HomeMy WebLinkAbout20071009_2075.pdfDECISION MEMORANDUM TO:CO MMISSI 0 NER KJELLAND ER COMMISSIONER SMITH COMMISSIONER REDFORD COMMISSION SECRETARY COMMISSION STAFF FROM:DON HOWELL DATE:OCTOBER 5, 2007 SUBJECT:UPDATING THE COMMISSION'S SAFETY AND ACCIDENT REPORTING RULES, CASE NO. 31-1101-0701 On September 5, 2007, the Commission caused to be published in the Administrative Bulletin a Notice of Proposed Rulemaking. More specifically, the Commission proposed to update its Safety and Accident Reporting Rules by the adoption of the 2006 Editions of the International Fuel Gas Code and the International Mechanical Code. In addition to the updated safety codes, the Commission also proposed to adopt new pipeline outage reports promulgated by the Federal Energy Regulatory Commission (FERC) after Hurricanes Katrina and Rita. Accident Reporting Rules 301.03 and 302.04 would require the pipeline corporations report serious damage and interruptions to the state commissions as well as FERC. Comments were due September 26, 2007. No person filed comments regarding the Commission s proposed changes to the Safety and Accident Reporting Rules. The Commission did receive a letter from Legislative Services indicating that the Senate and House Subcommittees for Review of Administrative Rules had no objections to the proposed rule. COMMISSION DECISION: Given the lack of any adverse comments, does the Commission wish to adopt the proposed rule as its pending rule?
