Subject: Petition to Intervene in Case ISW-W-08-01 Idaho Springs Water Company
This document represents our Petition to Intervene per IPUC rule 71 in the above stated
water rate case.
We have a direct and substatial interest in the case in that we own and occupy a house at
11865 West Tustin Lane, Kuna in the Arowrock Rach subdivision served by Arbor
Ridge, LLC and its successor, Idaho Springs Water Co., Inc.
In addition, we request the Commission provide affrmative relief as described in our
formal complaint (see atthed) of Janua 31, 2008.

Dear Sir:
The following constitutes a formal complaint as defined in Rule 54 of the IPUC Rules of
Procedure.
Arbor Ridge, LLC, an Idaho Corpration, has been operaing as a for profit water
company since at least Januar 2007 without a Cerificate of Public Convenience and
Necessity (CPCN) as required in Idao Code Title 61. Arbor Ridge, LLC is not exempt
from this requirement, as they are not a homeowner's association, formal water distrct,
municipaliy or other mutual non-profit organization. Arbor Ridge has established and
modified rates and charges, biled and collected connection and service fees without
IPUC approval as required by Title 61 and IPUC Rules (IDAPA 31.21.01.000 et seq.)
Arbor Ridge, LLC has not applied for a CPCN as of January 22, 2008 per email from
Chris Hecht, WUC Utilties Compliance Investigator.
We request the IPUC order Arbor Ridge, LLC to repay to all paries served any and all
monies collected including connection and service fees, late charges and any other
charges ilegally collected durng the period of operation prior to the granting of a CPCN
by the IPUC. In addition, we request the IPUC impose a penalty on Arbor Ridge of
$2,000 for each occurrence (e.g., bil for service or connection, etc.) as allowed per Idaho
Title 61-706.
