FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE RESOLD AND FACILITIES-BASED LOCAL EXCHANGE TELECOMMUNICATIONS SERVICES. CASE NO. BUY-05- On February 16 , 2005 , DCN, Inc. ("DCN" or the "Company ) filed an Application for a Certificate of Public Convenience and Necessity to provide resold and facilities-based local exchange services in Idaho exchanges currently served by Qwest or Verizon. On March 14 2005 , the Commission solicited comments regarding DCN's Application. See Order No. 29729. No comments were received other than those submitted by Commission Staff. THE APPLI CA TI 0 N Currently, DCN is authorized to provide switched and dedicated resold interexchange telecommunications services in Idaho. By this Application, UCN seeks additional authority to allow the Company to offer existing and prospective customers resold and/or facilities-based (leased) competitive local exchange telecommunications services. The local exchange services UCN proposes to offer include business class local loop connectivity and transmission, including 2-wire, 4-wire, DS-, DS-, DS-3 and OCn local loops necessary to connect customers to DCN' nearest point of presence. UCN is a publicly-traded corporation organized under the laws of the State of Delaware and its principal place of business is in Bluffdale, Utah. In June 2004, UCN changed its name from Buyers United, Inc., d/b/a buyersonline, d/b/a United Carrier Networks to UCN Inc. UCN is registered as a foreign corporation in good standing with the Idaho Secretary of State and maintains a registered in-state agent for service in Idaho. DECISION MEMORANDUM STAFF COMMENTS In its evaluation of UCN's Application, Staff determined the Company s filing complies with the requirements of the Commission. See Procedural Order No. 26665; IDAPA 31.01.01.111. Staff believes that the Company understands and agrees to comply with Commission rules and requirements. Staff further believes that the Company possesses the requisite financial, managerial, and technical qualifications necessary to operate as a provider of telecommunications services. Therefore, based on its review of the Application, Commission Staff recommends approval of the Application for a Certificate.
