PREHEARIN G CO NFEREN CE
This case was initiated by AT&T Corporation and AT&T Communications of the
Mountain States, Inc. (collectively "AT&T") regarding the rates charged to AT&T by Qwest
Corporation for use of Qwest' s telecommunications conduit in the State of Idaho. Qwest filed an
Answer and the parties thereafter submitted a proposed procedural schedule to the Commission
which the Commission adopted by a Notice of Procedural Schedule issued November 9, 2004.
The parties recently filed motions and cross-motions regarding discovery requests, which also
apparently has affected the procedural schedule as originally proposed. It therefore appears
appropriate to convene a prehearing conference and provide the parties an opportunity to resolve
discovery issues and adjust the procedural schedule.
YOU ARE HEREBY NOTIFIED that the Commission will convene a prehearing
conference in this case on FRIDAY, FEBRUARY 18, 2005 AT 10:00 A.M. IN THE
COMMISSION HEARING ROOM, 472 WEST WASHINGTON STREET, BOISE,
IDAHO a!!ID 334-0300 . The purposes of the prehearing conference are "formulating or
simplifying the issues, obtaining concessions of fact or of identification documents to avoid
unnecessary proof, scheduling discovery, arranging for the exchange of proposed exhibits or
prepared testimony, limiting witnesses, scheduling hearings, establishing procedure at the
hearings, discussing settlement offers or making settlement offers, and addressing other matters
that may expedite orderly conduct and disposition of the proceeding or its settlement."
NOTICE OF PREHEARING CONFERENCE
Commission Rule of Procedure 211 , IDAP 31.01.01.211. The parties are encouraged to
resolve as many issues prior to the prehearing conference as possible.
YOU ARE FURTHER NOTIFIED that all parties wishing to participate in the
prehearing conference by telephone may submit a written request to the Commission Secretary,
Idaho Public Utilities Commission, PO Box 83720, Boise, Idaho 83720-0074, no later than two
working days prior to the date set for the prehearing conference. Parties making such a request
will be informally notified prior to the prehearing conference whether their request has been
granted by the Commission.
YOU ARE FURTHER NOTIFIED that all hearings and prehearing conferences in
this matter will be held in facilities meeting the accessibility requirements of the Americans with
Disabilities Act (ADA). Persons needing the help of a sign language interpreter or other
assistance in order to participate in or to understand testimony and argument at a public hearing
may ask the Commission to provide a sign language interpreter or other assistance at the hearing.
The request for assistance must be received at least five (5) working days before the hearing by
