SECTION 1.0 - DEFIITIONS
For the purose of th ta, the followig defitions wi apply:
Access Line - An arrangement which connects the Customer's location to a caret s switchig center or
point of presence.
Account Codes - Optiona, Customer-defied digits that alow the Customer to identi the individual usr,
deparent or client associated with a cal. Account Codes appear on the Customer bil.
Advance Payment - Part or al of a payment requied before the sta of servce.
Authorized User - A person, fi, corporation, or any other entity authorid by the Customer to
communcate utig the Company's service.
Business - A clas of servce provided to individuals engaged in business, fi, parerships, corporations,
agencies, shops, works, tenants of offce buidigs, and individual practicig a profession or operatig a
business who have no offces other than their residences and where the use of the service is priary or
substatiy of a business, professiona or occupational natue.
Commssion - Idaho Public Utities Commsion.
Company or Caer - Broadvox-CEC, LLC, uness otherwe clearly indicated by the context.
Customer - The person, fi, corporation or other entity which orders, cancels, amends or us service and is
responsible for payment of charges and complice with the Company's ta.
Deposit - Refers to a cash or equivalent of cash secty held as a guarante for payment of the charges.

SECTION 1.0 - DEFINITIONS (CONTINUED)
DID Tru - A form of local switched access that provides the abilty for an outside par to cal an internal
extension diecy without the intervention of the Company operator.
Dial Puse (or "DP") - The pule ty employed by rota dial station sets.
Dual Tone Multi-Frequency (or "DTMF") - The pule tye employed by tone dial station sets.
End User - Any person, fi, corporation, partnership or other entity which us the servces of the
Company under the proviions and reguations of th ta. The End User is responsible for payment
uness the charges for the servces utied are accepted and paid for by another Customer.
End Ofice - With respect to each NP A-NX code prefi assigned to the Company, the location of the
Company's "end offce" for purposes of th ta shal be the point of interconnection associted with that
NP A-NX code in the Local Exchange Routig Guide ("LERG"), issued by Bellcore.
Hearng Impaied - Those persons with communcation impaients, includig those hearg impaied,
deaf, deaf/blid, and spee impaied persons who have an impairent that prevents them from
communcatig over the telephone without the aid of a telecommuncations device for the deaf.
Huntig - Route a cal to an idle station lie in a prearanged group when the called station lie is busy.
In-Only - A service attibute that restrcts outward dial access and routes incomig cal to a designted
anwer point.
IXC or Interexchange Carer - A long ditace telecommuncations servces provider.

LATA - A Local Access and Tranport Area establihed pursuant to the Modication of Fin Judgement
entered by the United States Distrct Court for the Distrct of Columbia in Civil Action No. 82-0192; or any
other geographic area designated as a LATA in the Nationa Exchange Carer Association, Inc. Tar F.c.c.

LEC - Local Exchange Company
Mimum Point of Presence ("MPOP") - The mai telephone closet in the Customer's buidig.
Monthly Recng Charges - The monthy charges to the Customer for servces, facities and equipment,
which contiue for the agreed upon duration of the servce.
Multi-Frequency or ("MF") - An inter-machie pul ty used for signalg between telephone switces, or
between telephone switches and PBX/key systems.
Non-Recurg Charge ("NRC") - The inti charge, usualy assessed on a one-tie basis, to intite and
establih servce.
Other Telephone Company - An Exchange Telephone Company, other than the Company.
PBX - Private Branch Exchange
Premises - A buidig or buidigs on contiguous property.
Recurng Charges - The monthy charges to the Customer for servces, facilties and equipment which
contiue for the agreed upon duration of the servce.
Residence or Residential- A class of service fuhed to a Customer at a place of dwellg where the actual
or obvious use is for domestic puroses.

Servce Commencement Date - The fist day followig the date on which the Company noties the
Customer that the requested servce is avaiable for use, uness extended by the Customer's refual to accept
servce which doe not conform to stadards set fort in the Service Order and th ta, in which case the
Servce Commencement Date is the date of the Customer's acceptace. The Company and Customer may
mutualy agree on a substitute Servce Commencement Date.
Servce Order - The writtn request for servces exected by the Customer and the Company in the formt
devisd by the Company. The signg of an Order by the Customer and acceptace by the Company
intiates the respective obligations of the pares as set forth therein and pursuant to th ta, but the
duration of the service is calculated from the Service Commencement Date.
Telecommuncations Company or Provider - Used thoughout th ta to mean Broadvox-CLEC, LLC
uness clearly indicated otherwe by the text.
TBD - To Be Determed.
Two Way - A service attbute that includes outward di capabilties for outbound cal and can alo be
used to car inbound cal to a central point for futher processing.
Usage Based Charges - Charges for miutes or messages traversing over local exchange facilties.
User or End User - A Customer, Joint User, or any other person authorid by a Customer to us servce
provider under th ta.

SECTON 2.0 - RULES AND REGULATIONS
2.1 Undertakng of the Company
2.1.1 Scope
The Company undertes to fuh communcations servce pursuant to the term of th
tarif in connection with one-way and/or two-way inormation tranmision origitig
from points with the State of Idaho, and termtig with a local calg area as defied
herein.
The Company is responsible under th ta only for the servces and facilties provided
hereunder, and it assumes no responsibilty for any servce provided by any other entity
that purchases access to the Company network in order to origite or termate its own
servces, or to communcate with its own Customers.
2.1.2 Shortage of Equipment or Facilties
(A) The Company resrves the right to lit or to alocate the us of existig facilties,
or of additional facities offered by the Company, when necessar beause of lack
of facilties, or due to some other caus beyond the Company's control.
(B) The fuhig of servce under th ta is subject to the avaiabilty on a
contiuing basis of all the necessar facilties and is lited to the capacity of the
Company's facilties as well as facities the Company may obta from other
carers to fuh servce from tie to tie as requied at the sole dicretion of the
Company.

2.1 Undertakng of the Company, (Contd.)
2.1.3 Term and Conditions
(A) Servce is provided on the basis of a mium period of at least one month, 24
hours per day. For the purose of computig charges in th ta, a month is
considered to have th (30) days.
(B) Customers may be requied to enter into wrttn service orders which shal conta
or reference a specifc description of the servce ordered, the rates to be charged, the.
duration of the services, and the term and conditions in th tarif. Customers wi
alo be requied to execte any other docuents as may be reasonably requested
by the Company.
(C) Except as otherwe stated in the ta, at the expiration of the inti term specifed
in each Service Order, or in any extension thereof, servce shall contiue on a month
to month basis at the then cuent rate uness termted by either par upon
proper notice. Any termtion shal not relieve the Customer of its obligation to
pay any charges incued under the servce order and th ta prior to
termation. The rights and obligations which by their natue extend beyond the
termtion of the term of the servce order shal surive such termation.
(D) Servce may be termated upon wrttn notice to the Customer if:
(1) the Customer is using the service in violation of th ta; or
(2) the Customer is using the service in violation of the law.
(E) Th ta shal be interpreted and governed by the laws of the State of Idaho
without regard for its choice of laws proviion.

(F) Any Oter Telephone Company may not interfere with the right of any person or
entity to obta servce diecy from the Company. No person or entity shal be
requied to make any payment, incu any penalty, moneta or otherwe, or
purchase any services in order to have the right to obta servce diectly from the
Company.
(G) Reserved for future use.
(H) The Company hereby reserves its rights to establih service packages speifc to aparticu Customer. These contract mayor may not be associated with volume
and/ or term discounts.

21 Undertakg of the Company, (Contd.)
21.4 Limitations on Liabilty
(A) The liabilty of the Company for damages arising out of the furnhig of its
Service, including but not liited to mitakes, omisions, interruption, delay, or
errors, or other defects, representations, or use of these servces or damages
arising out of the faiure to furnh the service, whether caused by acts or
omission, shall be lited to the extension of allowances for interruption as set
forth in 2.7. The extension of such allowances for interruption shall be the sole
remedy of the Customer and the sole liabilty of the Company. The Company
wi not be liable for any direct, indirect, incidental, special, consequential, lost
profits, exemplary or punitive damages to Customer as a result of any Company
service, equipment or facilties, or the acts or omissions or negligence of the
Company's employees or agents.
(B) The Company's liabilty for wil miconduct, if establihed as a result of
judicial or admitrative proceedings, is not lited by th taiff. The
Company's liabilty, if any, with regard to delayed intallation of Company
facilties or commencement of service, shal not exceed $1,000. With respect to
any other claim or suit, by a Customer or by any others, for damage associated
with the ordering (including the reservation of any specifc number for use with a
service), intallation (including delays thereof), provision, termiation,
maintenance, repai, interruption of restoration of any service or facilties offered
under th tarif, and subject to the proviions of Section 2.7, the Company's
liabilty, if any, shall be lited as provided herein.
(C) The Company shall not be liable for any delay or failure of performance or
equipment due to causes beyond its control, including but not lited to: acts of
God, fie, flood, explosion or other catatrophes; and law, order, reguation,
direction, action or request of the United States governent or of any other
governent, including state and local governents having or claig
jurisdiction over the Company, or of any department, agency, commsion,
bureau, corporation or other intrmentality of anyone or more of these federal,
state, or local governents, or of any mita authority; preemption of existig
service in compliance with national emergencies; inurrections; riots; wars;
unavaiabilty of rights-of-way or materia, or strikes, lockouts, work stoppages,
or other labor difcuties.

2.1.4 Limtations on Liabilty (Contd.)
(D) The Company shall not be lible for (a) any act or omision of any entity
furnhig the Company or the Company's Customers facilties or equipment
used for or with the services the Company offers; or (b) for the acts or omisions
of common carriers or warehousemen. Except in 31.41.01 Rule 501, 502, and 503
oftheIDAPA.
(E) The Company shal not be liable for any damages or losses due to the fault ofnegligence of the Customer or due to the failure or malfction of Customer-
provided equipment or facilties.
(F) The Customer shall indemn and hold the Company harmless from any and al
loss, claim, demands, suits, or other action, or any liabilty whatsoever, whether
sufered, made, intituted, or asserted by any other part or person(s), and for
any loss, damage, or destrction of any propert whether owned by the
Customer or others, caused or claimed to have been caused directly or indirectly
by the intallation, operation; failure to operate, maitenance, removal, condition,
location, or use of intallation provided by the Company. The Company reserves
the right to require each Customer to sign an agreement acknowledgig
acceptace of the provisions of th section as a condition precedent to such
intaations.
(G) The Company shall not be liable for any defacement of or damage to Customer
premises resultig from the furnhing of services or equipment on such premies
or the intallation or removal thereof, uness such defacement or damage is
caused by gross negligence or wil miconduct of the Company's agents or
employees. No agents or employees of other parcipatig carriers shall be
deemed to be agents or employees of the Company.
(H) Notwthtading the Customer's obligations, the Company shall be indemned,
defended, and held harmless by the Customer or by others authorid by it to
use the service againt any claim, loss of damage ariing from Customer's use of
services furnihed under th tariff, including: clai for libel, slander, invasion
of privacy or iningement of copyright arising from the material, data,
inormation, or other content tranmitted via the Company's service; and patent
iningement clai arising from combing or connectig the servce offered by
the Company with apparatus and systems of the Customer or others. All other
claim arising out of any act or omision of the Customer or others, in connection
with any service provided by the Company pursuant to this taiff.

21.4 Limitations on Liabilty (Contd.)
(I) The entie liabilty of the Company for any cla, loss, damage or expense from
any cause whatsoever shall in no event exceed sums actualy paid to the
Company by Customer for the specifc services giving rise to the claim, and no
such action or precedig againt the Company shall be commenced more than
one year afer the service is rendered.
m The Company makes no warranties or representations, express or implied,
including warranties of merchantabilty or fitness for a particular use, except
those expressly set forth herein.
(K) The Company shal not be liable for any act or omission of any other company or
companes furnhig a portion of the service, or for damages associated with
service, channels, or equipment which it does not furnh, or for damages which
result from the operation of Customer-provided systems, equipment, facilties or
services which are interconnected with Company services. Except in 31.41.01
Rule 501, 502, and 503 of the IDAP A.
(L) The Company does not guarantee nor make any warranty with respect to service
intallations at locations at which there is present an atmosphere that is
explosive, prone to fie, dangerous or otherwise unuitable for such intallations.
The Customer shall indemn and hold the Company harmless from any and al
loss, claim, demands, suits or other action, or any liabilty whatsoever, whether
sufered, made, intituted or asserted by the Customer or by any other party, for
any personal injury to, or death of, any person or persons, or for any loss,
damage or destrction of any property, whether owned by the Customer or
others, caused or claimed to have been caused, directly or indirectly, by the
intallation, operation, failure to operate, maintenance, removal, presence,
condition, locations or use of service furnhed by the Company at such locations.

(M) With respect to Emergency Number 911 Service:
(a) Th service is offered solely as an aid in handig assistance call in
connection with fie, police and other emergencies. The Company is not
responsible for any losses, claim, demands, suits or any liabilty whatsoever,
whether sufered, made, intituted or asserted by the Customer or by any
other party or person for any personal injury to or death of any person or
persons, and for any loss, damage or destruction of any property, whether
owned by the Customer or others, caused or claimed to have ben caused by:
(1) mitakes, omisions, interrptians, delays, errors or other defects in theprovision of th service, or (2) intallation, operation, failure to operate,
maintenance, removal, presence, condition, location or use of any equipment
and facilties furnhig th service.
(b) The Company is not responsible for any iningement or invasion of the right
of privacy of any person or persons, caused or claimed to have been caused,
directly or indirectly, by the intallation, operation, failure to operate,
maintenance, removal, presence, condition, occasion or use of emergency 911
service features and the equipment associated therewith, or by any services
fuhed by the Company including, but not lited to, the identication of
the telephone number, address or name associated with the telephone used
by the party or parties accessing emergency 911 service, and which arie out
of the negligence or other wrongfl act of the Company, the Customer, its
users, agencies or municipalities, or the employees or agents of anyone of
them.
(N) The Company's liabilty arising from errors or omisions in Directory Listigs,
other than charged litig, shall be lited to the amount of actual impairment of
the Customer's service and in no event shall exceed one-half the amount of the
fied monthy charges applicable to exchange servce affected durig the period
covered by the directory in which the error or omision occurs. In cases of
charged Directory Listigs, the liabilty of the Company shall be lited to an
amount not exceeding the amount of charges for the charged litigs involved
during the period covered by the directory in which the error or omision occurs.

(0) When a Customer with a non-publihed telephone number, as defied herein,
places a call to the Emergency 911 Service, the Company wi release the name
and address of the callg party, where such inormation can be determied, to
the appropriate local governenta authority responsible for the Emergency 911
Service, upon request of such governental authority. By subscribing to service
under th taif Customer acknowledges and agrees with the release of
inormation as described above.
(P) The included tariff language does not constitute a determiation by the
Commsion that a litation of liabilty imposed by the Company should be
upheld in a court of law. Acceptace for filg by the Commsion recognes
that it is a court s responsibilty to adjudicate negligence and consequential
damage claim. It is also the court s responsibilty to determie the validity of
the exculpatory clause.
2.1.5 Notiication of Servce-Afectng Actvities
The Company wi provide the Customer reasonable notication of servce-afectig
activities that may occu in normal operation of its business. Such activities may include,
but are not lited to, equipment or facities additions, removal or rearangements and
routie preventative maitenance. Generaly, such activities are not specifc to an
individual Customer but afect may Customers' servces. No specc advance notication
period is applicable to al service activities. The Company wi work cooperatively with the
Customer to determie the reasonable notication requiements. With some emergency or
unplaed service-afecg conditions, such as an outage resultig from cable damage,
notication to the Customer may not be possible.

2.1.6 Provision of Equipment and Facilties
(A) The Company shal use reasonable efort to maita only the facilties and
equipment that it fuhes to the Customer. The Customer may not nor may theCustomer permt others to rearange, diconnect, remove, attmpt to repai, or
otherwe interfere with any of the facilties or equipment intaed by the
Company, except upon the wrtt consent of the Company.
(B) The Company may substitute, change or rearange any equipment or facilty at any
tie and from tie to tie, but shal not thereby alter the tehncal parameters of
the service provided by the Customer.
(q Equipment the Company provides or inta at the Customer Premies for use in
connecon with the services the Company offers shal not be used for any purpose
other than that for which the equipment is provided.
(D) Except as otherwe indicated, Customer provided station equipment at theCustomer's premi for use in connection with the servce shal be so constrcted,
maitained and operated as to work satifactorily with the facilties of the
Company.
(E) The Company shal not be responsible for the intation, operation, or
maitenace of any Customer provided communcations equipment. Where such
equipment is connected to the facilties furnhed pursuant to th ta, the
responsibilty of the Company shal be lited to the fuhig of facilties offered
under th ta and to the maitenace and operation of such facilties. Subject to
th responsibilty, the Company shal not be responsible for:
(1) the though tranmision of signls by Customer provided equipment or
for the qualty of, or defec in, such tranmision; or
(2) the reception of sign by Customer-provided equipment; or
(3) network control signg where such signg is performed by Customer-
provided network control signg equipment.

21.7 Non-Routine Installation
At the Customer's request, intation and/or maitece may be performed outside the
Company's reguar business hours or in hazdous locations. In such cases, charges based
on cost of the actual labor, material, or other costs incued by or charged to the Company
wi apply. If intaation is stated durg regu business hours but, at the Customer's
request, extends beyond reguar business hours into tie periods includig, but not lited
to, weekends, holidays, and/ or night hours, additiona charges may apply.
2.1.8 Special Constrcton
Subject to the agreement of the Company and to al of the regutions contaed in th
ta, specal constrction or facilties may be underten on a reasonable efforts basis at the
request of the Customer. Specia constrction is constrction undertaen:
(A) where facities are not presently avaible, and there is no other requiement for the
facilties so constrcted;
(B) of a tye other than that which the Company would normaly uti in thefuhig of its services;
(q over a route other than that which the Company would normaly uti in thefuhig of its servces;
(D) in a quantity greater than that which the company.would normaly constrct;
(E) on an expedited basis;
(F) on a temporary basis unti permanent facilties are availble;
(G) involvig abnormal costs; or
(H) in advance of its normal constrction.

2.1.9 Owership of Facilities

parers, agents, contractors or suppliers.
2.2 Prohibited Uses
2.2.1 The servces the Company offers shal not be usd for any unawfu purose or for any us
as to which the Customer has not obtaed al requied governenta approval,
authoriations, licenses, consnts and permts.
2.2.2 The Company may requie applicants for servce who inted to use the Company's
offerings for resae and/ or for shared us to fie a lettr with the Company confg that
their use of the Company's offerigs complies with relevant laws and the Idaho
Commsion's regutions, policies, orders, and decisions.
2.2.3 The Company may block any signal being tranmitted over its Network by Customers
which cause interference to the Company or other usrs. Customer shal be relieved of al
obligations to make payments for charges relatig to any blocked Servce and shal
indemn the Company for any clai, judgment or libilty resultig from such blockage.
2.2.4 A Customer, joint usr, or authorid user may not assign, or tranfer in any maner, the
service or any rights associated with the servce without the wrtten consent of the
Company. The Company wi permt a Customer to tranfer its existig service to another
entity if the existig Customer has paid al charges owed to the Company for reguated
communcations services. Such a tranfer wi be treated as a disconnection of exitig
servce and intaation of new service, and non-recring intation charges as stated in
th ta wi apply.

2.3 Obligations of the Customer
2.3.1 General
The Customer shal be responsible for:
(A) the payment of al applicable charges pursuant to th ta;

omisions of the Customer; or the noncompliance by the Customer, with these
regulations; or by fie or theft or other casualty on the Customer Premis, uness
caused by the negligence or wi mionduct of the employee or agents of the
Company;
(q providig at no charge, as speced from tie to tie by the Company, any needed
equipment, space and power to operate Company facilties and equipmentintaed on the premi of the Customer, and the level of heatig and ai
conditionig necessar to maita the proper operatig environment on such
premies;
(D) obtag, maitaing, and otherwe having fu responsibilty for al rightsf-
way and conduit necessar for intaation of fiber optic cable and associated
equipment usd to provide Communcations Servces to the Customer from the
cable buildig entrance or propert lie to the location of the equipment space
described in Setion 2.3.1(C). Any and al costs associated with the obtag and
matag the rights-of-way desribed herein, includig the costs of alterig the
strctue to permt intation of the Company provided facilties, shal be borne
entiely by, or may be charged by the Company, to the Customer. The Company
may requie the Customer to demonstrate its complice with th section prior to
acceptig an order for service.

regardig the workig conditions on the premies at which Company employee

equipment. The Customer may be requied to inta and maita Companyfacilties and equipment with a hazardous area if, in the Company's opinon,
injur or damage to the Company employee or propert might result from
intation or matenace by the Company. The Customer shal be responsible
for identig, monitoring, removig and diposing of any hazdous materi
(e.g., friable asbetos) prior to any constrction or intalltion work;
(F) complyig with al laws and regutions applicable to, and obtag all consents,
approval, licens and permts as may be requied with respec to, the location of
Company facilties and equipment in an Customer premies or the rightsf-way
for which Customer is responsible under Setion 2.3.1(0); and grantig or obtag
permision for Company agents or employee to enter the premies of the
Customer at any tie for the purose of intag, inpectig, maitag,
repaiing, or upon termtion of servce as stated herein, removing the facilties or
equipment of the Company;
(G) not creatig or alowig to be placed any liens or other encubrances on the
Company's equipment or facilties; and
(H) makg Company facilties and equipment avaiable periodicaly for maitenance .purposes at a tie agreeable to both the Company and the Customer. No
alowance wi be made for the period durg which service is interrpted for such
puroses.

omisions of the Customer, its offcers, employees, agents, invites, or contractors
where such acts or omisions are not the diect result of the Company's negligence
or intentional miconduct.
(B) To the extent caused by any negligent or intentiona act of the Customer asdescribed in (A), precedig, the Customer shal indemn, defend and hold
harmless the Company from and agait al clai, actions, damages, liabilties,
costs and expen, including reasonable attrneys' fee, for (1) any loss,
destrction or damage to property of any thd party, and (2) any libilty incued
by the Company to any thd par pursuant to th or any other ta of the
Company, or otherw, for any interrption of, interference to, or other defect in
any service provided by the Company to such thd par.
(q The Customer shal not assert any cla agait any other Customer or user of the
Company's servces for damages resultig in whole or in party from or aring in
connection with the furnhig of servce under th ta includig but not lited
to mitaes, omisions, interrptions, delays, errors or other defects or
mirepresentations, whether or not such other Customer or user contrbuted in any
way to the occurence of the damages, uness such damages were causd solely by
the negligent to intentiona act or omision of the other Customer or user and not
by any act or omision of the Company. Nothg in th ta is intended either to
lit or to expand Customer's right to assert any clai agait thd pares for
damages of any natue other than those desbed in the preceding sentence.

2.4 Customer Equipment and Chanels
2.4.1 General
A user may tranmit or receive inormation or sign via the facities of the Company. The
Company's servces are designated priary for the tranmision of voice-grade telephonic
signls, except as otherwe stated in th ta. A usr may tranmit any form of signl that
is compatible with the Company's equipment, but the Company does not guarante that its
services wi be suitable for puroses other than voice-grade telephonic communcation
except as specifcaly stated in th ta.
2.4.2 Station Equipment
(A) Termial equipment of the user's premies and the electrc power consumed bysuch equipment shall be provided by and maitaed at the expense of the user.
The user is responsible for the proviion of wiing or cable to connect its termi
equipment to the Company MPOP.
(B) The Customer is responsible for ensuring that Customer-provided equipment
connected to Company equipment and facities is compatible with such equipment
and facilties. The magntude and character of the voltages and cuents impressed
on Company-provided equipment and wig by connecon, operation, or
maitenace of such equipment and wig shal be such as not to cause damge to
the Company-provided equipment and wig or injur to the Company's
employee or to other persons. Any additiona protetive equipment requied to
prevent such damage or injur shal be provided by the Company at the
Customer's expense, subject to prior Customer approval of the equipment expense.

2.4.3 Interconnection of Facilties
(A) Local Trafc Exchange provides the abilty for another local exchange provider to termte
local trafc on the Company's network. In order to quali for Local Trafc Exchange the
cal must (a) be origiated by an end usr of a company that is authorid by the
Commsion to provide local exchange servce; (b) origite and termte with a local
calg area of the Company.
(B) Any specia interface equipment necessary to achieve compatibilty between the facilties
and equipment of the Company usd for fuhig Communcations Servces and the
chanels, facilties, or equipment of others shal be provided at the Customer's expense.
(q Communcations Servces may be connected to the services or facilties of other
communcations carriers only when authoried by, and in accordance with, the term and
conditions of the tas of the other communcations carers which are applicable to such
connecons.
(D) Facilties furnhed under th tarif may be connected to Customer provided term
equipment in accordance with the provisions of th ta. Al such termal equipment
shal be regitered by the Federal Communcations Commsion pursuant to Par 68 of Title
47, Code of Federal Regutions; and al user-provided wiing sha be intaed and
maitaed in complice with those reguations.

2.4.4 Inspections
(A) Upon suitable notication to the Customer, and at a reasonable tie, the Company
. may make such tets and inpecons as may be necessar to determie that the
Customer is complyig with the requirements set forth in Seon 2.4.2(B) for the
intaation, operation, and maintenace of Customer-provided facilties,
equipment, and wiing in the connection of Customer-provided facities and
equipment to Company-owned facities and equipment.
(B) If the protetive requiements for Customer-provided equipment are not being
complied with, the Company may tae such action as it deems necessar to protet
its facilties, equipment, and personneL. The Company wi noti the Customer
promptly if there is any need for fuer corrective acton. With te days of
receiving th notice, the Customer must tae th corrective action and noti the
Company of the acton taen. If the Customer fai to do th, the Company may
take whatever additional action is deemed necessar, includig the suspension of
service, to protet its facities, equipment and personnel from har.
(C) If harm to the Company's network, personnel or services is iment, the
Company reserves the right to shut down Customer's servce imeditely, with no
prior notice requied.

2.6 Payment Arangements
2.6.1 Payment for Servces
The Customer is responsible for the payment of al charges for facilties and servces
fuhed by the Company to the Customer.
The Customer is responsible for the payment of federal excise taes, state and local sales
and use taes and simr taes imposed by governenta juisdictons, al of which shal be
separately designated on the Company's invoices. Any taes imposed by a local judicton
(e.g., county and muncipal) wi only be recovered from those Customers residing in theafected jurisdictons.
2.6.2 Billig and Collecton of Charges
The Customer is responsible for payment of al charges incued by the Customer or other
users for services and facities fuhed to the Customer by the Company.
(A) Non-recg chages are due and payable with thty (30) days afr the date
the invoice is maied to the Customer by the Company.
(B) The Company shall present invoices for recg charges monthy to the
Customer, in advance of the month in which servce is provided, and recg
charges shal be due and payable with th (30) days afr the date the invoice is
maied to the Customer by the Company. When bilg is based upon Customer
usage, usage charges wi be biled monthy for the preceding bilg period.
(C) When servce doe not begi on the fist day of the bilg period, or end of the lat
day of the bilg period, the charge for the fraction of the month in which servce
was furnhed wi be calcuated on a pro rata basis. For th purpose, every month
is considered to have th (30) days.

(E) If any porton of the payment is not received by the Company with 30 days of
receipt of th bil, or if any porton of the payment is received by the Company in
fuds which are not imeditely avaible upon presetment, then a late payment
charge of 1.5% per month shal be due to the Company. A late payment charge is
not applicable to subsuent rebilg of any amount to which a late payment
charge has aleady ben applied. Late payment charges are to be applied without
dicrimtion.
(F) the Customer should noti the Company of any diputed items on an invoice
with sixty (60) days of receipt of the invoice. If the Customer and the Company
are unable to resolve the dipute to their mutual satifaction, the Customer may fie
a complaint with the Commsion in accordance with the Commsion's rues and

The date of the dispute shall be the date the Company receives sufficient
documentation to enable it to investigate the dipute. The date of the resolution

(G) If service is diconnected by the Company (in accordance with Setion 2.6.3followig) and later re-intaed, re-intaation of servce wi be subject to al
applicable intation charges. If servce is suspended by the Company (in
accordance with Seon 2.6.3 followig) and later restored, restoration of servce
wi be subjec to the rate in Setion 4.3.

2.6.4 Notice to Company for Cancellation of Servce
Customers desiring to termite service shall provide the Company th (30) days notice
of desire to termte servce. H special constrction is involved, the requied notice shal be

2.6.5 Cancellation of Application for Servce
(A) Where the Company permts the Customer to cancel an application for servce prior
to the stat of service or prior to any specl constrcton, no charges wi be imposed
except for those specifed below.
(B) Where, prior to cancelltion by the Customer, the Company incus any expe in
intag the servce or in preparing to inta the service that it otherw would not
have incurred, a charge equal to the costs the Company incued, less net salvage,
shal apply, but in no case shal th chage exceed the sum of the charge for the
mium period of services ordered, includig intation charges, and al charges
others levy agait the Company that would have ben chargeable to the Customer
had service begu.
(C) Where the Company incus any expee in connecon with special constrction, orwhere special arangements of facilties or equipment have begu, before the
Company receives a cancelltion notice, a charge equal to the costs incued, less net
salvage, may apply. In such cases, the charge wi be basd on such elements as the
cost of the equipment, facilties, and material, the cost of intation, engieerig,
labor, and supervion, general and admtrative expens, other dibursements,
deprecation, maitenace, taes, proviion for retu on investment, and any other
costs associated with the speial constrcton or arrangements.

2.6.6 Changes in Servces Requested
H the Customer makes or requests materi changes in circuit engieerig, equipment
specifcations, service parameters, premies locations, or otherwe materially modifes any
proviion of the application for servce, the Customet s intaation fee sha be adjuted
accordigly.
2.6.7 Bad Check Charge
A service charge of $20.00 wi be assesed for al checks retued by a ban or other
ficial intitution for: Inufcient or uncollected fuds, closed account, apparent
taperig, mising signtue or endorsement, or any other inufciency or dicrepancy
necessitatig return of the intrent at the discretion of the drawee ban or other fiancial
intitution.
2.7 Allowances for Interrptions in Servce
2.7.1 General
Credit for Interruptions: When the use of service or facilties furnhed by the Company is
interrupted due to any cause other than the negligence or wil act of the Customer, or
the operation or faiure of the facilties or equipment provided by the Customer, pursuant
to IDAPA 31.41.01 Rules 502 and 503 subject to interruption wi be alowed for the
service and facilties rendered useless and inoperative by reason of the interruption,
whenever said interruption contiues for a period of 24 hours or more from the tie the
interrption is reported to or known to exist by the Company, except as otherwe
specifed in the Company's tarifs. H the Customer report a service, facilty or circuit to
be inoperative but declies to release it for testig and repair, it is considered to be
impaired, but not interrupted.
For calculatig credit allowances, every month is considered to have 30 days. A credit
allowance is applied pursuant to IDAPA 31.41.01 Rules 502 and 503 based on the rates
specifed hereunder for Local Line or Local Tru Service and is dependent upon the
lengt of the interruption. Ony those facilties on the interrpted portion of the circuit
wil receive a credit. Credit alowances for service outages that exceed 24 hours in
duration wi be rounded up at the next whole 24 hours.

(D) The Customer shal be responsible for the payment of servce chages as set fortherein for viits by the Companý s agents or employee to the premies of the
Customer when the servce difculty or trouble report results from the use of
equipment or facilties provided by any par other than the Company, includig but
not lited to the Customer.
2.7.2 Limitations of Allowances
No credit alowance wi be made for any interrption in servce:
(A) interruptions due to the negligence of, or noncompliance with the provisions of thtariff by, the Customer, Authorized User, Joint-User, or other common carrier
providing service connected to the service of Company;
(B) interruptions due to the negligence of any person other than the Company
including, but not lited to, the Customer connected to the Company's facilties;
(C) interruptions due to the faiure or malfction of non-Company equipment;
(D) interruptions of service during any period in which the Company is not given full
and free access to its facilties and equipment for the purpose of investigatig and
correctig interruptions;

(E) interruptions of service during a period in which the Customer contiues to use the
service on an impaired basis;
(F) interruptions of service during any period when the Customer has released service
to the Company for maitenance purposes or for implementation of a Customer
order for a change in service arrangements;
(G) interruption of service due to circumstaces or causes beyond the control of the
Company.
2.7.3 Use of Another Means of Communcations
If the Customer elects to use another mean of communcations durig the period of
interruption, the Customer must pay the charges for the alternative servce used.
2.8 Cacellation of Servctiermation Liabilty
If a Customer cancels a service order or termate servces before the completion of the term for any
reason other than a servce interruption (as defied in Seon 2.7.1) or where the Company breaches
the term in the servce contract, Customer may be requested by the Company to pay to Company
termition libilty charges, which are defied below. These charges shal beome due and owig
as of the effecve date of the cancellation or termtion and be payable with the period set forth
in Setion 2.6.2.
2.8.1 Termnation Liabilty
Customer's termtion liabilty for cancelltion of service shal be equal to:
(A) al unpaid non-recurring charges reasonably expeded by Company to establih
servce to Customer, plus;
(B) any diconnection, early cancellation or termation charges reasonably incued and
paid to thd parties by Company on behal of Customer, plus;
(C) al recrig charges specifed in the applicable Servce Order for the balce of the
then current term discounted at the prie rate anounced in the Wall Street Journal on
the thd business day followig the date of cancellation;
(D) mius a reasonable allowance for costs avoided by the Company as a diect result of
Customer's cancelltion.

2.9 Tranfers and Assignents
Neither the Company nor the Customer may assign or tranfer its rights or duties in connection with
the services and facilties provided by the Company without the wrtten const of the other party,
except that the Company may assign its rights an duties to a) any subsidi, parent company or
afte of the Company; b) pursuant to any sale or tranfer of substatiy al the assets of the
Company; or c) pursuant to any fiancig, merger or reorgantion of the Company.
2.10 Flexible Pricing
Notice to Customers of rate changes shall be made in accordance with Idaho Code 62-606. Where
there are no regulations,. notication wi be made in a maner appropriate to the circumstaces
involved: A Customer can request that the Company disconnect service that is provided under
the Flexible Pricing due to a price increase. The customer wi be credited for the diference
between the new price and the old price retroactive to the effective date of the price increase if the
customer noties the Company of its desire to disconnect service with 20 days of receiving
notication of the price increase.

coordite, as referenced in Local Exchange Routig Guide issued by Bellcore, assocted
with each NPA-NX combination (where NPA is the area code and NX is the fist thee
digits of a seven-digit telephone number). Where there is not telephone number assocted
with an access lie on the Companýs network (such as a dedicated 800 or WATS access
lie), the Company wi apply the rate center of the Customets mai bilg telephone

5.7 PBX Tru Servce
Basic PBX Tru Service provides a Customer with a single, voice-grade telephonic communcations
chanel, which can be used to place or receive one cal at a tie. Basic Tru are provided for
connecon of Customer-provided private branch exchanges (pBX) to the public switched
telecommuncations network. Each Basic PBX Tru is provided with touch-tone signg and may
be confgued into a hunt group at no additional charge with other Company-provided Basic PBX
Tru. The sign is an anlog signal at the DS leveL.
5.8 Reserved for Futue Use
5.9 Direct Inward Dialng (DID) Servce
Direct Inward Dialig ("DID") permts call incomig to a PBX system or other Customer Premi
Equipment to be routed to a specc station without the assistace of an attndant. DID call arerouted diectly to the station associated with the caled number. DID servce as offered by the
Company provides the necessary tr, telephone numbers, and out-puling of digits to enables
DID service at a Customet s location. DID service requies specl PBX softare and hardware not
provided by the Company. Such hardware and softare is the responsibilty of the Customer.

(A) Flexible Cal Forwardig: Provides end-user control for cal forwarding capabilties via
dial-accessed voice prompt menus. Customers may forward cal to a pri local or
long ditace. The end-user may specif a secondar location for routig of go
unanwered at the forward-to location or reach a bus sign. Th secondar location
may be another telephone number, pager or voice messagig servce. Other capabilties
included with th featue include:
Spee Forwardig;
Priority Screenig;
Rig Control; and
Timed Forwardig.
It is the responsibilty of the Customer to subscbe to the telephone number, pager or
voice messagig servce used as the secondar location.

rigig interval before forwardig and the forward-to number are fied by the servce

conference controls the call and may diconnect the thd par to reetablih the
Òrigial connecon or establih a connection to a dierent thd party. The featue may
be usd on both outgoing and incomig cal.
(H) Multiple Diectory Number Distinctve Riging: Th featue alows an end user to
determe the source of an incomig cal from a distictive ring. The end user may
have up to two additiona numbers assigned to a single lie (i.e. Distictve Rigig -
First Number and Distictive Rigig - Seond Number). The designated priar
number wi receive a normal rigig pattrn; other numbers wi receive ditictive

of the end-usts Diecry Number and Direcory Name on al cal dialed from an
exchange servce equipped with th option. When active, the end-uset s telephone
name and number wi not appear on the caled partys Caler ID CPE or be dilosed in
another way. The featue is avaible on a per cal or per lie basis. With per cal
Calg Number Delivery Blockig, it is necessar for the end-usr to dial an activation
code prior to placing the cal. With the per lie version of the featue, al cal are
placed with the end-uset s number blocked. Per lie end-usrs must dial an activation

7.3 Standard Business Local Exchange Servce
Stadard Business Local Exchange Service provides the Customer with a single, anog, voice-grade
telephonic communcations chanel, which can be used to place or receive one cal at a tie.
Stadard Business Local Exchange Servce lies are provided for the connection of Customer-
provided wig, telephones, facsime machies or other station equipment. An optional per lie
Huntig featue is avaible for multi-lie Customers which route a cal to the next idle lie in a
prearanged group when the caled lie is busy.
Local exchange servce lies and tr are provided on a single par (individual) basis only. No
multi-par lies are provided. Service is available on a flt rate, measured rate or message rate
basis dependig on the servce plan selected by the Customer. Not all servce pla wi be available
in all areas.
Recing charges for Stadard Business Local Exchange Service are biled monthy in advance.
Usage charges, if applicable are biled in arears. Usage charges may apply for cal placed from the
Customets lie. No usage charges wi apply to cal received by the Customer. Non-recrrg
charges for intation or rearangement of service are biled on the next month's bil îmedtely
followig work performed by the Company.

7.5 Business PBX Tru Servce
PBX Tru servce provides a Customer with a single, voice-grade telephonic communcations
chanel which can be used to place one cal at a tie. Tru are provided for connection of
Customer-provided private branch exchanges (PBX) or other station equipment to the public
switched telecommuncations network.
PBX Tru are avaiable to Business Customers as Inward, Outward or Two-Way combination
tr where services and facilties permt.
Each PBX Tru is provided with Touchtone signg at no additional charge. An optional per
tr Huntig feature is avaible for Customers which route a cal to the next idle tr in a
prearanged group (se Setion 7.3).
PBX Tru may alo be equipped with Direc Inward Diag (OID) capabilty and DID number

7.6 Direct Inward Dialing (DID) Servce
Direc Inward Dialig ("DID") permts cal incomig to a PBX system or other Customer Premies
Equipment to be routed to a specifc station without the assistace of an attendant. DID cal arerouted diectly to the station associated with the caled number. DID servce as offered by the
Company provides the necessar tr, telephone numbers, and out-puling of digits to enable
DID servce at a Customet s location. DID servce requies speia PBX softare and hardware not
provided by the Company. Such hardware and softare is the responsibilty of the Customer.
The followig charges apply to Customers subscribing to DID servce provided by the Company.
These charges are in addition to recg and non-recing charges for PBX Tru as shown in
Setion 7.5 of th ta. The Customer wi be charged for the number of DID numbers utied out
of the avaiable 20 numbers.

8.1.1 The Company shal provide for a single diectory litig, termed the priar litig, in the
telephone diectory publihed by the domit local exchange servce provided in the
Customer's exchange area of the Station number which is designated as the Customer's
main bilg number. Diectory litigs of additiona Company Station numbers, other than
the Customer's mai bilg number, assocted with a Customer's service wi be provided
for a monthy recring charge per litig.

ISDN PRJ offers an array of value-added featues, such as callg number identication and call-
by-call selection that enhance productivity. ISDN PRJ is confgured with 23 64 Kbps bi-directional
B (Bearer) chanels and one 64 Kbps D (Data) chaneL. Unique to ISDN PRJ is its abilty to
designate the D chanel to handle all of the signalg and call control requirements and leave the
remaing 23 B chanels free for any mi of circuit-switched voice and data.

9.2 Digital DS-l PBX Service with Unlimited Local Calling
Th service provides a tr side DS1 electrical interface from the customet s digital PBX system
to a digita port on a local Company switch for the origiation and termiation of call. Trafc to
and from the digital PBX can be received or dialed directly from any PBX station without the
need for an attendant.
These digital trnk deliver a high-speed DS1 (Tl) connection between your PBX and the
Company network. There are up to 24 chanels on one facilty, each of which can be used to place
or receive call. Th multi-chanel capabilty dramatically reduces the need for additional PBX
circuit cards.
Each of these products is offered under a 12, 24 or 36 month term agreement. Rates include

ISDN BRI (Basic Rate Interface) uses stadard "twted pai" cables and is nearly thee ties
faster than a 56K dial up lie. ISDN PRI (Primary Rate Interface) uses a 1.54 Mbps digital
tranport facilty (Tl). Both services provide the superior clarity of digita tranmision, a high-
speed data interface and suffcient bandwidth capacity to fulf your current and future
communcation needs.
ISDN BRI consists of two 64 Kbps B (Bearer) chanels and one 16 Kbps D (Data) chaneL. Each B
channel has the abilty to integrate voice, data, image and video. The B chanels may be kept
separate or bonded together to deliver 128 Kbps.

designated carrier. Presubscription does not prevent a Customer who has presubscribed
to an IntraLATA or InterLATA toll carrier from using carrier access codes or additional
dialig to direct call to an alternative long distace carrier on a per call basis.
11.1.2 Presubscrption Options - Customers may select the same carrier or separate carriers for
intraLATA and interLATA long distance. The following options for long distace

Customer select the Company as the presubscribed carrier for
IntraLATA and InterLATA toll cal subject to presubscription.
Customer may select the Company as the presubscribed carrier for

Customer may select a carrier other than the Company for intraLATA
toll call subject to presubscription and the Company for interLATA toll
call subject to presubscription.
Customer may select the carrier other than the Company for both
intraLATA and interLATA toll call subject to presubscription.
Customer may select two dierent carriers, neither being the Company
for intraLATA and interLATA toll cal. One carrier to be the Customers'
primary intraLATA interexchange carrier. The other carrier to be the
Customer's primary interLATA interexchange carrier.
Customer may select a carrier other than the Company for no
presubscribed carrier for intraLAT A toll call subject to presubscription
which wil require the Customer to dial a carrier access code to route all
intraLA T A toll call to the carrier of choice for each call.

11.1.3 Rules and Reguations
Customers of record wi reta their priar interexchange carer(s) unti they request that
their dig arangements be changed.
Customers of record or new Customers may selec either Options A, B, C, D, E or F for
intraLA TA Presubscription.
Customers may change their selected Option and/ or presubscrbed toll carer at any tie
subjec to charges speced in 11.1.5 below:
11.1.4 PresubscrptionProcedures
A new Customer wi be asked to selec intraLATA and interLATA toll carers at the tie
the Customer places an order to establih local exchange servce with the Company. The
Company wi process the Customet s order for servce. Al new Customers inti requests
for intraLATA toll servce presubscrption shal be provided free of charge.
If a new Customer is unble to make selection at the tie the new Customer places an order
to establih local exchange service, the Company wi read a random litig of al avaible
intraLATA and interLATA carers to aid the Customer in selecon. If selection is sti not
possible, the Company wi inorm the Customer that he/ she wi be given 90 calendar days
in which to inorm the Company of hi/her choice for priar toll carer(s) free of charge.
Unti the Customer inorm the Company of hi/her choice of priar toll carer, the
Customer wi not have access to long ditace servces on a presubscribed basis, but rather
wi be requied to di a carer access code to route al toll cal to the carer(s) of choice.
Customers who inorm the Company of a choice for toll carer presubscption with the
90-day period wi not be assessed a servce charge for the intial Customer request.
Customers of record may intite an intraLATA or interLATA presubscription change at
any tie, subjec to the charges speifed in 11.1.5 below. If a Customer of record inquies
of the Company of the carriers avaiable for toll presubscription, the Company wi read a
random litig of al avaible intraLAT A carers to aid the Customer in selection.

SECTION 13.0 - PROMOTIONAL OFFRINGS I CONTRACT & ICB
13.1 Promotional Oferings
The Company, upon notication to Commsion, may make promotional offerings to its service
which may include waiving or reducing the applicable charges for the promoted service. The
promotional offerings may be lited as to the duration, the date and ties of the offerig and
the locations where the offerings are made.
13.2 Contract Rates / Individual Case Basis (ICB) Arangements
Competitive pricing arrangements at negotiated rates may be furnhed on an individual case
basis (ICB) in response to request by customers to Broadvox-CLEC, for proposals or for
competitive bids. Service offered under th taiff provision wi be provided to the Customer
pursuant to contract. Unless otherwise specifed, the regulations for such arrangements are in
addition to the applicable regulations and prices in other sections of th taif. Specialed rates
or charges wil be made availble to simarly situated Customers on a non-discrimatory basis.
Company wi provide the Commission with copies of any ICB contractual arrangements.
