, other Operator Assisted and Person-to-Person. Collect calls to coin
telephones and transfers of charges to thrd telephones which are coin telephones
wil not be accepted.
3.3.5 Busy Line Verfication and Interpt Serce
Upon request of a calling par, the Company wil attempt to verfy a busy
condition on a called line using Local Exchange Servce by Company. The
Operator wil deterine whether the line is clear or in use and report its status to
the callng par. The operator wil interpt the calIon the called line only if the
callng pary indicates an emergency and requests interption. Busy Line
Verfication and Interpt Serce is fushed where and to the extent that
facilities permit. The customer shall indemnfy and hold the Company harless
against all claims that may arse :fom either par to the interpted call or any
person. A charge wil apply when the operator verifies that the line is busy with a
call in progress, the operator verfies that the line is available for incoming calls;
or the operator verfies that the called number is busy with a call in progress and
the customer requests interption. The operator wil then interpt the call,
advising the called par of the name of the calling par. No charge wil apply
when the calling par advises that the call is to or :fom an offcial public
emergency agency.

Emergency Telephone Number Servce allows customers to reach emergency
serces including police, fie and medical services. Subject to availability,
Enhanced 911 has the ability to selectively route an emergency call to the primar

wil be provided to the primar E911 provider for display at the Public Serce
Answering Point (PSAP).

3.3.7 Blocking Featues
A callng par may block their telephone number, associated main listed name and
voiceback of calling identification information to users or subscrbers to customer callng
featues utilizing SS7 technology. Blocking wil also prevent call completion though the
use of Retu Call service.
Customers have two blocking options:
Per-Call Blocking: By activating a special code, the caller may block the transfer of the
telephone number for that call only. There is no charge for using per-call blocking and it
is provided on an unimited basis.
Line Blocking: Ths serce must be added to a customer's line by contacting the
Company's business office and having a serice order issued. All calls are automaticaly
blocked when a customer subscribes to line blocking unless the blocking featue is
deactivated.
If a customer subscribes to line blocking, he/she can deactivate blocking by dialing a
special code prior to placing a calL. Blocking wil be deactivated for that outgoing call
only.
As facilities perit, a line blocking customer wil be provided with a separate code to
deactivate blocking, which is different from the per-call blockig code. Where ths
separate code is not available, the code for per-call blocking and the code to deactivate
line blockig wil be the same.
Line blocking is available to all customers in Broadview Networks, Inc.'s servng
terrtory. Line blockig is provided without charge, except as discussed in the rate
section of this tarff.

3.4 Broadspeed Voice Tl
a. Descrption
Broadspeed Voice Tl serice provides digital trnk connections :fom an end
user's Private Branch Exchange (PBX) or other DS I-capable equipment to a
Company switching center. Broadspeed Voice Tl is a DSI (1.544 Mbps)
transmission lin providing 24 voice-grade DSO communications chanels per
facility.
Broadspeed Voice Tl offers customers the capabilities for outgoing calls only
(DOD), incoming calls only (DID), or a combination of both inbound and
outbound calls. Direct Outward Dialing perits end users behind a PBX, or DS 1-
capable system, to dial out directly without the aid of an attendant. Direct Inward
Dialing permts calls to terinate directly to a number behind a PBX or DS 1-
capable system, without the aid of an attendant. DID/DOD perits two-waytrng.
Customers are given the opportnity to subscribe to the Company's serices for 1
year, 2 year or 3 year ters. If the Customer discontinues its ter commitment
prior to the expiration of the agreed upon contract, the terination liability will be
equal to the monthly charge multiplied by the number of months remaining on the
contract. All Customer agree to meet and will be biled a minmum of$150.00 in
monthy caling volumes, including local serce, intraLA T A toll, intertate and
interational long distace calling for each Broadpee Voice Tl serce.

b. Non-Recurng Charges
Installation: A non-recurng Instalation charge is applicable for each Broadspeed
Voice Tl facility. Biling wil commence at the earlier of: 1) the date on which
installation is complete and serces are tued up; or 2) fifteen days after wrtten
notification to Customer of the Company's readiness to schedule serice tu up.
Serce Order: A non-recurrng Servce Order charge is applicable for each
Broadspeed Voice Tl facility.
Change Order: A non-recurg Change Order charge is applicable for each
Broadspeed Voice Tl facility where after initial installation, the Customer
requests changig telecommuncations servces associated with Broadspeed Voice
Tl.
Inside Wire: A non-recurng Inside Wire charge is applicable for Broadspeed
Voice Tl serce. The charge is biled on an hourly basis, with a minimum
charge of one hour. Additional Inside Wire charges are biled in hourly
increments.
c. Monthly Recurng Charges
Broadspeed Voice Tl servce is subject to monthly recurng charges on a per
facility basis. All DS 1 facilities are subject to a fixed monthy recurng charge.
DS 1 facilties that are greater than 0.1 miles and less than fifteen miles are subject
toa monthly recurng mileage charge in addition to the fixed monthly recurng
charge. No serces are provisioned beyond fifteen miles :fom a Company Tl
collocation. Subscribers wil be subject to a fixed monthly recurng mileage
component and a per mile component. DS 1 facilty mileage calculated at .5 or
less wil be rounded down. DS 1 facility mileage calculated at .6 or higher wil be
rounded up (Example - If DS 1 facility mileage equals 1.5 miles, the per mile
component of the monthy recurng mileage would equal 1 mile. IfDSl facility
mileage equals 1.6 miles, the per mile component of the monthly recurng
mileage would equal 2 miles).

d. Local Calls
Broadspeed Voice Tl provides local callng servce. Local usage is non-time-of-
day sensitive and is biled on per miute basis.
The Company concus with the local exchange and servce areas defined by the
incumbent local exchange areas.
The Flat Rate Local Plan is limited to 100,000 miutes per month of outbound
local usage allowance per Voice Tl. Local Usage exceeding the monthy
allowance wil be biled at standard Measured Plan per minute rates.
F or customers with the Flat Rate Local Plan, the local usage allowance applies
only to outbound direct dialed calls. The serice canot be used with autodialers
which are devices that allow user to dial pre-programed telephone numbers, or
used for outbound call center applications such as telemarketing or market
research. This servce is available only to business customers and is only for
voice use. The Company reseres the right to change the callng plan of
customers with inappropriate usage or who are not in compliance with the
restrctions set fort in ths tarff. Customers who exceed the Flat Rate Local Plan
allowance for three (3) consecutive months may have their rates adjusted to the
standard Measured Plan.
e. IntraLaTA Toll Calls
Broadspeed Voice Tl provides IntraLATA Toll Calling Serce which is
fuished for communcations between different local calling areas with a
LATA. A LATA is an area defined in the Modification of Final Judgment
entered by the United States Distrct Cour for the Distrct of Columbia in Civil
Action No. 82-0191. A call that terinates within the same LATA but outside
the local calling area is considered an IntraLATA Toll Serce calL. IntraLATA
Toll usage is non-time-of-day sensitive and is biled on a per minute basis.

a. Descrption
Broadspeed PRI is a local exchange access service that provides direct digita
connections via 1.544 facitlty between customers with ISDN-PRI compatible
Customer Premises Equipment (CPE) and ISDN-PRI equipped switches.
Broadspeed Primar Rate Intedace (PRI) provides local exchange access loop
serces such as Direct Inward Dialing (DID), Direct Outward Dialing (DOD),
and business dial tone lines. It can also be used as loop transport for circuit data
applications. Broadspeed PRI is provisioned on the 1.544 megabits per second
(Mbps) bandwidth and uses ISDN architectue of 23 B or bearer chanels and 1 D
or data chanel, or 24 B chanels to provide the customer with the capabilties of
a simultaneous access, transmission, and switchig of voice, data and video
applications via chanelized transport.
Customers are given the opportty to subscrbe to the Company's serces for 1
year, 2 year or 3 year ters. If the Customer discontinues its ter commitment
prior to the expiration of the agreed upon contract, the termination liability wil be
equal to the monthly charge multiplied by the number of months remaining on the
contract. All Customer agree to meet and wil be biled a mium of $150.00 in
monthy calling volumes, including local serce, intraLATA toll, intertate and

b. Featues
Broadspeed PRI offers the following featue fuctionalities:
Calling Par Number (CPN) - CPN allows the user to have access to the
directory number of the calling par.
Call-by-Call (CBC) - CBC allows B chanels to be configued to access
multiple serices such as data, voice and video applications on a per call
basis and eliminates the need for separate facilities for individual serices.
Multiple Facilty Signaling Control - MFSC allows the D chael of one
PRI arangement to provide signaling for up to 20 (T) PRIs. A back up D
chanel is required for this arangement.
Calling Line Identifcation - Delivers the callng par's telephone
number, if available, to the Broadspeed PRI subscrber. The number wil
be delivered if the call originates either in the same switch as the
subscrber or is connected to the switch by SS7. This featue is available
per port.
Backup D Chanel - provides a backup D chanel as a standby spare in
the event that the priar D chanel fails. Multiple Facility Signaling
Control is required for this featue. Backup D chanel is available in the
DMS switches; and must be NI-2 compatible.
Caller ID With Name - This featue provides the originating telephone
number and also the name associated with the line. The information is
displayed on a Customer provided display device attached to the
Customer's telephone line.

3.6 Broadspeed Integrated Tl
a. Descrption
Broadspeed Integrated Tl serce provides a high capacity DS 1 (1.544 Mbps)
transmission link from an end user's premises to the Company's switching center.
Broadspeed Integrated Tl serice allows customers to integrate voice and data on
the same circuit or facilty. The minimum configuation of an Integrated Tl is one
of the three following configurations: 1) 10 lines of voice serce and 256k
Internet access port; 2) 8 lines of voice servce and 384k Interet access port; or
3) 6 lines of voice service and 5l2k Internet access port. At no time is the
configuation pertted to be below one of these minimum configuations.
Broadspeed Integrated Tl offers customers the capabilties for local, intraLATA
toll, long distance, 411, 911, dial around and toll-:fee calls. Customers must
select the Company as their carrer for local, intraLAT A toll and long distance
callng. Broadspeed Integrated TI also offers customers the capabilties for
incoming calls only (DID). Direct Inward Dialing permits calls to terinate
directly to a number behid a PBX or DS I-capable system, without the aid of an
attendant.
Customers are initially given the opportty to subscrbe to the Company's
serces for 2 year or 3 year term commitments, with a 2 year term being the
minimum contractul obligation. At the expiration of the ter contracts,
Customers are given the opportty to subscribe to the Company's services on a
month-to-month basis. All measured-rate Customers agree to meet and will be
biled a minum of $50.00 in monthy caling volumes, including local serce,
intraLA TA toll, interstate and interational long distance calling over the
Company's Tllines.

Customers are also given the opportty to select :fom two mutually exclusive
price plans. A measured-rate price plan has a monthly fee for each voice line and
usage charges for local, intraLA TA toll, and domestic and interational Long
Distance based on a cost per minute. Calls are metered and charges are
determined by the duration of the call times the cost per minute. A flat-rate
pricing plan gives the Customer the option to select unlimited local and
intraLA T A toll calls for one fixed price per line and metered domestic and
interational Long Distace based on a cost per minute. All voice lines
provisioned on an Integrated Tl must be assigned identical calling plans. Mixig
measured-rate and flat-rate calling plans on an Integrated Tl service is not
permitted.

If the Customer discontinues its ter commitment prior to the expiration of the
agreed.upon contract or requires their configuation of voice and data lines to fall
below the minimum thresholds, the terination liability wil be equal to $400
multiplied by the number of months remaining on the contract.
b. Non-Recurng Charges
Installation: A non-recurrng Installation charge is applicable for each Broadspeed
Integrated TI facility. Biling wil commence at the earlier of: 1) the date on
which installation is complete and serces are tued up; or 2) fifteen days after
wrtten notification to Customer of the Company's readiness to schedule serce
tu up.
Serice Order: A non-recurng Serice Order charge is applicable for each
Broadspeed Integrated Tl facility.
Change Order: A non-recurg Change Order charge is applicable for each
Broadspeed Integrated Tl facility where after initial installation, the Customer
requests changing telecommuncations serces associated with Broadspeed
Integrated T I .
Inside Wire: A non-recurrng Inside Wire charge is applicable for Broadspeed
Integrated Tl service. The charge is biled on an hourly basis, with a minium
charge of one hour. Additional Inside Wire charges are biled in hourly
increments.

c. Monthy Recurng Charges
DS1 Facility: A monthly recurng fee applies for each DS1 facility provisioned.
In addition to the DS 1 facilty fee, a mileage fee is added to those circuits that are
greater than o. I miles and less than fifteen miles :fom a Company Integrated Tl
serce collocation. No servces are provisioned beyond fifteen miles from a
CompanyTl èollocation. Broadspeed Integrated T1 subscrbers wil be subject to
a fixed monthy recurng mileage component and a per mile component. DS 1
facility mileage calculated at .5 or less will be rounded down. DS 1 facility
mileage calculated at .6 or higher wil be rounded up (Example - If DS 1 facility
mileage equals 1.5 miles, the per mile component of the monthy recurng
mileage would equal 1 mile. If DS 1 facility mileage equals 1.6 miles, the per
mile component of the monthly recurrng mileage would equal 2 miles).
Interet Access Port: Customers must select one of five (5) discrete bandwidth
choices for Interet access.
Caller ID With Name: This featue provides the originating telephone number
and also the name associated with the line. The information is displayed on a
Customer provided display device attched to the Customer's telephone line.
Caller ID With Name is only available to subscribers with two or thee year
commitments.

Voice Lines: Customers may opt for analog voice lines and/or digital or PRI
trs. Fees are per working voice chaneL. Customers may select all lines
assigned to the measured rate callng plan or all lines assigned to the flat-rate
calling plan. Calling plan assignents canot be mixed on the same Integrated
T1 serce.
Customers that select the flat-rate callng plan with unlimted local and
intraLATA calling are fuher subject to these conditions: Line rate includes all
local and intraLATA outbound direct dialed calls. Unlimited usage applies to
outbound direct dialed calls only. Serice canot be used with autodialer, call
center or certain automated switching equipment. Available for voice use only.
The Company reseres the right to change the callng plan of customers with
inappropriate usage or who are not in compliance with the restrctions set forth in
this tarff
A PRI tr type is also available for purchase. When a customer selects any
number oflines as PRI tru tye, the following conditions apply:
One DSO chanel on the DS 1 facility is reserved as the data chanel or
"D-chanel" of the PRI arangement. for purposes of providing
signaling for up to 19 other DSO's provisioned as bearer chanels or B-
chanels on that same facility.
The Customer is not charged for the D-chanel, nor does the D-
chanel count toward the minimum configuation requiements
defied earlier in ths section.
Each B-chanel is levied monthly recurg line charges described as
"PRI Trunk" in ths section.
PRI Tru tyes may not be provisioned with Tl Digital Tru tyes
(T1 Chanel Assigned Signaling) on the same DS1 facility.
Each PRI Tru includes Call ID (Number Only) at no additional
charge. Customer's PBX must support NI-1 protocol. The PRI Tru
tye supports NI-1 or 5ESS simulation only. It wil not support NI-2
protocol.

e. IntraLATA Toll Calls
Broadspeed Integrated T1 provides intraLATA toll calling servce which is
fushed for communcations between different local calling areas within a
LATA. A LATA is an area defined in the Modification of Final Judgment
entered by the United States Distrct Cour for the Kentucky in Civil Action No.
82-0191. A call that terminates withn the same LATA but outside the local
callng area is considered an intraLATA toll calL. IntraLATA toll usage is non-
time-of-day sensitive and is biled on a per minute basis.
The Company concurs with the standard intraLATA boundares defined by the
incumbent local exchange company.
f. Long Distance Calls
Broadspeed Integrated T 1 provides intrastate and interstate long distance callng
serice. Long distance usage is non-time-of-day sensitive. Long distance usage is
biled in intial thirdy (30) second increments with six (6) second increments
biled thereafter.

3.7 Public Telephone Surcharge
In order to recover the Company's expenses to comply with the FCC's pay telephone
compensation plan effective on October 7, 1997 (FCC 97-371), an undiscountable per
call charge is applicable to all intrastate calls that originate :fom any pay telephone used
to access Company provided services. Ths surcharge, which is in addition to standard
tarffed usage charges and any applicable service charges and surcharges associated with
serce, applies for the use of the instrent used to access Company provided serice
and is unrelated to the service accessed :fom the pay telephone.
Pay telephones include coin-operated and coinless phones owned by local telephone
companies, independent companes and interexchange carers. The Public Pay
Telephone Surcharge applies to the initial completed call and any re-originated call (e.g.,
using the "#" symbol). The Public Pay Telephone Surcharge does not apply to calls
placed :fom pay telephones at which the Customer pays for serice by inserting coins
durng the progress of the calL.
Whenever possible, the Public Pay Telephone Surcharge wil appear on the same invoice
containing the usage charges for the surcharged calL. In cases where proper pay
telephone coding digits are not transmitted to the Company prior to completion of a call,
the Public Pay Telephone Surcharge may be biled on a subsequent invoice after the
Company has obtained information :fom a carer that the originating station is an
eligible pay telephone.

automated switching equipment. Ths servce is available only to business customers and
for voice use only. Broadview Networks reserves the right to chage the calling plan of
customers with inappropriate usage or who are not in compliance with the restrctions set
