CASE NO. ATT-O4- NOTICE OF PROCEDURAL SCHEDULE On August 6, 2004, AT&T Corp., and AT&T Communications of the Mountain States, Inc. (collectively AT&T) filed a complaint against Qwest Corporation. On August 31 2004, Qwest filed its response to AT&T's complaint. On November 1 , 2004, the parties submitted a proposed procedural schedule to complete the case. YOU ARE HEREBY NOTIFIED that the Commission adopts the following procedural schedule: November 29 2004 Last day to serve discovery. Discovery responses due 14 days from date of service. January 3 , 2005 Last day to file Motions to Compel. If no Motions to Compel are filed, then the schedule is as follows: January 5, 2005 Deadline for parties to complete statement of stipulated facts. January 12, 2005 Parties file Motions for Summary Judgment. January 26, 2005 Parties file responses to Motions for Summary Judgment. Oral Argument to be scheduled. NOTICE OF PROCEDURAL SCHEDULE If Motions for Summary Judgment are denied: 21 days from service date of Commission Order on Motions for Summary Judgment parties file direct testimony Rebuttal testimony due 14 days after direct testimony filed. Technical hearing to be scheduled. If Motions to Compel are filed by deadline then the following schedule applies: January 17, 2005 Responses to Motions to Compel Week of January 31 Oral Argument on Motions to Compel 14 days from service date of Commission Order on Motions to Compel discovery responses to be served in accordance with Order. 14 days from service of discovery in accordance to Commission Order - parties complete statement of stipulated facts. 7 days from service date of statement of stipulated facts parties file Motions for Summary Judgment. 14 days from service date of Motions for Summary Judgment parties file responses to Motions for Summary Judgment. Oral Argument to be scheduled.
