HomeMy WebLinkAbout20180223final_order_no_33998.pdfOffice of the Secretary Service Date February 23,2018 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF ALEC,LLC'S REQUESTFOR ) CANCELLATION OF CERTIFICATE OF PUBLIC )CASE NO.ALE-T-09-01 CONVENIENCE AND NECESSITY NO.489 ) )ORDER NO.33998 On February 7,2018,ALEC,LLC (ALEC)requested that its Certificate of Public Convenience and Necessity (CPCN or Certificate)No.489 be cancelled.In its Decision Meetingon February 20,2018,the Commission addressed ALEC's request to cancel Certificate No.489. COMMISSION FINDINGS In November 2009,the Commission issued Order No.30944 granting ALEC Telecom, Inc.,a CPCN to provide local exchange telecommunications services within the State of Idaho. Certificate No.489 was issued to ALEC Telecom,Inc. In February 2012,ALEC Telecom,Inc.,requested that its CPCN be transferred to ALEC, LLC.On March 9,2012,the Commission issued Order No.32482 amending the name change from ALEC,Inc.to ALEC,LLC.A First Amended Certificate No.489 was issued reflecting the name change. On February 7,2018,the Commission received a letter asking that ALEC,LLC,be allowed to cancel the First Amended Certificate No.489.The Company stated that effective March 31,2018,it proposes to cease providing service in Idaho,and that the only customer it currentlyhas is its affiliate,Momentum Telecom Inc.(Momentum).The Company further stated that Momentum is fullyaware of the discontinuance,and to the extent necessary,Momentum will purchase services previously provided by ALEC from a third-party.Consequently,we cancel Certificate No.489 and direct Staff to remove the Company's tariff on file. ORDER IT IS HEREBY ORDERED that ALEC,LLC's request for cancellation of Certificate of Public Convenience and Necessity No.489 is granted.Certificate No.489 will no longerbe in effect after March 31,2018,and ALEC,LLC is no longer authorized to provide telecommunications services in the State of Idaho. ORDER NO.33998 1 THIS IS A FINAL ORDER.Any person interested in this Order may petition for reconsideration within twenty-one (21)days of the service date of this Order with regard to any matter decided in this Order.Within seven (7)days after any person has petitioned for reconsideration,any other person may cross-petition for reconsideration.See Idaho Code §§62-619 and 61-626.
