I have spoken with my client, Eagle Water Customer Group (EWCG) regarding the question of potentially adopting a
Modified Procedure in this matter.
A Technical Hearing was held in the South County Water Company/United Water ldaho sale and transfer case no. UWI-
W-98-2 19981119order No 27798.pdf (idaho.gov). That matter resolved severalof the same issues involved in this
matter (e.g., purchase price v. value; acquisition adjustment; large percentage rate increase; proposed S-year phase-in
for rate-increase; and customer billing matters). An opportunity for cross-examination of witnesses by the
Commissioners, PUC attorneys, and counselforthe parties seems appropriate in this matter, as well.
EWCG therefore does not support adoption of a Modified Procedure in this matter and requests that a Technical
Hearing instead be held. We understand that this will not change the overall schedule/timeline for a Commission
decision, but believe it is important to the process, given the nature of the matter and the issues to be resolved by the
Commissioners.

As we discussed today, here are the issues Staff plans to address along with the dates and procedure that will be
recommended to the Commission at next week's decision meeting (August 31't). Please note that the date for the
technical hearing, if needed, has been moved to November tSth-from November 4th-due to a scheduling conflict with
the Commissioners. The proposed schedule also includes a customer workshop and a customer hearing-neither of
which we discussed during today's meeting.
