SECTON 1.0 - DEFINIIONS
For the purpose of th ta, the followig defitions wi apply:
Access Line - An arangement which connec the Customer's location to a carer's switcg center or
point of presence.
Account Codes - Optional, Customer-defied digits that allow the Customer to identi the individual user,
department or client assocated with a cal. Account Codes appear on the Customer bil
Advance Payment - Part or al of a payment reuied beore the sta of servce.
Authorized User - A persn, fi, corporation, or any other entity authorid by the Customer to
communcate utiing the Company's servce.
Business - A class of servce provided to individual engaged in business, fi, parerships, corporations,
agencies, shops, works, tenats of offce buidigs, and individual practicig a profession or operatig a
business who have no. offces other than their residences and where the use of the servce is priarily or
substatialy of a business, professional or occupationa natue.
Commssion - Idaho Public Utities Commsion
Company or Caer - Aiesprig, Inc., uness otherw clealy indicate by the context.
Customer - The person, fi, corpration or other entity which orders, cancels, amends or uses servce and is
responsible for payment of chges and complice with the Company's ta.
Deposit - Refers to a cash or equivalent of cash secty held as a guarante for payment of the charges.

DID Tru - A form of local switched access that provides the abilty for an outside party to cal an intern
extension directly without the intervention of the Company operator.
Dial Pulse (or "DP") - The pule ty employed by rota dial station sets.
Dual Tone Multi-Frequency (or "DTMF") - The pule tye employed by tone dia station sets.
End User - Any person, fi, corporation, parership or other entity which uses the services of the
Company under the proviions and regulations of th tarif. The End User is responsible for payment
uness the charges for the services utied are accepted and paid for by another Customer.
End Ofice - With respect to each NP A-NX code prefi assigned to the Company, the location of the
Company's "end offce" for purposes of th ta shal be the point of interconnecon assocated with that
NP A-NX code in the Local Exchange Routig Guide ("LERG"), issued by Bellcore.
Hearg Impaired - Those persons with communcation impaiments, includig those hearing impaied,
deaf, deaf/blid, and speech impaired persons who have an impaiment tht prevents them from
communcatig over the telephone without the aid of a telecommuncations device for the deaf.
Huntig - Routes a cal to an idle station lie in a prearranged group when the called station lie is busy.
In-üy - A servce attbute that restrcts outward dia access and routes incomig cal to a designted
anwer point
IXC or Interexchange Carer - A long ditace telecommuncations servces provider.

Minimum Point of Presence ("MPOP") - The ma telephone closet in the Customer's buiding.
Monthly Recng Charges - The monthy charges to the Customer for servces, facities and equipment,
which contiue for the agreed upon duration of the service.
Multi-Frequency or ("MF") - An inter-machie pule ty usd for signalg between telephone switches, or
between telephone switces and PBX/key systems.
Non-Recurg Charge ("NRC") - The inti charge, usualy assesed on a one-tie basis, to intite and
establih service.
Other Telephone Company - An Exchange Telephone Company, other than the Company.
PBX - Prvate Branch Exchage
Premises - A buidig or buidigs on contiguous propert.
Recg Charges - The monthy chages to the Customer for servces, facities and equipment which
contiue for the agreed upon duration of the servce.
Residence or Residential- A class of service fuhed to a Customer at a place of dwellg where the actual
or obvious use is for domestic purose.

Servce Commencement Date - The fist day. followig the date on which the Company noties the
Customer that the requested servce is avaiable for us, uness exteded by the Customer's refual to accept
service which does not conform to stadards set fort in the Service Order and th tarif, in which cas the
Servce Commencement Date is the date of the Customer's acceptace. The Company and Customer may
mutualy agree on a substitute Servce Commencement Date.
Servce Order - The writtn request for servces exected by the Customer and the Company in the format
devised by the Company. The signg of an Order by the Customer and acceptace by the Company
intites the respective obligations of the parties as set fort therein and pursuant to th tarif, but the
duration of the servce is calcuated from the Servce Commencement Date.
Telecommuncations Company or Provider - Used thoughout th ta to mean Aiespring, Inc. uness
clearly indicated otherw by the text.
TBD - To Be Determied.
Two Way - A servce attbute that includes outward dial capabilties for outbound call and can alo be
used to car inbound call to a central point for fuer processing.
Usage Based Charges - Charges for miutes or messages traversing over local exchange facilties.
User or End User - A Customer, Joint User, or any other person authorid by a Customer to use servce
provider under th tarif.

SECTON 2.0 - RULES AND REGULATIONS
2.1 Undertaking of the Company
2.1.1 Scope
The Company undertes to fuh communcations servce pursuant to the term of th
ta in connecon with one-way and/or two-way inormation tranmision origiatig
from points with the State of Idaho, and termtig with a local calg area as defied
herein.
The Company is responsible under th ta only for the servces and facilties provided
hereunder, and it assumes no responsibilty for any servce provided by any other entity
that purchases access to the Company network in order to origite or termte its own
servces, or to communcate with its own Customers.
2.1.2 Shortage of Equipment or Facilities
(A) The Company reserves the right to lit or to alocate the use of existig facilties,
or of additiona facities offered by the Company, when necessar beaus of lack
of facities, or due to some other caus beyond the Company's control.
(B) The fuhig of servce under th ta is subject to the avaibilty on a
contiuig basis of al the neessa facities and is lite to the capacity of the
Company's facilties as well as facities the Company may obta from other
carers to fuh servce from tie to tie as requied at the sole dicretion of the
Company.

2.1.3 Terms and Conditions
(A) Service is provided on the basis of a mium period of at leat one month, 24
hours per day. For the purpose of computig charges in th ta, a month is
considered to have th (30) days.
(B) Customers may be requied to enter into wrtten servce orders which shal conta
or reference a specifc desption of the servce ordered, the rates to be charged, the
duration of the servces, and the terms and conditions in th ta. Customers wi
alo be requied to execte any other docuents as may be reasonably requested
by the Company.
(C) Except as otherwe stated in the ta, at the expiration of the inti term speced
in each Service Order, or in any extension thereof, service shal contiue on a month
to month basis at the then curent rates uness termited by either par upon
proper notice. Any termtion shall not relieve the Customer of its obligation to
pay any charges incued under the service order and th ta prior to
termtion. The rights and obligations which by their natue extend beyond the
termtion of the term of the servce order sha surive such termation.
(D) Service may be termated upon written notice to the Customer if:
. (1) the Customer is using the service in violation of th ta; or
(2) the Customer is using the service in violation of the law.
(E) Th tari shal be interpreted and governed by the laws of the State of Idaho
without regard for its choice of laws provision.

entity to obta servce diectly from the Company. No person or entity shal be
requied to make any payment, incur any penty, moneta or otherw, or
purch any servces in order to have the right to obta service diectly from the
Company.
(G) Resrved for futue us.
(H) The Company hereby resrves its rights to establih servce packages specifc to a
particu Customer. Thes contract mayor may not be associated with volume
and/ or term diounts.

2.1.4 Limitations on Liabilty
(A) The liabilty of the Company for damages arising out of the furnhig of its
Service, including but not lited to mitakes, omissions, interruption, delay, or
errors, or other defects, representations, or use of these services or damages
arising out of the failure to furnh the servce, whether caused by acts or
omision, shall be lited to the extension of allowances for interruption as set
forth in 2.7. The extension of such allowances for interruption shall be the sole
remedy of the Customer and the sole liabilty of the Company. The Company
wil not be liable for any diect, indirect, incidental, special, consequential, lost
profits, exemplary or puntive damages to Customer as a result of any Company
service, equipment or facilties, or the acts or omissions or negligence of the
Company's employees or agents.
(B) The Company's liabilty for will miconduct, jf establihed as a result of
judicial or admintrative proceedings, is not lited by th tarif. The
Company's liabilty, if any, with regard to delayed intaation of Company
facilties or commencement of service, shall not exceed $1,000. With respect to
any other claim or suit, by a Customer or by any others, for damage associated
with the ordering (including the reservation of any specific number for use with a
service), intallation (including delays thereof), proviion, termiation,
maintenance, repair, interruption of restoration of any service or facilties offered
under th taiff, and subject to the provisions of Setion 2.7, the Company's
liabilty, if any, shall be lited as provided herein.
(C) The Company shall not be liable for any delay or failure of performance or
equipment due to causes beyond its control, including but not lited to: acts of
God, fire, flood, explosion or other catastrophes; and law, order, regulation,
diection, action or request of the United States governent or of any other
governent, including state and local governments having or claiming
jurisdiction over the Company, or of any department, agency, commission,
bureau, corporation or other intrentality of anyone or more of these federal,
state, or local governments, or of any mitary authority; preemption of existig
service in compliance with national emergencies; inurrections; riots; wars;
unavailabilty of rights-of-way or materials, or strikes, lockouts, work stoppages,
or other labor dificulties.

(D) The Company sha not be lible for (a) any act or omision of any entity
fuhig the Company or the Company's Customers facilties or equipment
used for or with the servces the Company offers; or (b) for the acts or omissions
of common carers or warehousmen. Except in 31.41.01 Rule 501, 502, and 503
of the IDAP A.
(E) The Company shal not be lible for any damages or losses due to the fault of
negligence of the Customer or due to the failure or malfnction of Customer-
provided equipment or facilties.
(F) The Customer shal indemn and hold the Company harmless from any and all
loss, clai, demands, suits, or other action, or any libilty whatsoever, whether
sufered, made, intituted, or assertd by any other party or person(s), and for
any loss, damage, or destrction of any property whether owned by the
Customer or others, caus or claied to have ben caused directly or indirectly
by the intation, operation; faiure to operate, maitenance, removal, condition,
location, or use of intaation provided by the Company. The Company reserves
the right to requie each Customer to sign an agreement acknowledgig
acceptace of the proviions of th section as a condition precedent to such
intallations.
(G) The Company shall not be liable for any defacement of or damage to Customer
premies resultig from the fuhig of services or equipment on such premies
or the intallation or removal thereof, uness such defacement or damage is
caused by gross negligence or will miconduct of the Company's agents or
employees. No agents or employee of other partcipatig carriers shal be
deemed to be agents or employees of the Company.
(H) Notwthtading the Customer's obligations, the Company shall be indemnied,
defended, and held harmless by the Customer or by others authorized by it to
use the service agait any claim, loss of damage arising from Customer's use of
services fuhed under th tariff, including: claims for libel, slander, invasion
of privacy or iningement of copyright ariing from the material, data,
inormation, or other content transmitted via the Company's service; and patent
iningement claim arising from combing or connectig the service offered by
the Company with apparatus and systems of the Customer or others. All other
claim arising out of any act or omission of the Customer or others, in connection
with any service provided by the Company pursuant to th tarif.

(I) The entie liabilty of the Company for any claim, loss, damage or expense from
any cause whatsoever shall in no event exceed sums actually paid to the
Company by Customer for the specific services giving rise to the claim, and no
such action or preceding againt the Company shall be commenced more than
one year after the service is rendered.
(J The Company makes no warranties or representations, express or implied,including warranties of merchantabilty or fitness for a particular use, except
those expressly set forth herein.
(K) The Company shall not be liable for any act or omision of any other company orcompanes furnhig a portion of the service, or for damages associated with
service, chanels, or equipment which it does not furnh, or for damages which
result from the operation of Customer-provided systems, equipment, facilties or
services which are interconnected with Company services. Except in 31.41.01
Rule 501, 502, and 503 of the IDAP A.
(L) The Company does not guarantee nor make any warranty with respect to service
intallations at locations at which there is present an atmosphere that is
explosive, prone to fire, dangerous or otherwise unuitable for such intallations.
The Customer shall indemn and hold the Company harmess from any and all
loss, claim, demands, suits or other action, or any liabilty whatsoever, whether
sufered, made, intituted or asserted by the Customer or by any other party, for
any personal injur to, or death of, any person or persons, or for any loss,
damage or destrction of any property, whether owned by the Customer or
others, caused or claimed to have been caused, directly or indiectly, by the
intallation, operation, failure to operate, maitenance, removal, presence,
condition, locations or use of service furnihed by the Company at such locations.

(M) With respect to Emergency Number 911 Service:
(a) Th servce is offered solely as an aid in handing assistace call in
connection with fie, police and other emergencies. The Company is not
responsible for any losses, claim, demands, suits or any libilty whatsoever,
whether sufered, made, intituted or asserted by the Customer or by any
other par or person for any. personal injur to or death of any person or
persons, and for any loss, damage or destrction of any propert, whether
owned by the Customer or others, caused or claimed to have been caused by:
(1) mitaes, omisions, interruptions, delays, errors or other defects in theproviion of th service, or (2) intallation, operation, faiure to operate,
maitenance, removal, presnce, condition, location or use of any equipment
and facilties fuhig th service.
(b) The Company is not responsible for any iningement or invasion of the right
of privacy of any person or persons, caused or claimed to have been caused,
diecy or indiectly, by the intaation, operation, failure to operate,
maitenace, removal, presence, condition, occasion or use of emergency 911
service featues and the equipment associated therewith, or by any services
furnhed by the Company including, but not lited to, the identication of
the telephone number, address or name associated with the telephone used
by the par or pares accessing emergency 911 service, and which arise out
of the negligence or other wrongfl act of the Company, the Customer, its
users, agencies or muncipalities, or the employees or agents of anyone of
them.
(N) The Company's liabilty arising from errors or omisions in Directory Listigs,
other than charged litig, shall be lited to the amount of actual impaiment of
the Customer's service and in no event shall exceed one-hal the amount of the
fied monthy charges applicable to exchange service afected during the period
covered by the directory in which the error or omision occurs. In cases of

(0) When a Customer with a non-publihed telephone number, as defined herein,
places a call to the Emergency 911 Service, the Company wi release the name
and address of the calg party, where such inormation can be determed, to
the appropriate local governental authority responsible for the Emergency 911
Servce, upon request of such governental authority. By subscribing to service
under this tarif Customer acknowledges and agrees with the release of
inormation as described above.
(P) The included tarif language does not constitute a determination by the
Commsion that a litation of liabilty imposed by the Company should be
upheld in a court of law. Acceptace for fig by the Commission recognes
that it is a court s responsibilty to adjudicate negligence and consequential
damage claim. It is also the court s responsibilty to determine the valdity of
the exculpatory clause.
2.1.5 Notiication of Servce-Afectig Activities
The Company wi provide the Customer reasonable notication of service-affectig
activities that may occur in normal operation of its business. Such activities may include,
but are not lited to, equipment or facities additions, removal or rearangements and
routie preventative maitenance. Generally, such activities are not specifc to an
individual Customer but afec many Customers' servces. No specifc advance notication
period is applicable to al servce actvities. The Company wi work cooperatively with the
Customer to determe the reasonable notication requiements. With some emergency or
unplaed servce-afectig conditions, such as an outage resultig from cable damage,
notication to the Customer may not be possible.

(A) The Company shal us reanable effort to mainta only the facilties and
equipment tht it fuhes to the Customer. The Customer may not nor may theCustomer pet others to rearange, dionnect, remove, attmpt to repai, or
otherw intenere with any of the facilties or equipment intaed by the
Company, except upon the wrttn consent of the Company.
(B) The Company may substitute, change or rearange any equipment or facilty at any
tie and from tie to tie, but shal not thereby alter the tecal parameters of
the servce provided by the Customer.
(q Equipment the Company provides or inta at the Customer Premies for use in
connection with the servces the Company offers shal not be used for any purose
other than that for which the equipment is provided.
(D) Except as otherw indicate, Customer provided station equipment at the
Customer's premi for use in connecon with the servce shal be so constrcted,
maitaed and operate as to work satifactoriy with the facilties of the
Company.
(E) The Company sha not be responsible for the intation, operation, or
maintece of any Customer provided communcations equipment. Where such
equipment. is connecd to the facilties fuhed pursuant to th taif, theresponsibilty of the Company sha be lited to the fuhig of facilties offered
under th ta and to the maitenace and operation of such facities. Subject to
th responsibilty, the Company shal not be responsible for:
(1) the though tranmision of signal by Customer provided equipment or
for the qualty of, or defects in, such tranmision; or
(2) the reception of signal by Customer-provided equipment; or
(3) network control signg where such signg is performed by Customer-
provided network control signg equipment.

2.1.7 Non-Routine Instalation
At the Customer's request, intaation and/ or maitece may be performed outside the
Company's regu business hours or in hazardous locations. In such cass, charges based
on cost of the actual labor, materia, or other costs incued by or charged to the Company
wi apply. H intaation is stad durig regu business hours but, at the Customer's
request, extends beyond reguar business hours into tie periods includig, but not lited
to, weekends, holidays, and/ or night hours, additiona charges may apply.
2.1.8 Specal Constrction
Subject to the agreement of the Company and to al of the reguations contained in th
tarif, speial constrction or facilties may be undertaen on a reasonable efforts basis at the
request of the Customer. Speial constrction is constrction undertken:
(A) where facilties are not presently avaible, and there is no other requiement for the
facilties so constrctd;
(B) of a ty other than that which the Company would normally utie in thefuhig of its services;
(C) over a route other than that which the Company would normaly uti in the
furnhig of its services;
(D) in a quantity greater than that which the company would normaly constrct;
(E) on an expedited basis;
(F) on a temporar basis unti permanent facilties are avaiable;
(G) involvig abnorm costs; or
(H) in advance of its normal constrcton.

2.2 Prohibited Uses
22.1 The servces the Company offers sha not be us for any unwf purose or for any use
as to which the Customer has not obtaed al requied governental approval,
authoriztions, licen, consnts and permts.
2.2.2 The Company may requie applicants for service who intend to use the Company's
offerings for rese and/or for shared us to fie a lettr with the Company confg that
their use of the Company's offerigs complies with relevant laws and the Idaho
Commsion's reguations, policies, orders, and decions.
2.2.3 The Company may block any sign being tranmittd over its Network by Customers
which cause intenerence to the Company or other usrs. Customer shal be relieved of al
obligations to make payments for charges relatig to any blocked Servce and shal
indemn the Company for any cla, judgment or libilty resultig from such blockage.
2.2.4 A Customer, joint usr, or authorid usr may not assign, or tranfer in any maer, the
servce or any rights assoted with the servce without the wrttn consnt of the
Company. The Company wi permt a Customer to tranfer its exitig servce to another
entity if the exitig Customer has paid all charges owed to. the Company for reguted
communcations servces. Such a tranfer wi be treated as a diconnection of exitig
service and intaation of new servce, and non~recring intaation charges as stated in
th ta wi apply.

regulations; or by fie or theft or other casualty on the Customer Premies, uness
caused by the negligence or wi miconduct of the employees or agents of the
Company;
(C) providing at no charge, as specifed from tie to tie by the Company, any needed
equipment, space and power to operate Company facilties and equipmentintaed on the premies of the Customer, and the level of heatig and ai
conditionig necessar to mata the proper operatig environment on such
premies;
(D) obtaing, maitag, and otherw having fu responsibilty for all rights-of.
way and conduit necessar for intation of fiber optic cable and associted
equipment used to provide Communcations Services to the Customer from the
cable buidig entrance or property lie to the location of the equipment space
descrbed in Setion 2.3.1(C). Any and al costs associated with the obtag and
maintaing the rightsof-way described herein, including the costs of alterig the
strctre to permit intaation of the Company provided facilties, shal be borne
entiely by, or may be charged by the Company, to the Customer. The Company
may requie the Customer to demonstrate its complice with th section prior to
acceptig an order for service.

approval, licen and permts as may be requied with respect to, the location of
Company facities and equipment in an Customer premies or the rightsof-way
for which Customer is responsible under Setion 2.3.1(0); and grantig or obtag
permsion for Company agents or employee to enter the premis of the
Customer at any tie for the purose of intallg, inpectig, maintaing,
repaig, or upon termation of service as state herein, removig the facilties or
equipment of the Company;
(G) not creatig or allowig to be placed any liens or other encubrances on the
Company's equipment or facilties; and
(H) makg Company facilties and equipment avaible periodicaly for maintenace
purposes at a tie agreeable to both the Company and the Customer. No
allowance wi be made for the period durg which service is interrpted for such
purose.

2.3.2 Liabilty of the Customer
(A) The Customer wi be liable for damages to the facilties of the Company and for al
incidental and consequentil damages causd by the negligent or intetiona acts or
omisions of the Customer, its offcers, employees, agents, invite, or contractors
where such acts or omisions are not the direct result of the Company's negligence
or intentional miconduct.
(B) To the extent caused by any negligent or intentiona act of the Customer as
described in (A), precedig, the Customer shal indemn, defend and hold
harmess the Company from and agait al claim, actons, damages, libilties,
costs and expenses, includig reasonable attrneys' fees, for (1) any loss,
destrction or damage to propert of any thd party, and (2) any liabilty incued
by the Company to any thd party pursuant to th or any other ta of the
Company, or otherwe, for any interrption of, interference to, or other defec in
any servce provided by the Company to such thd part.
(C) The Customer shal not assert any clai agait any other Customer or usr of the
Company's servces for damages resultig in whole or in party from or aring in
connection with the furnhig of servce under th tarif including but not lited
to mitakes, omisions, interruptions, delays, errors or other defec or
mirepresentations, whether or not such other Customer or user contributed in any
way to the occurence of the damages, uness such damages were caused solely by
the negligent to intentional act or omision of the other Customer or usr and not
by any act or omision of the Company. Nothg in th ta is intended either to
lit or to expand Customer's right to assert any clai agait thd pares for
damages of any nature other than those described in the preceding sentence.

2.4 Customer Equipment and Chanels
2.4.1 General
A user may tranmit or receive inormtion or signal vi the facilties of the Company. The
Company's services are designte priary for the tranmision of voice-grade telephonic
signal, except as otherw stated in th ta. A user may tranmit any form of signal that
is compatible with the Company's equipment, but the Company doe not guarante that its
servces wi be suitable for purose other than voice-grade telephonic communcation
except as specaly stated in th ta.
2.4.2 Station Equipment
(A) Termi equipment of the user's premies and the elecic power consumed bysuch equipment shal be provided by and mataed at the expense of the user.
The user is responsible for the provision of wiing or cable to connect its termal
equipment to the Company MPP.
(B) The Customer is. responsible for enurg that Customer-provided equipment
connected to Company equipment and facilties is compatible with such equipment
and facilties. The magntude and chactr of the voltages and cuents impressed
on Company-provided equipment and wig by connection, operation, or
maitece of such equipment and wig shal be such as not to caus damage to
the Company-provided equipment and wig or injur to the Company's
employee or to other persons. Any additional protetive equipment requied to
prevent such damage or injur shal be provided by the Company at the
Customer's expens, subject to prior Customer approval of the equipment expense.

2.4.3 Interconnecton of Facilities
(A) Local Trafc Exchange provides the abilty for another local exchange provider to
termate local trafc on the Company's network. In order to quali for Local
Trafc Exchange the cal must (a) be origiated by an end user of a company that is
authorizd by the Commsion to provide local exchange servce; (b) origiate and
termate with a local callg area of the Company.
(B) Any specia interface equipment necessar to achieve compatibilty between the
facilties and equipment of the Company used for furnhig Communcations
Servces and the chanels, facilties, or equipment of others shal be provided at the
Customer's expense.
(C) Communcations Services may be connected to the servces or facilties of other
communcations carriers only when authoried by, and in accordance with, the
terms and conditions of the tarifs of the other communcations carriers which are
applicable to such connections.
(D) Facilties fuhed under th ta may be connected to Customer provided
termi equipment in accordance with the proviions of th tarif. Al such
termil equipment shal be regitered by the Federal Communcations
Commsion pursuant to Part 68 of Title 47, Code of Federal Regulations; and al
user-provided wiing shall be intalled and maitained in complice with those
regulations.

(A) Upon suitable notication to the Customer, and at a reasonable tie, the Company
may make such tets and inpections as may be necessar to determie that the
Customer is complyig with the requiements set forth in Seon 2.4.2(B) for the
intation, operation, and maintenace of Customer-provided facilties,
equipment, and wig in the connection of Customer-provided facilties and
equipment to Company-owned facilties and equipment. '
(B) If the proteve requiements for Customer-provided equipment are not being
complied with, the Company may tae such action as it deems necessary to protet
its facities, equipment and personnel. The Company wi noti the Customer
promptly if there is any nee for fuer corrective action. With ten days of
receivig th notice, the Customer must tae th corrective action and noti the
Company of the acton taen If the Customer fai to do th, the Company may
tae whatever additiona acton is deemed necessar, includig the suspension of
servce, to prote its facilties, equipment and personnel from har.
(C) If har to the Company's network, personnel or services is iment, the
Company reerves the right to shut down Customer's servce imediately, with no
prior notice requied.

2.6 Payment Arangements
2.6.1 Payment for Servces
The Customer is responsible for the payment of al charges for facilties and services
fuhed by the Company to the Customer.
The Customer is responsible for the payment of federal excis taes, state and local sales
and use taxes and simar taes imposed by governental jurdictions, al of which shal be
separately designted on the Company's invoices. Any taes imposed by a local jurisdiction
(e.g., county and muncipal) wi only be recovered from those Customers residig in the
afected jurisdictons.
2.6.2 Billing and Collecton of Charges
The Customer is responsible for payment of al charges incued by the Customer or other
users for services and facilties fuhed to the Customer by the Company.
(A) Non-recrring charges are due and payable with thty (30) days afr the date
the invoice is maied to the Customer by the Company.
(B) The Company shal present invoices for recrig charges monthy to the
Customer, in advance of the month in which servce is provided, and recurring
charges shal be due and payable with th (30) days afr the date the invoice is
maied to the Customer by the Company. When bilg is basd upon Customer
usage, usage charges wi be biled monthy for the precedig bilg period.
(C) When service doe not begi on the fist day of the bilg period, or end of the lat
day of the bilg period, the charge for the fraction of the month in which service
was fuhed wi be calcuated on a pro rata basis. For th purpose, every month
is considered to have th (30) days.

(D) Bilg of the Customer by the Company wi begi on the Service Commencement
Date, which is the day on which the Company noties the Customer that the
service or facilty is avaiable for use, except that the Servce Commencement Date
may be postponed by mutual agreement of the pares, or if the service or facity
doe not conform to stadards set fort in th ta or the Service Order. Bilg
accrues though and includes the day that the servce, circut, arrangement or
component is diontiued.
(E) If any porton of the payment is not received by the Company with 30 days of
receipt of th bil or if any porton of the payment is received by the Company in
fuds which ar not imedtely avaible upon prestment, then a late payment
charge of 1.5% per month shal be due to the Company. A late payment charge is
not applicable to subsuent rebilg of any amount to which a late payment
charge has aleady ben applied. Late payment charges are to be applied without
dicrimtion.
(F) the Customer should noti the Company of any diputed items on an invoice
with sixty (60) days of receipt of the invoice. If the Customer and the Company
are unble to reslve the dipute to their mutual satifacton, the Customer may fie
a complat with the Commsion in accordance with the Commsion's rues and

The date of the dispute shall be the date the Company receives suffcient
documentation to enable it to investigate the dispute. The date of the resolution
is the date the Company completes its investigation and noties the Customer of

followig) and later re-intaed, re-intaation of service wi be subject to al
applicable intation chages. If servce is suspended by the Company (in
accordance with Setion 2.6.3 followig) and later restored, restoration of servce
wi be subject to the rate in Setion 4.3.

The Company may dicontiue service for the followig reasons provided in th Seon
2.6.3. Customers wi be provided ten (10) days wrtt notice prior to diontiuance
uness otherwe indicated. Notice wil be provided via First Oass U.S. Mai.
Upon the Company's diontiuance of service to the Customer under Setion 2.6.3(A) or
2.6.3(B), the Company, in addition to al other remedies tht may be . avaible to the
Company at law or in equity or under any other proviion of th taif, may declare al
futue monthy and other charges which would have ben payable by the Customer durig
the remaider of the term for which such servces would have otherw ben provided to
the Customer to be imediately due and payable.
(A) Upon nonpayment of any amounts owig to the Company, the Company maydiontiue or suspend service without incug any liabilty. Company wi
comply with the Telephone Customer Relations Rule.
(B) Upon violation of any of the other material terms or conditions for furnhigservce the Company may, dicontiue or suspend servce without incug any
libilty if such violation contiues durg that period.
(C) Upon condemnation of any material porton of the facities usd by the Company
to provide service to a Customer or if a casualty renders al or any materia porton
of such facilties inoperable beyond feasible repai, the Company, by notice to the
Customer, may dicontiue or suspend servce without incug any libilty.
(0) Upon the Customer's inolvency, assignent for the benefit of creditors, fig forbanptc or reorganation, or faig to diharge an involuntary petition with
the tie permitted by law, the Company may imediately discontiue or suspend
service without incurring any liabilty. Company wi comply with Federal
Banruptcy law and rules.
(E) Upon any governental prohibition or governental required alteration of the
servces to be provided or any violation of an applicable law or regulation, the
Company may imediately diontiue servce without incug any libilty.

2.6.5 Cancellation of Application for Servce
(A) Where the Company permts the Customer to cancel an application for service prior
to the stat of service or prior to any specia constrction, no charges wi be imposed
except for those speifed below.
(B) Where, prior to cancellation by the Customer, the Company incurs any expenss in
intallg the service or in preparg to inta the servce that it otherwe would not
have incurred, a charge equal to the costs the Company incued, less net salvage,
shal apply, but in no case shal th charge exceed the sum of the charge for the
mium period of services ordered, including intation chges, and al charges
others levy agait the Company that would have be chargeable to the Customer
had service begu.
(C) Where the Company incurs any expene in connection with speia constrcton, or
where special arrangements of facilties or equipment have begu, before the
Company receives a cancellation notice, a charge equal to the costs incured, less net
salvage, may apply. In such cas, the charge wi be based on such elements as the
cost of the equipment, facilties, and material, the cost of intaation, engieerig,
labor, and supervion, general and admtrative expense, other dibursements,
depreciation, maitenance, taes, provision for retu on investment, and any other
costs associated with the special constrction or arangements.
(D) The special charges described in 2.6.5(A) though 2.6.5(Q wi be calculated and
applied on a case-by-case basis.

If the Customer maes or requests materi changes in circut engieerig, equipment
speccations, servce parametrs, premi locations, or otherwe materially modifes any
proviion of the application for servce, the Customer's intallation fee shall be adjuted
accordigly.
2.6.7 Bad Check Chge
A servce charge of $20.00 wi be. assesed for alchecksretumed by a ban or other
ficial intitution for: Inutcient or uncollected fuds, closed account, apparent
taperig, mising signture or endorsement, or any other inufciency or disrepancy
necessitatig retu of the intrent at the dietion of the drawee ban or other financial
intitution.
2.7 Allowances for Interrptions in Serce
2.7.1 General
Credit for Interrptions: When the use of service or facilties furnhed by the Company is
interrupted due to any cause other than the negligence or wi act of the Customer, or
the operation or faiure of the facilties or equipment provided by the Customer, pursuant
to IDAP A 31.41.01 Rules 502 and 503 subject to interruption wi be allowed for the
service and facilties rendered usless and inoperative. by reason of the interruption,
whenever said interrption contiues for a period of 24 hours or more from the tie the
interruption is reported to or known to exist by the Company, except as otherwise
specifed in the Company's tariffs. If the Customer report a service, facilty or circuit to
be inoperative but declies to release it for testig and repair, it is considered to be
impaired, but not interrupted.
For calculatig credit allowances, every month is considered to have 30 days. A credit
allowance is applied pursuant to IDAPA 31.41.01 Rules 502 and 503 basd on the rates
specified hereunder for Local Line or Local Trun Service and is dependent upon the
lengt of the interruption. Only those facilties on the interrupted portion of the circuit
wi receive a credit. Credit alowances for service outages that exceed 24 hours in
duration wi be rounded up at the next whole 24 hours.

(C) If the Customer reports a service, facilty or circut to be interrpted but declies to

(D) The Customer shal be responsible for the payment of servce charges as set fortherein for viits by the Company's agents or employees to the premies of the

2.7.2 Limitations of Allowances
No credit allowance wi be made for any interruption in servce:
(A) interruptions due to the negligence of, or noncompliance with the provisions of th
tarif by, the Customer, Authorized User, Joint-User, or other common carrier
providing service connected to the service of Company;
(B) interruptions due to the negligence of any person other than the Company
including, but not lited to, the Customer connected to the Company's facilties;
(C) interruptions due to the failure or malfction of non-Company equipment;
(D) interruptions of service during any period in which the Company is not given full
and free access to its facilties and equipment for the purpose of investigatig and
correctig interruptions;

2.7.3 Use of Another Mean of Communcations
If the Customer elec to us another mean of communcations durg the period of
interruption, the Customer must pay the charges for the alterntive service used.
2.8 Cancellation of Servcelermtion Liabilty
If a Customer cancels a service order or termte servces beore the completion of the term for any
reason other than a service interrption (as defed in Seon 2.7.1) or where the Company breaches
the term in the servce contract, Customer may be requested by the Company to pay to Company
termation liabilty charges, which are defied below. These charges shal beome due and owig
as of the effective date of the cancelltion or termtion and be payable with the period set fort
in Setion 2.6.2.
2.8.1 Termnation Liabilty
Customer's termition libilty for cancelltion of service shal be equal to:
(A) al unpaid non-recg chges reasonably expended by Company to establih
servce to Customer, plus;
(B) any diconnecon, early cancellation or termiation charges reasonably incurred and
paid to thd pares by Company on behal of Customer, plus;
(q al recrring charges speifed in the applicable Servce Order for the balance of the
then current term dicounted at the prie rate anounced in the Wall Street Journl on
the thd business day followig the date of cancellation;
(D) mius a reasonable alowance for costs avoided by the Company as a diect result of
Customer's cancelltion.

2.9 Transfers and Assignents
Neither the Company nor the Customer may assign or tranfer its rights or duties in connection with
the services and facities provided by the Company without the writtn consent of the other part,
except that the Company may assign its rights an duties to a) any subsidiar, parent company or
afate of the Company; b) pursuant to any sale or tranfer of substatiy all the assets of the
Company; or c) pursuant to any fiancing, merger or reorganation of the Company.
2.10 Flexible Pricing
Notice to Customers of rate changes shall be made in accordance with Idaho Code 62-606. Where
there are no regulations, notication wi be made in a manner appropriate to the circumtances
involved. A Customer can request that the Company disconnect service that is provided under
the Flexible Pricing due to a price increase. The customer wi be credited for the diference
between the new price and the old price retroactive to the effective date of the price increase if the
customer notiies the Company of its desire to disconnect service within 20 days of receiving
notication of the price increase.

Where charges for a service are specifed based on the duration of use, such as the duration of a
telephone call, the followig rules apply:

5.3.1 Ditace between two points is measured as ailie ditace between the rate centers of the
origitig and termtig telephone lies. The rate center is a set of geographic
coordinte, as referenced in Loal Exchange Routig Guide issued by Bellcore, associate
with each NPA-NX combintion (where NPA is the area code and NX is the fist thee
digits of a seven-digit telephone number). Where there is not telephone number associated
with an access lie on the Companýs network (such as a dedicate 800 or WATS access
lie), the Company wi apply the rate center of the Customer's mai bilg telephone
number.
5.3.2 The ailie ditace betwee any two rate centers is determed as follows:
Step 1: Obta the "V" (vertcal) and "H" (horinta) coordites for each Rate Center
from the above-refereced Bellcore docent.

The Stadard Business Line provides a Customer with a single, analog, voice-grade telephonic

or facsime maches. An optiona per lie Huntig featue is available for multi-lie Customers
which routes a cal to an idle station lie in a prearranged group when the caled station lie is bus.
5.7 PBX Tru Servce
Basic PBX Tru Servce provides a Customer with a single, voice-grade telephonic communcations
chanel, which can be usd to place or receive one ca at a tie. Basic Tru are provided for
connection of Customer-provided priate branch exchges (pBX) to the public switched
telecommuncations network. Each Basic PBX Tru is provided with touch-tone signalig and may
be confgued into a hunt group at no additiona charge with other Company-provided Basic PBX
Tru. The signal is an anog sign at the DS leveL.
5.8 Reserved for Futue Use
5.9 Direct Inward Dialg (DID) Servce
Direct Inward Diag ("DID") permts cal incomig to a PBX system or other Customer Premis
Equipment to be routed to a specifc station without the assistace of an attdant. DID cal are
routed diecy to the station assoted with the caled number. DID service as offered by the
Company provides the necessar tr, telephone numbers, and out-pulsing of digits to enables
DID servce at a Customer's location. DID servce requies specia PBX softare and hardware not
provided by the Company. Such hadware and softare is the responsibilty of the Customer.

5.11.1 Featues Descrptions
(A) Flexible Call Forwarding: Provides end-user control for call forwardig capabilties via
dial-accessed voice prompt menus. Customers may forward call to a priary local or
long ditace. The end-usr may specif a secondar location for routig of go
unanwered at the forward-to location or reach a busy signL. Th seondar location
may be another telephone number, pager or voice messagig service. Other capabilties
included with th feature include:
Speed Forwardig;
Priority Screenig;
Rig Control; and
Timed Forwardig.
It is the responsibilty of the Customer to subscribe to the telephone number, pager or
voice messagig servce usd as the secondary location.
(B) Call Forwarding Don't Answer: Permts the forwardig of incomig cal when the
end-usr's lie remain unanwered after a pre-esignted ringig interval. The
rigig interval before forwarding and the forward-to number are fied by the servce
order. However, the end-usr has the abilty to tu the feature on or off at hi/her
dicretion.
(q Call Forwarding Busy Line: Permts the forwardig of incomig call when the end-
user's lie is bus. The forwarded number is fied by the end-user servce order.

number cal received from up to six end-usr pre-selected telephone numbers
programmed into the featues screenig lit. The end-usr controls when the featue is

connecon. When the thd par anwers, a two-way conversation can be held before
addig the origi par for a theeway conference. The end-user intitig the
conference controls the call and may diconnect the thd par to reetablih the
origial connection or establih a connection to a dierent thd par. The feature may
be used on both outgoing and incomig call.
(H) Multiple Diecory Number Distinctve Rigig: Th featue alows an end usr to
determe the source of an incomig cal from a diticte rig. The end usr may
have up to two additiona numbers assigned to a single lie (i.e. Ditictive Rigig -
First Number and Distictive Rigig - Seond Number). The designted pri
number wi receive a normal rigig pattrn other numbers wi receive ditictive
ringig pattrn. The pattrn is based on the telephone number that the calg partydi.

remove telephone numbers and codes to j from the speed calg lit without assistace
from the Company.
(J Repeat Dialng: Permts the end-user to have cal automatically rediaed when the fistattmpt reaches a busy number. The lie is checked every 45 seconds for up to 30
miutes and alerts the Customer with a distictive rigig pattrn when the busy
number and the Customer's lie are free. The Customer can contiue to make and
receive cal whie the featue is activated. The followig tyes of call canot be

(K) Caller ID: Permts the end-user to view a Directory Name and Directory Number of the
calg party on incomig telephone cal. Inormation is displayed on a speciald
CPE not provided by the Company. The featue alo provides the date and tie of
each incomig cal. It is the responsibilty of the Customer to provide the necessar
CPE. In some situations, the calg partys city and state may be diplayed rather than
a Directory Name, dependig on avaible cal data.
(L) Ca Selector: Allows a Customer to assign a maximum of 15 telephone numbers to a
speial lit. The Customer wi hear a ditictive rig when cal are received from

(N) Cal Tracing: Alows the tracing of nuiance cal to a speifed telephone number
suspeted of origitig from a given local offce. The tracig is activated upon
enterig the speed di code. The origitig telephone number, outgoing tr
number or termatig number, and the tie and date are generated for every cal to
the specifed telephone number can then be identied.
(0) Cal Block: Alows the end-usr to automaticaly block incomig cal from up to six
end-user pre-selected telephone numbers programed into the featue's screenig lit.
Callers whose numbers have be blocked wi hear a recorded message statig that
their cal has be blocked. The end-user controls when the feature is active, and can
add or remove calg numbers from the feature's screenig lit.

(P) Cal Retu: Allows the Customer to retu a call to the lat incomig cal whether
anwered or not. Upon activation, it wi redi the number automaticaly and contiue
to check the number every 45 seconds for up to 30 miutes if the number is busy. The
Customer is alerted with a ditictive rigig pattrn when the busy number is free.
When the Customer anwers the ring, the cal is then complete. The callg pars
number wi not be delivered or anounced to the cal recipient under any
circutaces.
(Q) Anonymous Cal Rejection: Permts the end-user to automaticaly reject incomig call
when the cal origites from a telephone number which has blocked delivery of its
callg number (se Callg Number Delivery Blockig). When active, call from
private numbers wi be routed to a specia anouncement then termted. The featue
may be turned on or off by the end-usr by dialg the approprite featue control code.
Anonymous Call Rejecon is offered as a stad-alone featue or as an add-on to Caler
IDDeluxe.
(R) Caling Number Delivery Blockig: Prevents the delivery, display and anouncement
of the end-user's Directory Number and Direcory Name on al call dialed from an
exchange servce equipped with th option. When active, the end-user's telephone
name and number wi not appear on the caled pars Caler ID CPE or be disclosed in
another way. The featue is avaiable on a per cal or per lie basis. With per cal
Calg Number Delivery Blockig, it is necessar for the end-user to dial an activation
code prior to placing the cal. With the per lie version of the featue, all cal are
placed with the end-usr's number blocked. Per lie end-usrs must dia an activation
code prior to utition.
(S) Message Waitig Indication: Provides the end-user with an audible (stuttr di tone)
or viual (lp or other CPE diplay) indication that messages are waitig to be
retreved. Message Waitig Indication can only be actvatedj deactvated by a voice
maibox or other voice messagig service provided by the Company or thd party. It is
the responsibilty of the Customer to subscribe to a compatible voice messagig servce.
Visual Message Waitig Indication requies speciald CPE not provided by the
Company. It is the responsibilty of the Customer to provide the necessary CPE.

5.121 Non-Published Serce
Th optiona servce provides for suppression of prited and recorded diecory litigs. A
Customer's name and number do not appear in prited diectories or Directory Assistace
Bureau records.
5.122 Non-Listed Servce
Th optional service provides for suppression of prite diectory litigs only. Partes
may sti obtain the Customer's number by calg the Directory Assistace Bureau.
5.13 Directory Assistance
Provides for identiçation of telephone diecry nUmbers, vi an operator or automated platform.
Customers are provided with a maum of 21itigs per each cal to Diectory Assistace.
5.14 Miscellaneous Servces
5.14.1 Presubscption Servces
Th servce provides for the Presubsription of local exchange lies provided by the
Company to the intraLATA and interLATA long ditace carer(s) selected by the
Customer.
5.14.2 Pay Per Cal BlockiWUnblockig
Th servce provides the option of blockig, or subsequent unblockig, al 900 and 976 call
on a per lie basis. The Company wi provide for per-lie blockig where the Companý s
switchig facilties permt.

Huntig featue is availble for. multi-lie Customers which routes a cal to the next idle lie in a
prearanged group when the caled lie-is busy.
Local exchange servce lies and tr are provided on a single part (individual) basis only. No
multi-par lies are provided. Service is available on a flat rate, measured rate or message rate
basis depending on the servce plan selected by the Customer. Not al service pla wi be avaiable

Recurring charges for Stadard Residence Local Exchange Service are biled monthy in advance.

7.5 Business PBX Tru Servce
PBX Tru servce provides a Customer with a single, voice-grade telephonic communcations
chanel which can be used to place one call at a tie. Tru are provided for connection of
Customer-provided private branch exchanges (pBX) or other station equipment to the public
switched telecommuncations network.
PBX Tru are avaible to Business Customers as Inward, Outward or Two-Way combination
tr where servces and facilties permt.
Each PBX Tru is provided with Touchtone signalg at no additional charge. An optional per
tr Huntig feature is avaible for Customers which routes a cal to the next idle tr in a
prearanged group (see Section 7.3).
PBX Tru may alo be equipped with Direct Inward Dialig (DID) capabilty and DID number
blocks for additional charges (see Setion 7.6). Usage charges are lited in Setion 7.3.

7.6 Direct Inward Dialing (DID) Servce
Direct Inward Diag ("DID") permts cal incomig to a PBX system or other Customer Premies
Equipment to be route to a spec station without the assistace of an attndant. DID cal are
routed diecy to the station assocte with the caled number. DID service as offered by the
Company provides the necessa tr, telephone numbers, and out-puling of digits to enable
DID servce at a Customer's location. DID servce requies specal PBX softare and hardware not
provided by the Company. Such hardware and softare is the responsibilty of the Customer.
The followig chges apply to Customers subscrbing to DID servce provided by the Company.
These charges are in addition to recg and non-recg charges for PBX Tru as shown in

9.1 ISDN PRI Servce with Unlmited Local Caling
ISDN PRI offers an array of value-added featues, such as callg number identication and call-
by-call selection that enhance productivity. ISDN PRI is confgured with 23 64 Kbps bi-directional
B (Bearer) chanels and one 64 Kbps D (Data) chaneL. Unique to ISDN PRI is its abilty to
designate the D chanel to handle al of the signalg and call control requirements and leave the
remaing 23 B chanels free for any mi of circuit-switched voice and data.
Each of these products is offered under a 12, 24 or 36 month term agreement. Rates include

9.2 Digital DS-l PBX Servce with Unlimited Local Calling
Th service provides a tr side DSI electrcal interface from the customer's digita PBX system
to a digital port on a local Company switch for the origiation and termation of call. Traffic to
and from the digital PBX can be received or dialed directly from any PBX station without the
need for an attendant.
These digital tr deliver a high-speed DSI (Tl) connection between your PBX and the
Company network. There are up to 24 chanels on one facilty, each of which can be used to place
or receive cal. Th multi-chanel capabilty dramatically reduces the need for additional PBX
circuit cards.
Each of these products is offered under a 12, 24 or 36 month term agreement. Rates include

ISDN PRI offers an array of value-added featues, such as calg number identication and call-
by-call selection that enhance productvity. ISDN PRI is confgued with 23 64 Kbps bi-directional
B (Bearer) chanels and one 64 Kbps D (Data) chaneL. Unique to ISDN PRI is its abilty to
designate the D chanel to handle al of the signalg and cal control requirements and leave the
remaing 23 B chanels free for any mi of circut-switched voice and data.
This product is offered under a 12, 24 or 36 month term agreement. Rates include united local
callg for sent-paid, directly diaed cal. Rates do not include callg card cal, inormation tye
cal to Time and Weather, 555, 700, 900, 976 Services, Directory Assistace or any other type of
Operator Handled call.
The Unlted Local Callg and Bundled TolljLD Service Products are offered with six diferent
increments of TolljLD Minutes of Use: 5,000, 10,000, 15,000, 30,000, 50,000 and 100,000.
Intallation charges are included in the monthy recg charges. Regiona Toll and Long
Distace Services must be PIC'd to the Company.

9.4 Digital DS-l PBX Servce with Unlimited Local Callng and Bundled TolJlD Service
This service provides a trun side DSI electrical interface from the customer's digital PBX system
to a digital port on a local Company switch for the origition and termiation of cal. Trafc to
and from the digital PBX can be received or dialed directly from any PBX station without the
need for an attndant.
These digital trs deliver a high-speed DSI (Tl) connection between your PBX and the
Company network. There are up to 24 channels on one facilty, each of which can be used to place
or receive call. Thi multi-chanel capabilty dramatically reduces the need for additional PBX
circuit cards.
Each of these. products is offered under a 12, 24 or 36 month term agreement. Rates include
unted local callg for sent-paid, directly dialed call. Rates do not include callg card call,
inormation type call to Time and Weather, 555, 700,900,976 Services, Directory Assistance or
any other type of Operator Handled call.

ISDN BRI (Basic Rate Interface) uses stadard "twisted pair" cables and is nearly thee ties
faster than a 56K dial up lie. ISDN PRI (Primary Rate Interface) uses a 1.54 Mbps digital
tranport facilty (Tl). Both services provide the superior clarity of digital transmision, a high-
speed data interface and suficient bandwidth capacity to fulfil your current and future
communcation needs.
ISDN BRI consists of two 64 Kbps B (Bearer) chanels and one 16 Kbps D (Data) chaneL. Each B
channel has the abilty to integrate voice, data, image and video. The B channels may be kept

11.1 Carier Presubscription
11.1.1 General
SECTION 11.0 - MISCELLANEOUS SERVICES
Carrier Presubscrption is a procedure whereby a Customer designates to the Company
the carier which the Customer wihes to be the carier of choice for intraLAT A and
interLATA toll cal, Such cal are automatically diected to the designated carrier,
without the need to use carrier access codes or additional dialig to direct the call to the
designated carrier. Presubscription does not prevent a Customer who has presubscribed
to an IntraLATA or InterLATA toll carrier from using carrier access codes or additional
dialig to diect call to an alterntive long ditace carrier on a per call basis.
11.1.2 Presubscnption Options - Customers may select the same carrier or separate carriers for
intraLATA and interLATA long ditace. The following options for long distace
Presubscription are avaiable:

Customer may select two diferent carriers, neither being the Company
for intraLATA and interLATA toll cal. One carrier to be the Customers'

Customer may select a carrier other than the Company for no
presubscribed carrier for intraLAT A toll cal subject to presubscription
which wi require the Customer to dial a carrier access code to route all

11.1.3 Rules and Reguations
Customers of record wi retain their priar interexchange carer(s) unti they request that
their dialg arrangements be changed.
Customers of record or new Customers may select either Options A, B, C, D, E or F for
intraLATA Presubscription.
Customers may change their seleced Option andj or presubscribed toll carier at any tie
subject to charges speced in 11.1.5 below:
11.1.4 Presubscnption Procedures
A new Customer wil be asked to select intraLATA and interLATA toll cariers at the tie
the Customer places an order to establih local exchange servce with the Company. The
Company wi process the Customer's order for service. Al new Customers inti requests
for intraLAT A toll servce presubscription shal be provided free of charge.
If a new Customer is unble to make selection at the tie the new Customer places an order
to establih local exchange servce, the Company wi read a random litig of al available
intraLATA and interLATA carers to aid the Customer in selection. If selection is sti not
possible, the Company wi inorm the Customer that hej she wi be given 90 calendar days
in which to inorm the Company of hijher choice for priar toll carier(s) free of charge.
Unti the Customer inorms the Company of hijher choice of priary toll carer, the
Customer wi not have access to long ditace servces on a presubscribed basis, but rather
wi be required to dil a carer access code to route al toll cal to the carrier(s) of choice.
Customers who inorm the Company of a choice for toll carer presubscription with the
90-day period wi not be assessed a servce charge for the inti Customer request
Customers of record may intite an intraLATA or interLATA presubscrption change at
any tie, subjec to the charges speced in 11.1.5 below. If a Customer of record inquies
of the Company of the carers avaiable for toll presubscription, the Company wi read a

13.1 Promotional Oferigs
The Company, upon notication to Commsion, may make promotional offerings to its service
which may include waiving or reducing the applicable charges for the promoted service. The
promotional offerings may be lited as to the duration, the date and ties of the offering and
the locations where the offerings are made.
13.2 Contract Rates / Individual Cae Basis (ICB) Arangements
Competitive pricing arrangements at negotited rate may be furnhed on an individual case
basis (ICB) in response to request by cutomers to Aiesprig, for proposals or for competitive
bids. Servce offered under th tari provision wi be provided to the Customer pursuant to
contract. Unless otherwise specifed, the reguations for such arrangements are in addition to the
applicable regulations and prices in other setions of th taif. Specialied rates or charges wil
be made available to simarly situated Customers on a non-disrimatory basis. Company wil
provide the Commision with copies of any ICB contractual arrangements.
