COMMENTS ON PROPOSED
SETTLEMENT
The City of Eagle supports the Proposed Settlement entered into by SUEZ, Eagle Water
Company, and the PUC staff. The Proposed Settlement provides for a seven-year rate phase in
for existing Eagle Water Company customers who would be transitioning to receive water
service from SUEZ, and also includes a refund to existing Eagle Water Company customers to
further help offset the initial increase in rates for those customers moving to SUEZ.
The City of Eagle agrees with and supports the Commission’s adoption of the terms of
the Settlement and the approval of SUEZ’s acquisition of the assets of Eagle Water Company
upon the terms set forth in the Settlement.
The City of Eagle further supports the Proposed Settlement because the adoption of the
Proposed Settlement by the Commission will support and aid the implementation of the Water
Management Agreement separately agreed to by SUEZ and the City of Eagle as part of the

resolution of the City’s litigation with the Eagle Water Company and SUEZ concerning the
current transaction now pending before the Commission.
These comments of the City of Eagle are provided for the purposes of this PUC
proceeding only; the City specifically reserves its right to take and state other positions in any
other proceeding or context if the Settlement is not accepted or adopted by the Commission or if
SUEZ ultimately does not proceed with the acquisition of the assets of Eagle Water Company.
