NOTICE OF MODIFIED
PROCEDURE
YOU ARE HEREBY NOTIFIED that on September 24, 1997, Atlas Communications, Ltd. (Atlas) filed an Application with this Commission for a Certificate of Public Convenience and Necessity to provide resold local exchange carrier services within the state of Idaho. Atlas will offer resold, recurring flat rate local exchange services, EAS service, all control options, customer calling services and any other services available on a resale basis from the underlying incumbent local exchange carrier or other certified carrier.
Atlas states that it intends to resell exchange services that enable its customers to originate and terminate local calls to other customers served by Atlass network as well as to customers of other exchange carriers. Atlass resold exchange services will also provide customers the ability to assess their long distance interexchange carrier. Carrier access service resold by Atlas will include switched access services to interexchange carriers, which will allow interexchange carrier customers to originate and terminate interstate and intrastate calls to customers on Atlass network.
Atlass exchange services to be resold will include, but will not be limited to (1) local exchange access service to single line and multi-line business customers at the various points in the specified service areas; (2) local exchange usage service to customers of Atlass end user access services, and; (3) switched and special carrier access services to other common carriers. Atlas will provide emergency 911 access for all customers.
Atlas currently resells interLATA and intraLATA switched and dedicated out bound interexchange services and intraLATA and interLATA switched and dedicated in bound interexchange services within the state of Idaho. Atlas proposes to provide resold exchange services to subscribers from all points within the state of Idaho and, therefore, seeks statewide authorization. Specifically, Atlas seeks authority to resell local exchange services in the existing areas of U S WEST and GTE.
YOU ARE FURTHER NOTIFIED that the Application together with supporting workpapers, testimonies and exhibits, have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices.
YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission's jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under Title 61.
YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure, IDAPA 31.01.01.000 et seq.
YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission's Rules of Procedure, IDAPA 31.01.01.201 through -.204.
YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within twenty-one (21) days from the date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. Written comments concerning this application shall be mailed to the Commission and the Applicant at the addresses reflected below:
